(“GSCI”) FOR THE COLORADO BOULEVARD SIDEWALK GAP CLOSURE AT NEWCASTLE PARK IN THE AMOUNT OF $183,833, AND A CATEGORICAL EXEMPTION PURSUANT TO SECTION 15301 CLASS 1(c) OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) Recommendation: Approve SUMMARY Colorado Boulevard between San Antonio Road and Santa Anita Avenue is an important connection between neighborhoods otherwise bisected by the Gold Line light rail line, and it lacks a continuous sidewalk. Recent projects completed by the Gold Line Authority and the private developer on the northwest corner of Colorado Boulevard and Santa Anita Avenue have filled much of this stretch with new sidewalk. To close the gap of missing sidewalk between San Antonio Road and the Gold Line Bridge along Colorado Boulevard, a sidewalk project was included in the 2017-18 Capital Improvement Program. The project was advertised in April 2018, and bids were opened on May 1, 2018. Four (4) bids were received, and Golden State Constructors, Inc. (“GSCI”) submitted the successful low bid in the amount of $183,833. It is recommended that the City Council approve, and authorize and direct the City Manager to execute, a contract with GSCI for the Colorado Boulevard Sidewalk Gap Closure at Newcastle Park. BACKGROUND Over the years, residents have asked the City to install sidewalks on Colorado Boulevard between San Antonio Road and Santa Anita Avenue to connect the neighborhoods bisected by the Gold Line rail. As part of the construction of the Gold Line, the City funded a betterment to lengthen the new bridge over Colorado Boulevard to add five-foot-wide sidewalks under the bridge on both sides of the street. Those short segments of sidewalk are in place, but are lacking connections. Award Contract Colorado Boulevard Sidewalk Gap Closure at Newcastle Park May 15, 2018 Page 2 of 3 In 2014, the owner of the property at 501 North Santa Anita Avenue, the northwest corner of Santa Anita Avenue and Colorado Boulevard, approached the City with plans to redevelop the site of the previous church. The property owner agreed to construct a sidewalk on the north side of Colorado Boulevard adjacent to the property, and create a landscaped parkway, in exchange for excess right-of-way vacation and project entitlements. On April 12, 2016, the Arcadia Planning Commission approved MFADR 14 -09, and a series of other actions, for the development of a 20 -unit residential condominium project at 501 North Santa Anita Avenue. The project was conditioned to construct sidewalk and a landscaped parkway adjacent to Colorado Boulevard. In 2017, the developer fulfilled this condition by constructing a five-foot sidewalk, a variable width planter area, and a retaining wall. The sidewalk now extends from Santa Anita Avenue to the west side of the Gold Line Bridge. In anticipation of this activity, a sidewalk project was included in the 2017-18 Capital Improvement Program to close the gap of missing sidewalk between San Antonio Road and the Gold Line Bridge. In order to widen the existing two-foot strip of concrete to a five-foot wide sidewalk, a variable height retaining wall is required to be able to cut-back and support the existing slope. The new wall will only need to be high enough to intersect the existing slope, and will not be as high as the retaining wall on the other side of the bridge. The wall will have a concrete finish to match the other wall. The project was estimated for budget purposes a year ago at $150,000, and was based on very limited information. During design, it became apparent that the wall was going to be more expensive than the budgeted amount, due to the size and depth of the wall, and the connections to the existing bridge and the concrete slope. Upon completion of the design, the engineer’s estimate was $200,000. DISCUSSION The project was advertised for bids in April 2018, and bids were opened on May 1, 2018. Bids were received from four (4) prospective contractors with the following results: Company Amount Golden State Constructors, Inc. (GSCI) $183,833.00 EC Construction $231,345.02 Vido Samarzich Inc. $249,042.00 Cal Pro Max Engineering Inc. $292,518.00 Award Contract Colorado Boulevard Sidewalk Gap Closure at Newcastle Park May 15, 2018 Page 3 of 3 After reviewing the bid documents, GSCI was determined to be the lowest responsible bidder. GSCI has been in existence for 13 years, and is a qualified and competent contractor. Although they have not previously worked for the City of Arcadia, they have completed similar and larger projects for the City of Irvine, the County of Orange, and the Tustin Unified School District. It is determined that GSCI can satisfactorily perform the required work. ENVIRONMENTAL IMPACT The project is categorically exempt per Section 15301 class 1(c) of the California Environmental Quality Act (“CEQA”). FISCAL IMPACT This project was budgeted in the Fiscal Year 2017-18 Capital Improvement Program, with $150,000 from the Road Maintenance and Rehabilitation fund (SB 1). The low bid is in the amount of $183,833. Because the sidewalk and ramps portion of this project meets the eligibility requirements of the City’s Miscellaneous Ramps and Sidewalk project, also budgeted in this Fiscal Year CIP, in the amount of $50,000 from TDA Article 3 funds, the Colorado Boulevard project will utilize this funding to fully fund the project. No General Fund monies are needed for this project . RECOMMENDATION It is recommended that the City Council approve, and authorize and direct the City Manager to execute a contract with Golden State Constructors, Inc. (“GSCI”) for the Colorado Boulevard Sidewalk Gap Closure at Newcastle Park in the amount of $183,833; and determine the project is categorically exempt pursuant to Section 15301 Class 1(c) of the California Environmental Quality Act (“CEQA”). Such amount shall be subject to adjustment in accordance with the applicable terms of this Contract. All Work shall be subject to, and performed in accordance with the above referenced documents. 3.3 Standard of Performance. Contractor shall perform all Work under this Contract in a skillful and workmanlike manner, and consistent with the standards generally recognized as being employed by professionals in the same discipline in the State of California. Contractor represents and maintains that it is skilled in the professional calling necessary to perform the Work. Contractor warrants that all employees and subcontractors shall have sufficient skill and experience to perform the Work assigned to them. Finally, Contractor further represents that it, its employees and subcontractors have all licenses, permits, qualifications and approvals of whatever nature that are legally required to perform the Work, and that such licenses and approvals shall be maintained throughout the term of this Contract. Contractor shall perform and complete all Work under this Contract within 30 working days, beginning ten (10) calendar days after the date on which the Notice to Proceed is sent by the Owner to the Contractor. Moreover, Contractor shall perform its Work in strict accordance with any completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications. Contractor agrees that if such Work is not completed within the aforementioned period and/or pursuant to any such completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications, it is understood, acknowledged and agreed that the Owner will suffer damage. Pursuant to Government Code Section 53069.85, Contractor shall pay to the Owner as fixed and liquidated damages the sum of Two Hundred Fifty Dollars ($250) PER DAY as provided by the applicable provisions of the General Conditions, found in Part "B" of the Contract Appendix. 3.5 Owner's Basic Obligation. Owner agrees to engage and does hereby engage Contractor as an independent contractor to furnish all materials and to perform all Work according to the terms and conditions herein contained for the sum set forth above. Except as otherwise provided in the Contract, the Owner shall pay to Contractor, as full consideration for the satisfactory performance by the Contractor of the services and obligations required by this Contract, the above referenced compensation in accordance with compensation provisions set forth in the Contract. 3.6 Contractor's Labor Certification. Contractor maintains that he is aware of the provisions of Section 3700 of the California Labor Code which require every employer to be insured against liability for Worker's Compensation or to undertake self-insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Work. A certification form for this purpose is attached hereto as Exhibit “A” and incorporated herein by reference, and shall be executed simultaneously with this Contract. 3.7 Attorneys' Fees. If either party commences an action against the other party, either legal, administrative or otherwise, arising out of or in connection with this Contract, the prevailing party in such action shall be entitled to have and recover from the losing party reasonable attorneys' fees and all other costs of such action. 3.8 Successors. The parties do for themselves, their heirs, executors, administrators, successors, and assigns agree to the full performance of all of the provisions contained in this Contract. Contractor may not either voluntarily or by action of law, assign any obligation assumed by Contractor hereunder without the prior written consent of the Owner.
