HomeMy WebLinkAbout06/05/2018 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, JUNE 5, 2018 1. CALL TO ORDER— Mayor Amundson called the regular meeting to order at 7:00 p.m. 2. INVOCATION — Reverend Terry Keenan, Santa Anita Church 3. PLEDGE OF ALLEGIANCE — Lawrence Papp, Retired United States Navy 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEMS City Attorney Deitsch reported that prior to the regular meeting, the City Council met in Closed Session to consider the four (4) items listed on the posted agenda, and no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that there was no supplemental information. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tern Tay, seconded by Council Member Chandler, to read all ordinances and resolutions by title only and waive the reading in full. COUNCIL COMMENTS City Manager Lazzaretto stated that last Friday, the City Council held a goal setting/team building workshop; that Mayor Amundson earlier indicated that he would like to move a portion of the City Council comments forward to allow the City Council to make comments relating to the goal setting/team building workshop. Mayor Pro Tern Tay thanked City Manager Lazzaretto for setting up the team building workshop; he indicated that during the team building session, the City Council was able to talk freely and communicate with each other, and he was able to understand what was upsetting his colleagues. He stated that, during the recent City Council election, he sent a mailer out that stated the City Council did not support his proposal regarding public safety; he indicated that the entire City Council supports public safety and wants to provide outstanding safety service for the residents and that he regrets his choice of words; he stated that moving forward he recognizes that facts matter, especially when his name is used, and looks forward to working with the entire City Council in years to come. 1 06-05-2018 Council Member Chandler commented on the Vietnam War Memorial and the Arcadia Rotary Field of Honor with the display of flags; he stated the team building workshop was positive; that this election created a tremendous amount of friction and felt that this was the most contentious election in memory; he stated that it was time to move on, and that public safety needs to be supported wholeheartedly; that unfortunately the mailer was written by a consultant who used a couple of terms that were not true, which hurt other people; he thanked Mayor Pro Tem Tay and appreciates that he accepted the fact that he put out a little bit of bad information. Council Member Beck asked Mayor Pro Tern Tay if the statements he made in the mailers sent out were not true and in poor judgment, and asked him if he regrets it; and indicated that he wants to hear that the statements were not true. In response to Council Member Beck's questions and comments, Mayor Pro Tern Tay responded that the statements made were not true, and which he had already admitted. Council Member Beck stated that the problem he had was that as a sitting Council Member sending out mailers about how dangerous the City is was made in poor judgment, and that he accepts Mayor Pro Tem Tay's apology; he feels that Friday's workshop was good and an important one; he indicated that he wants to get along and have a good working relationship; he indicated that this is not just about Mayor Pro Tem Tay individually, and explained that if any other Council Member sent out a mailer with untrue statements, he would have a problem; and the City Council wants to move forward; he explained that the election was very hard on everyone, and noted that the districting caused some unintended consequences; and he apologized to the public if the City Council has offended anyone; he stated that everyone makes mistakes, and we all want Arcadia to be a harmonious City, and continue to be the City with great services, great beauty, great people, and great volunteers. Mayor Amundson called last call for speaker cards. Council Member Verlato stated that she was surprised how well the outcome was at the team building session on Friday, and did not expect that differences would be resolved; she stated that she definitely feels it is a step in the right direction; she stated that she appreciated Mayor Pro Tem Tay's comments; she stated that the contention on the City Council was bleeding out to the community and is ready to accept Mayor Pro Tern Tay's apology, and thanked him for that; and stated that she is looking forward to building a stronger relationship with her colleagues on the City Council. Mayor Amundson indicated that he also felt betrayed by some of the comments made by Mayor Pro Tern Tay; he stated that all votes regarding public safety have been 5-0; he thanked Mayor Pro Tern Tay for his apology, and accepts it, and looks forward to working with the City Council as a whole. 8. PRESENTATIONS a. Presentation of the Spring Home Awards by the Arcadia Beautiful Commission. Mayor Amundson introduced the Spring Home Awards and Arcadia Beautification Committee. He and Jan Shimmin displayed the winning homes and presented the winners with certificates. b. Presentation of a $1,000 Ostashay Scholarship to Arcadia Police Explorer Yulissa Hernandez by the Friends of the Arcadia Historical Society. 2 06-05-2018 9. PUBLIC COMMENTS In order to allow the public some context prior to the public comment period, Mayor Amundson asked each Council Member to state their current preference for Mayor. Council Member Beck indicated his preference for Mayor would be Sho Tay. Council Member Chandler indicated his preference for Mayor would be Sho Tay, and he would nominate him at the appropriate time. Council Member Verlato indicated her preference for Mayor would be Sho Tay in appreciation for his comments tonight. Mayor Pro Tern Tay thanked the Mayor and Council Members. Mayor Amundson also indicated his preference for Mayor would be Sho Tay, and stated that he appreciated his attitude and words, and felt it was time to heal. City Manager Lazzaretto announced that the Mayor had set the time limit for speakers to two minutes. Roy McMeen, who had submitted a speaker card, declined to comment. Marci Schultz, an Arcadia resident, appeared and spoke about the shame and notoriety brought upon the City by district elections; she commented on the 45-day cooling off period; she expressed concern with Mr. Tay's actions; and indicated bad behavior should not be rewarded, apology or not. Scott Steindler, an Arcadia resident, appeared and indicated that he was bothered by the April City Council meeting at which people encouraged voting based on race; he suggested decisions be based on what was best for the City; and encouraged better behavior at the next election. John McMahon, an Arcadia resident, appeared and thanked Mayor Amundson for the 45-day day cooling off period; indicated that personal attacks did not help; commented on the Council's team building meeting and thanked the City Council; urged decisions be made in the best interest of the entire city and urged the City Council to move forward; and noted everyone was an immigrant or decedent of immigrants and came to America for a promise for a better life. Tina Sweet, an Arcadia resident, appeared and spoke about integrity and suggested those with integrity be put in office. Roger Nemrava, an Arcadia resident, appeared and discussed changes to the City; he commented on illegal voting and mean spiritedness and hope that things would change following Mr. Tay's apology; and encouraged prioritizing the $130 million long term debt. Dean Radle, an Arcadia resident, appeared and expressed appreciation that the City Council was united; he suggested more frequent team building workshops; and spoke about false accusations and comments made in the Sierra Madre Tattler. 3 06-05-2018 Lindy Bell, an Arcadia resident, appeared and expressed appreciation for the City Council's efforts to return harmony; she indicated support for Mr. Tay serving as Mayor; she thanked Mr. Amundson for serving as acting Mayor; and urged efforts for a harmonious Arcadia. David Phung, an Arcadia resident, appeared and discussed his involvement in the community; he commented on school safety; he expressed concerns regarding public safety and criminal activity; he spoke about Prop 57 and 109, and the recent lock-down at Highland Oaks Elementary School, and requested more police officers around the schools. Brett Mitulski, who had submitted a speaker card, was not present when his name was called. Jack Chang, Vice President IPAC, appeared and commented on the rotation of Mayor and applauded the tradition; and recognized Sho Tay's work and indicated support. Zhi (Zig), an Arcadia resident, appeared and urged the City Council to work together against hatred, racism and discrimination. David Arvizu, an Arcadia resident, appeared and thanked Sho Tay for his apology and taking responsibility; he discussed the importance of integrity for the City Council; he asked that the community allow an opportunity for the City to heal, and wished Mr. Tay luck as Mayor. Christina Ng, an Arcadia resident, appeared and discussed her experience with racism; she expressed no confidence in Sho Tay; and suggested Sho Tay remove himself from selection of Mayor and resign. Susan Guo, an Arcadia resident, appeared and discussed the 45-day cooling off period; she spoke about healing, and her personal experience with home invasion and burglary; and encouraged strengthening the police force. John Huang, representing the Chinese American Chinese Alliance, appeared and spoke on civil liberties, district voting, and the mayoral appointment. David Liu, an Arcadia resident, appeared and thanked the City Council; thanked Mr. Beck for bringing the City Council to a better standard; and asked Mr. Tay to apologize. Liangyi Gu, an Arcadia resident, appeared and stated she was happy that the City Council was uniting; she read 1988 jury instructions; and spoke about rumors, and the need to reunite the City Council. Lee Marshall, an Arcadia resident, appeared and congratulated the City Council on unifying itself; he spoke about the election and false claims and appeals to racism; he stated that he was glad to hear the diversity of opinions; and suggested a workshop for angry residents. 10. CITY CLERK City Manager Lazzaretto provided a history of the 2018 Mayoral transition and explained the status of the investigations related to allegations of voter fraud and alleged FPPC violations. 4 06-05-2018 City Attorney Deitsch stated there was no indication from the FPPC on resolution on the allegation against Mr. Tay; he stated the City had contacted the Integrity Division of the Los Angeles County Registrar Recorders Office and it had sent letters, but had not received a response. a. The City Clerk called for the election of Mayor Council Member Chandler nominated Mayor Pro Tem Sho Tay for Mayor. Seeing no other nominations, Council Members cast their vote for Mayor Pro Tern Tay for Mayor as follows: AYES: Chandler, Amundson, Beck, Tay, and Verlato NOES: None The City Clerk announced that Mayor Pro Tern Tay was unanimously elected by the City Council as Mayor through April 2019. b. Mayor Tay called for the election of Mayor Pro Tern Council Member Beck nominated Council Member April Verlato for Mayor Pro Tern. Seeing no other nominations, Council Members cast their vote for Council Member Verlato for Mayor Pro Tern as follows: AYES: Beck, Chandler, Verlato, Tay, and Amundson NOES: None ABSENT: None The City Clerk announced that Council Member Verlato was unanimously elected by the City Council as Mayor Pro Tern through April 2019. c. Comments by the newly Elected Mayor Mayor Tay thanked his colleagues for their support; encouraged people to get to know and accept each other; he discussed rumors and suggested addressing the source; he expressed his love for the community and desire to do what was best for the community; he stated he would work with the Arcadia Chinese Association on more events for the community. d. Comments by the newly Elected Mayor Pro Tern Mayor Pro Tern Verlato stated she looked forward to unifying the community; she indicated support for Mayor Tay; she encouraged moving forward and bridging the community back together; she stated her child was at Highland Oaks Elementary School when it was on lock down and understood the need for safety; and encouraged determining common goals and interests. e. Comments by Members of the City Council and City Clerk Council Member Beck congratulated Mayor Tay and Mayor Pro Tern Verlato. 5 06-05-2018 Council Member Chandler congratulated Mayor Tay, and commended Council Member Amundson. Council Member Amundson discussed districts and the recent election, and expressed appreciation to Mayor Tay and encouraged working together. Mayor Tay called a recess at 8:48 p.m. The meeting reconvened at 8:55 p.m. with all Council Members present. Council Member Beck discussed the complaint filed by David Liu against him regarding campaign disclosures, and indicated he filed his reports in a timely manner and properly; and shared the Chief's email regarding decreases in crime. He announced the Ring Doorbell Program, and asked Chief Guthrie to comment. Chief Guthrie stated there were still vouchers available and discussed positive results. Council Member Beck addressed comments regarding the $130 million in pension liabilities and upcoming creation of a citizen's advisory committee; he commended staff on the inclusion of Chinese on the City Council agendas; he thanked the Hakka Foundation for supporting the Gilb Museum; he commended all volunteers and Alice Wang; and thanked Council Member Amundson for his leadership during this difficult time, and wished Mayor Tay success. Council Member Chandler congratulated Mayor Pro Tem Verlato and Mayor Tay; and commented on the City's future agenda and unfunded liability. Council Member Amundson discussed an article falsely indicating his wife had a business related to historical preservation; he commented on recent events and activities; he announced the Rotary Veterans Memorial Monument Opening on June 16; he wished all the fathers a Happy Father's Day; and stated that he would be celebrating the 75th Anniversary of the Battle of the Aleutian Islands in memory of his father. Mayor Pro Tem Verlato discussed the Memorial Day weekend events; she reminded residents of Canines and Cops at Clockers Corner, and the Veterans Monument Dedication at the Community Center on June 16; she announced the Patriotic Festival on July 1, and invited everyone to attend; and thanked staff for the Chinese translations on the agenda, and Susan Guo for sharing her experience. City Clerk Glasco congratulated Mayor Tay and Mayor Pro Tern Verlato; and summarized the Memorial Day weekend events. 11. CONSENT CALENDAR a. Regular Meeting Minutes of May 1, 2018. Recommended Action: Approve b. Resolutions initiating proceedings for the Annual Levy and Collection of Assessments, approving the Preliminary Engineer's Report, and declaring intention to levy and collect assessments for Fiscal Year 2018-19 and appointing a time and place for a Public Hearing for the Arcadia Citywide Lighting District No. 1. 6 06-05-2018 Recommended Action: Find that the Resolutions are exempt under the California 111 Environmental Quality Act ("CEQA"); and adopt Resolution No. 7216 initiating proceedings for the annual levy and collection of assessments for the Arcadia Citywide Lighting District No. 1 pursuant to the provisions of Part 2 of Division 15 of the California Streets and Highways Code and ordering the preparation of the Engineer's Report. Recommended Action: Adopt Resolution No. 7217 approving the preliminary Engineer's Report of Willdan Financial Services for the Arcadia Citywide Lighting District No. 1. Recommended Action: Adopt Resolution No. 7218 declaring its intention to levy and collect assessments within the Arcadia Citywide Lighting District No. 1 for Fiscal Year 2018-19 and appointing a time and place for a public hearing. Recommended Action: Adopt c. Agreement for Services with the Arcadia Chamber of Commerce in the amount of $77,960. Recommended Action: Approve d. Accept all work performed by Western Air Conditioning Company, Inc. for the replacement of HVAC units and ductwork at the Community Center as complete. Recommended Action: Approve e. Professional Services Agreement with Wittman Enterprises, LLC for Ambulance Billing and Collection Services in an amount not to exceed $83,400 for Fiscal Year 2018-19. Recommended Action: Approve f. Extension to the Purchase Order with All Star Fire Equipment for Structural Firefighting Coats and Pants in an amount not to exceed $37,500. Recommended Action: Approve g. Extension to the Purchase Order with Western Water Works Supply Company for the purchase of water pipeline fittings, brass valves, and other related accessories for the City's Water Distribution System in the amount of$107,000. Recommended Action: Approve h. Extension to the Contract with General Pump Company, Inc. for unscheduled maintenance and emergency repair of City wells and pumps in the amount of $79,000. Recommended Action: Approve Extension to the Professional Services Agreement with G4S Secure Solutions, Inc. for Temporary Community Affairs Liaison Services in an amount not to exceed $41,200. Recommended Action: Approve 7 06-05-2018 j. Extension to the Professional Services Agreement with U.S. Mobile Wireless Communications, Inc. (Day Wireless Systems) for Radio Communication Services in an amount not to exceed $45,000. Recommended Action: Approve k. Extension of the Professional Services Agreement with Executive Information Services, Inc. for PS.net Public Safety Software System Support Services in the amount of$32,150. Recommended Action: Approve I. Purchase Order with Galls, LLC for the purchase of uniforms for the Police Department in an amount not to exceed $46,200. Recommended Action: Approve m. Donation in the amount of $1,000 from the Hakka Foundation for support of the Gilb Museum of Arcadia Heritage Juried Photography Contest. Recommended Action: Accept n. Direct the City Manager to review the City's Conflict of Interest Code pursuant to the Political Reform Act of 1974. Advanced Deposit Wagering ("ADW") Tax Payment Agreement with the Los Angeles Turf Club, Inc. and the Thoroughbred Owners of California. Recommended Action: Approve City Manager Lazzaretto and Assistant to the City Manager Bruckner presented the staff report. Council Member Beck complimented City Manager Lazzaretto and Assistant to the City Manager Bruckner on the negotiations. It was moved by Council Member Chandler, seconded by Mayor Pro Tern Verlato, and carried on roll call vote to approve, and authorize and direct the City Manager to execute the Advanced Deposit Wagering Tax Payment Agreement with the Los Angeles Turf Club, Inc. and the Thoroughbred Owners of California. Successor Agency Resolution No. SA-15 approving a Purchase and Sale Agreement with Northeast Development Enterprises II, LLC for the Arcadia Self- Storage Property at 35 W. Huntington Drive. Recommended Action: Adopt Economic Development Analyst Schwehr presented the staff report. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Verlato, and carried on roll call vote to adopt Successor Agency Resolution No. SA-15 approving a Purchase and Sale Agreement with Northeast Development Enterprises II, LLC for the Arcadia Self-Storage Property at 35 W.
