The Development Services Department received four letters of opposition to your request to legalize the unpermitted removal of a healthy, protected, 34-inch, Coast Redwood tree and to legalize the unpermitted topping and significant limb removal of a protected, 24.5-inch, Western Sycamore tree. After careful consideration, the Development Services Department has conditionally approved the request to legalize the removal of the healthy Coast Redwood tree and the topping and significant limb removal of the Western Sycamore tree. The application is subject to the following conditions: 1. Within 30 days of this decision, a fine in the amount of $2,000 shall be paid to the City of Arcadia. This fine shall be filed with the Planning Division by 5:30 PM on Thursday, November 8, 2018. 2. Within 90 days of this decision (Monday, January 7, 2019), the remaining stump and roots from the above mentioned Coast Redwood tree shall be removed and two (2) 36-inch box Holly Oak (Quercus ilex) trees shall be planted in the front yard area. The location of the two Holly Oak trees shall be consistent with the enclosed site plan that was submitted to Planning Services on July 18, 2018. A Certified Arborist shall supervise the planting of the two Holly Oak trees and shall submit a follow-up report to Planning Services to verify the fulfillment of this condition. This report shall also be submitted by January 7, 2019. 3. The Applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the Applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 4. Within 30 calendar days of this decision (November 8, 2018), the property owner/applicant shall execute and file with the Planning & Community Development Administrator or designee the enclosed Acceptance Form to indicate awareness and acceptance of the restitution requirements. There is a ten (10) day appeal period for this application. To file an appeal, a completed Appeal Application form must be submitted to the Community Development Division along with a $600.00 appeal fee by 4:30 p.m. on Friday, October 19, 2018.
