Wray, Deputy Director of Development Services SUBJECT: RESOLUTION NO. 7231 A JOINT RESOLUTION BETW EEN THE BOARD OF SUPERVISORS AS THE GOVERNING BODY OF THE COUNTY OF LOS ANGELES, THE CONSOLIDATED FIRE PROTECTION DISTRICT, AND THE LA COUNTY LIBRARY, ROAD DISTRICT NO. 5, COUNTY LIGHTING MAINTENANCE DISTRICT NO. 1687, COUNTY LIGHTING DISTRICT LLA-1, UNINCORPORATED ZONE, AND THE CITY COUNCIL OF THE CITY OF ARCADIA, APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM THE REORGANIZATION OF TERRITORY KNOWN AS CITY OF ARCADIA REORGANIZATION NO. 2018-03, AMENDING THE SPHERES OF INFLUENCE OF THE CITY OF ARCADIA AND THE COUNTY OF LOS ANGELES RELATED TO THIS PROPERTY EXCHANGE, AND INITIATING AN APPLICATION REQUESTING THAT THE LOS ANGELES COUNTY LOCAL AGENCY FORMATION COMMISSION (“LAFCO”) REORGANIZE TERRITORIAL BOUNDARIES BETWEEN THE COUNTY OF LOS ANGELES AND THE CITY OF ARCADIA AT THE INTERSECTION OF DUARTE ROAD AND OAK AVENUE, AND NEAR THE INTERSECTION OF MAYFLOWER AVENUE AND STANDISH STREET Recommendation: Adopt SUMMARY There are two locations along the City’s jurisdictional boundaries that cross public streets in awkward configurations. The westerly City boundary at Duarte Road extends west as a narrow strip only within the street right-of-way, and the easterly City boundary across Standish Street jogs along the street centerline for the length of one property. These awkward boundary lines cause difficulties in determining actual jurisdictional street maintenance responsibilities in the field. The County of Los Angeles shares the boundaries with the City at these two locations, and has agreed to adjust the boundary lines to make simple straight lines at the street crossings (see attached Duarte Road Location Map and Standish Street Location Map). Resolution No. 7231 September 4, 2018 Page 2 of 4 An application was filed with the Local Agency Formation Commission (“LAFCO”). LAFCO has completed its investigation and determined that there are no property tax adjustments, and has asked that the City and the County adopt a joint resolution acknowledging this. Upon adoption of this resolution, LAFCO will make the final determination. BACKGROUND The westerly City boundary at Duarte Road has an unusual shape that extends west approximately 178-feet from the most westerly adjacent boundary as a long narrow strip, 62-feet wide, completely within the Duarte Road right-of-way. This narrow strip extends into the intersection of Duarte Road and Oak Avenue. This configuration is also unusual because the private properties on all corners of the intersection that surround the City’s narrow strip are in the jurisdiction of the unincorpor ated County of Los Angeles. Another unusual situation exists on the east side of the City on Standish Street just east of Mayflower Avenue. The City’s common boundary with the unincorporated County of Los Angeles jogs along the centerline of Standish Street the length of one residential lot. These awkward boundary lines cause difficulties in locating and determining actual jurisdictional street maintenance responsibilities in the field. In 2015, the County requested that the City share the cost of a traffic signal at the intersection of Duarte Road and Oak Avenue. In lieu of the City sharing the cost, the City requested the County to consider a boundary change to remove from the City’s jurisdiction the extension of the Duarte Road right-of-way that extends to the Oak Avenue intersection. The County accepted the City’s boundary change request but, in turn, requested another similar boundary change on Standish Street just east of Mayflower Avenue to add a portion of right-of-way to the City’s jurisdiction. For both locations, the proposed jurisdictional boundary lines will make straight, clean lines across street right-of-way. For the City, the two boundary changes would result in a reduction of 0.257 acres at Duarte Road, and the addition of 0.046 acres at Standish Street, for a net reduction of 0.211 acres. On October 20, 2015, the City Council adopted a resolution initiating an application requesting that the Los Angeles County Local Agency Formation Commission (“LAFCO”) initiate proceedings for reorganization of territorial boundaries between the County of Los Angeles and the City of Arcadia at the intersection of Duarte Road and Oak Avenue, and near the intersection of Mayflower Avenue and Standish Street. Resolution No. 7231 September 4, 2018 Page 3 of 4 DISCUSSION A joint application was made to LAFCO for the reorganization. LAFCO has conducted a full investigation of the impacts of the boundary changes, and b ecause this only affects public right-of-way and not private property, has determined that there are no property tax adjustments. As a result, LAFCO has asked that the City and the County acknowledge this determination by adopting a joint resolution. ENVIRONMENTAL IMPACT This action is exempt from the California Environmental Quality Act (“CEQA”) because it is not considered a project per Section 15061 of the CEQA guidelines. FISCAL IMPACT There will be no measurable fiscal impact from this action in terms of the minor reduction in the City’s overall street maintenance responsibility. The action will eliminate the City’s fiscal responsibility to share the cost of installing and maintaining a traffic signal at the intersection of Duarte Road and Oak Avenue ; however, and this is a positive fiscal impact. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 7231 a joint resolution between the Board of Supervisors as the governing body of the County of Los Angeles, the Consolidated Fire Protection District, and the LA County Library, Road District No. 5, County Lighting Maintenance District No. 1687, County Lighting District LLA-1, unincorporated zone, and the City Council of the City of Arcadia, approving and accepting the negotiated exchange of property tax revenue resulting from the reorganization of territory known as City of Arcadia Reorganization No. 2018-03. (Amendments to the spheres of influence of the City of Arcadia and Consolidated Fire Protection District of the County of Los Angeles; detachment of Parcel 1 from the City of Arcadia; annexation of Parcel 1 to the Consolidated Fire Protection District, LA County Library, Road District No. 5, County Lighting Maintenance District N o. 1687, and County Lighting District LLA-1, unincorporated zone; detachment of Parcel 2 from the Consolidated Fire Protection District, LA County L ibrary, Road District No. 5, County Lighting Maintenance District No. 1687, and County Lighting District LLA-1, unincorporated zone; and annexation of Parcel 2 to the City of Arcadia); and initiate an application requesting that the Los Angeles County Local Agency Formation Commission (“LAFCO”) initiate proceedings for reorganization of territorial boundaries between the County of Los Angeles and the City of Arcadia at the intersection of Duarte Road and Oak Avenue, and near the intersection of Mayflower Avenue and Standish Street.
