Wray, Deputy Director of Development Services/City Engineer By: Kevin Merrill, Principal Civil Engineer SUBJECT: CONTRACT WITH BELCO ELECNOR GROUP FOR TRAFFIC SIGNAL IMPROVEMENTS, INCLUDING TRAFFIC SIGNALIZATION AND CROSSWALK MODIFICATIONS AT DUARTE ROAD AND LOVELL AVENUE, TRAFFIC SIGNALIZATION AT SUNSET BOULEVARD AND FAIRVIEW AVENUE, AND TRAFFIC SIGNAL IMPROVEMENTS AT HUNTINGTON DRIVE AND SECOND AVENUE, IN THE AMOUNT OF $873,774 Recommendation: Approve SUMMARY This project proposes traffic signal improvements at multiple locations. The improvements include the installation of two new traffic signals at the intersections of Duarte Road and Lovell Avenue, and Sunset Boulevard and Fairview Avenue, the removal of the crosswalk and flashing warning light system on Dua rte Road approximately 600 feet east of Baldwin Avenue, and the addition of a protected/permissive left turn phase to the traffic signal at Huntington Drive and Second Avenue. Each of these locations was studied over the past few years and the various recommendations for these locations were converted into individual Capital Improvement Projects. For ease of administration, the four projects were combined into one and were designed as one project. The project was advertised for bids in July 2018, and four bids were received, with Belco Elecnor Group being the low bidder. It is recommended that the City Council approve, and authorize and direct the City Manager to execute a contract with Belco Elecnor Group for the project in the amount of $873,774, and approve a 10% contingency. Traffic Signal Improvements – Multiple Locations August 21, 2018 Page 2 of 4 BACKGROUND With regard to the new traffic signal at the intersection of Duarte Road & Lovell Avenue , in 2015 the City hired KOA Corporation, a traffic engineering firm with expertise in crosswalks, to conduct a study of several midblock and uncontrolled crosswalks on Duarte Road and Santa Anita Avenue. The study recommended the removal of the mid-block crosswalk on Duarte Road approximately 600 feet east of Baldwin Avenue, and the accompanying in-roadway and overhead warning light systems. In lieu of the crosswalk, the study recommended a new traffic signal at the intersection of Duarte Road and Lovell Avenue, approximately 400 feet east of the midblock crosswalk. Not only is this location warranted for a signal based on traffic volumes, but it also will provide a reasonable alternative to the midblock crosswalk proposed for removal. On March 15, 2016, the City Council reviewed the recommendations of the study and directed staff to proceed with implementation. The law requires that before a crosswalk can be removed, the public must be notified of the City’s intention and provided an opportunity to comment. A Community Meeting was held in October 2017 to receive input on the proposed crosswalk removal. Meeting notices were posted at the crosswalk stating the City’s intention, and providing the opportunity to comment either before or at the meeting. No one attended the meeting, and only one comment was received, requesting that the City ensure compliance with ADA requirements for the area. The sidewalks on both sides of the street have been inspected and the necessary actions were either previously handled, or are incorporated into this project. With regard to the new traffic signal at the intersection of Sunset Boulevard and Fairview Avenue, over the past few years several accidents have occurred at this intersection, and complaints have been received regarding the need for a traffic signal. Striping improvements have been made during that time to help address the accidents, and to facilitate safe traffic flow, such as striping left turn lanes on Sunset Boulevard, and adding red curb on Sunset Boulevard to help the sightlines from Fairview Avenue. More recently, a Traffic Signal Warrant Study was conducted for the intersection and the results indicate the need for a traffic signal. There are traffic signals on Fairview Avenue at Baldwin Avenue, and at Rosemead Boulevard, so a signal at Sunset Boulevard is consistent with the Fairview Avenue corridor. Finally, with the opening of the Gold Line through Arcadia, the intersection of First Avenue and Santa Clara Street has become more impacted and inconvenient for through traffic because of the preemption for the at-grade train crossing. Daily traffic volumes on surrounding streets before and after the Gold Line opening show that the traffic patterns have changed, especially in the north/south direction, where more vehicles are using Second Avenue and less are using First Avenue. This has created an impact at the intersection of Huntington Drive and Second Avenue where there is an increase in southbound left turns and northbound through traffic, making it difficult to clear the left turn queue in each signal cycle. The proposed project will add a Traffic Signal Improvements – Multiple Locations August 21, 2018 Page 3 of 4 protected/permissive left turn phase for the north/south direction to help clear the queues. Each of the described projects was originally budgeted separately, but they were combined into one project for ease of administration. On August 15, 2017, the City Council approved a Professional Services Agreement with KOA Corporation to prepare the design plans for the traffic signals. The design was completed in May 2018. DISCUSSION Once all of the four projects were combined, the single, biddable project had the following scope:  New traffic signal at the intersection of Duarte Road & Lovell Avenue  New traffic signal at the intersection of Sunset Boulevard and Fairview Avenue  Conduit and fiber optics lines to connect the signals to the City’s fiber optics network  New ADA curb ramps at both intersections and additional sidewalks to connect and repair existing sidewalks near the intersections  Removal of the crosswalk, ADA ramps, warning light systems and mast arms on Duarte road approximately 400 feet west of Lovell Avenue  Protected/permissive left turn phase for the Second Avenue direction of the Second Avenue and Huntington Drive traffic signal  Miscellaneous street restriping to accommodate the new signals including crosswalks and turn lanes The project was advertised for bids in July 2018, and on July 31, 2018, four (4) bids were received for the project as follows: COMPANY BID AMOUNT Belco Elecnor Group $873,774 California Professional Engineering, Inc. $903,544 Comet Electric, Inc. $967,417 Dynalectric $1,021,421 The low bidder, Belco Elecnor Group, has the required license, and is fully qualified to perform the work. Although Belco has not done any previous work directly for the City, the company just recently completed the Foothill Boulevard Corridor Traffic Signal Improvements for the County of Los Angeles, which included significant work in the City of Arcadia. Both the County and the City were satisfied with their work, which was completed in a timely manner with minimal change orders. Traffic Signal Improvements – Multiple Locations August 21, 2018 Page 4 of 4 ENVIRONMENTAL IMPACT This project is categorically exempt per Section 15301(c) of the California Environmental Quality Act (“CEQA”), as an existing highway or street. FISCAL IMPACT As mentioned above, each component of this project was originally funded separately in different Capital Improvement Projects, as follows: PROJECT BUDGET FUND Lighted Crosswalk Warning System Improvements $100,000 Capital Outlay Duarte Rd. & Lovell Ave. Traffic Signal $350,000 Transportation Impact Sunset Blvd. & Fairview Ave. Traffic Signal $450,000 Transportation Impact Huntington Dr. & Second Ave. Signal Modifications $150,000 Transportation Impact Total Funds Available $1,050,000 The total amount budgeted for the four projects was $1,050,000. A Professional Services Agreement with KOA Corporation for design services was approved by the City Council in the amount of $72,806, leaving a balance of approximately $977,000. There are sufficient funds in the budget to cover this traffic signal contract in the amount of $873,774, including a 10% contingency. RECOMMENDATION It is recommended that the City Council approve, and authorize and direct the City Manager to execute a contract with Belco Elecnor Group for traffic signalization improvements, including traffic signalization and crosswalk modifications at Duarte Road and Lovell Avenue, traffic signalization at Sunset Boulevard and Fairview Avenue, and traffic signal improvements at Huntington Drive and Second Avenue, in the amount of $873,774, with a 10% contingency. Contractor shall perform all Work under this Contract in a skillful and workmanlike manner, and consistent with the standards generally recognized as being employed by professionals in the same discipline in the State of California. Finally, Contractor further represents that it, its employees and subcontractors have all licenses, permits, qualifications and approvals of whatever nature that are legally required to perform the Work, and that such licenses and approvals shall be maintained throughout the term of this Contract. 3.4 Period of Performance. Contractor shall perform and complete all Work under this Contract within 60 calendar days, beginning ten (10) calendar days after the date on which the Notice to Proceed is sent by the Owner to the Contractor. Moreover, Contractor shall perform its Work in strict accordance with any completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications. Contractor agrees that if such Work is not completed within the aforementioned period and/or pursuant to any such completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications, it is understood, acknowledged and agreed that the Owner will suffer damage. Pursuant to Government Code Section 53069.85, Contractor shall pay to the Owner as fixed and liquidated damages the sum of One Thousand Dollars ($1,000) PER DAY as provided by the applicable provisions of the General Conditions, found in Part "B" of the Contract Appendix. 3.5 Owner's Basic Obligation. Owner agrees to engage and does hereby engage Contractor as an independent contractor to furnish all materials and to perform all Work according to the terms and conditions herein contained for the sum set forth above. Except as otherwise provided in the Contract, the Owner shall pay to Contractor, as full consideration for the satisfactory performance by the Contractor of the services and obligations required by this Contract, the above referenced compensation in accordance with compensation provisions set forth in the Contract. 3.6 Contractor's Labor Certification. Contractor maintains that he is aware of the provisions of Section 3700 of the California Labor Code which require every employer to be insured against liability for Worker's Compensation or to undertake self-insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Work. A certification form for this purpose is attached hereto as Exhibit “A” and incorporated herein by reference, and shall be executed simultaneously with this Contract. 3.7 Attorneys' Fees. If either party commences an action against the other party, either legal, administrative or otherwise, arising out of or in connection with this Contract, the prevailing party in such action shall be entitled to have and recover from the losing party reasonable attorneys' fees and all other costs of such action.
