Wray, Deputy Director of Development Services/City Engineer SUBJECT: RESOLUTION NO. 7219 APPROVING PARCEL MAP NO. 70963, REJECTING THE DEDICATION OF A STREET RIGHT-OF-WAY AND EASEMENT FOR UTILITY PURPOSES ON THE MAP, AND RESERVING THE RIGHT TO ACCEPT THE STREET RIGHT OF WAY AND EASEMENT IN THE FUTURE Recommendation: Adopt SUMMARY On July 17, 2009, the Arcadia Planning Commission approved Parcel Map 70963 subject to Conditions of Approval. The Parcel Map is to split the existing 135-foot wide by 230-foot deep lot that fronts on Santa Anita Avenue (1512 South Santa Anita Avenue) to construct a new single-family residence on each lot. Santa Anita Terrace terminates at the subdivision’s easterly boundary. The map offers a public street dedication to the City for the future extension of Santa Anita Terrace as a cul-de-sac and an easement for public utility purposes. The street right-of-way and the utility easement are not necessary until the development of Lot 2. Parcel Map 70963 is now ready for approval and recordation. In consideration of the developer’s offer of the dedication and easement, it is recommended that the City Council adopt Resolution No. 7219 to accept the map, but reject the street right-of-way and easement for utility purposes at this time, and reserve the right to accept the street and easement in the future as a part of Parcel Map 70963. BACKGROUND In 2008, a Tentative Parcel Map Application was submitted to the City for a two-lot, single-family residential subdivision at 1512 South Santa Anita Avenue. The size of the new lots will be 20,925 sq. ft. for Lot 1, and 8,288 sq. ft. for Lot 2. Lot 1, the westerly lot, fronts on Santa Anita Avenue, and Lot 2, the easterly lot, will connect to Santa Anita Terrace as an extension from its terminus. Currently, Santa Anita Terrace terminates at the easterly subdivision boundary, and the Parcel Map proposes to extend the street as Resolution No. 7219 (1512 S. Santa Anita Ave.) June 19, 2018 Page 2 of 2 a 1,837 square-foot half cul-de-sac bulb, measured separately from the two lots, to serve Lot 2. The other half of the cul-de-sac bulb would be dedicated from the adjacent northerly property in the event that property is subdivided. A public utility easement for drainage and public utilities is also proposed on the property for the benefit of the street right of way and Lot 2. It was determined that because the cul-de-sac extension and the easement have no benefit to the City until development of Lot 2 occurs, there is no need to build the half cul-de-sac now. On July 17, 2009, the Arcadia Planning Commission approved Parcel Map 70963 subject to Conditions of Approval. Clearly, a great deal of time has elapsed since the original approval. There were a number of reasons for this. Because the tentative map was approved during the recession, various state Assembly Bills granted automatic time extensions to July 14, 2017. Before the map can be recorded, the existing home on the property (several structures) must be demolished because it encumbers both proposed lots. In an effort to obtain a Certificate of Demolition, the applicant had the existing structures evaluated for historic significance. The first evaluation of the property was done in May 2016 and the evaluator found one of the structures to be eligible for listing on the California Register of Historic Places. A second evaluation of the structures was done in October 2017, and this evaluator determined that there were no significant structures on the property. Both evaluations were submitted to the City and the City’s consultant reviewed both documents, as well as completing additional research, and agreed that there are no significant structures on the property. The Certificate of Demolition application was approved on January 8, 2018. During the evaluation period, the owner requested and received one final one-year time extension from the City to July 14, 2018. The requirement for construction of the half cul-de-sac for Santa Anita Terrace is not a condition of the final map, and will be required as part of the development of Lot 2. DISCUSSION Final Parcel Map No. 70963 is now ready for approval and recordation. The half cul-de- sac public street for Santa Anita Terrace was designed by the project engineer, and is approved and on file with the City. The cul-de-sac right-of-way and the utility easement are offered for dedication on the map. The recommendation is to reject the offer of dedication and the easement now, but reserve the right to accept them in the future when the need arises. It is of no benefit to the City to accept the dedication and easement now, and the City would be liable for the property even though it would not be improved. When development of Lot 2 occurs, the development will be required to construct the Santa Anita Terrace half cul–de-sac to provide access. At that time, the City will accept the dedication for the public street, and the easement for utility purposes. Resolution No. 7219 (1512 S. Santa Anita Ave.) June 19, 2018 Page 2 of 2 ENVIRONMENTAL ANALYSIS The proposed dedication is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to Section 15301(c) because the action will result in negligible or no expansion of use. FISCAL IMPACT There will be no fiscal impact incurred by the City as a direct result of this action. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 7219 approving Parcel Map No. 70963, rejecting a dedication of street right-of-way and an easement for utility purposes on the map, and reserving the right to accept the street right of way and easement in the future.
