SUBJECT: Healthy Protected Tree Removal Permit No. TRH 18-14
PROJECT ADDRESS: 1636 Oakwood Avenue
Dear Mr. Tsang:
The public comment period for the Notice of Pending Decision for the above
mentioned application ended on August 24, 2018. Staff received one comment
from a neighbor in opposition to the proposed tree removal. The neighbor stated
that tree benefits the community and appears to be healthy and well maintained.
The neighbor felt that the tree could be saved if the garage and driveway was
relocated back to the south side of the property. After careful consideration, the
Development Services Department has approved the request to remove a
healthy, 20-inch diameter Chinese Elm (Ulmus parvifolia) tree located in the front
yard of the subject property to accommodate the driveway for a new house. The
design of the new house was approved by the Arcadia Highlands Homeowners
Association Architectural Review Board (Highlands ARB). The conditions of
approval are as follows:
1. One (1), 48-inch box tree shall be planted in the front yard area and one
(1), 48-inch box tree shall be planted in the rear yard area prior to the
issuance of a Certificate of Occupancy from Building Services. The tree
species shall be subject to review and approval by the Planning and
Community Development Administrator or designee prior to the issuance
of a building permit. The specific location of the trees must be shown on
the final landscape plan prior to the issuance of a building permit.
2. The applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officials, officers, employees, and agents from and against
any claim, action, or proceeding against the City of Arcadia, its officials,
officers, employees or agents to attack, set aside, void, or annul any
approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, including but not limited to any approval
or conditional approval of the City Council, Planning Commission, or City
Staff, which action is brought within the time period provided for in
Government Code Section 66499.37 or other provision of law applicable
to this project or decision. The City shall promptly notify the applicant of
any claim, action, or proceeding concerning the project and/or land use
decision and the City shall cooperate fully in the defense of the matter.
The City reserves the right, at its own option, to choose its own attorney
to represent the City, its officials, officers, employees, and agents in the
defense of the matter.
There is a 10 working-day appeal period from the date of the approval. To file an
appeal, a completed Appeal Application form must be submitted to the
Community Development Division with a $600.00 appeal fee by 5:30 p.m. on
Monday, September 17, 2018. You will be notified if an appeal is filed.

Approval of TRH 18-14 shall not be of effect unless the property owner and applicant have
executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of
these conditions of approval. The Acceptance form is due now and if it is not received by 5:30
p.m. on October 4, 2018, this approval will become null and void.
This approval shall expire in one year (September 18, 2019) from the effective date unless
plans are submitted to Building Services for plan-check, a building permit is issued and the
construction is diligently pursued, a certificate of occupancy has been issued, or the approval is
renewed.
