Subject: Complaint of Discrimination, Docket Number PCR-11-21
Dear Ms. Somogyi:
This in in response to the complaint filed against the city of Arcadia(Arcadia), dated March 31,
2010, which was assigned to the Bureau of Reclamation(Reclamation) for investigation. The
complaint was accepted for investigation by the Department of the Interior on November 1,
2010, under authority of Title II of the Americans with Disabilities Act of 1990 (42 U.S.C.
12131) (Title II of the ADA). Title II of the ADA prohibits discrimination on the basis of
disability in services,programs, and activities provided by State and local governments
regardless of whether these entities receive Federal financial assistance.
The complaint alleged that Wilderness Park.failed to provide ADA compliant restrooms to
visitors.
Reclamation completed its investigation into the alleged complaint of discrimination against the
city of Arcadia. Based on our investigation,Reclamation determined that there was no violation
of Title II of the ADA. The city of Arcadia was made aware of the issue concerning restroom
facilities at Wilderness Park and took action to secure funding, and construct ADA compliant
restrooms at the site. As a result of the actions taken by the city of Arcadia,Reclamation is
closing this complaint effective August 16,2016.
Under the Freedom of Information Act, 5 U.S.C. § 552, Reclamation may be required to release
this information and related correspondence and records related to your complaint in response to
a request from a third party. In the event,that Reclamation receives such a request, Reclamation
will safeguard,to the extent provide by law,personal information that would constitute an
unwarranted invasion of privacy.
