SUBJECT: Healthy Protected Tree Removal Permit No. TRH 18-16

Dear Mr. Chang:
The public comment period for the Notice of Pending Decision for the above
mentioned application ended on October 11, 2018. The Development Services
Department did not receive any comments during the public comment period for
your request to legalize the unpermitted removal of a healthy, protected, 14-inch,
Coast Live Oak tree that was located at 155 E. Longden Ave, and removed by the
neighboring property owner at 163 E. Longden Ave.
After careful consideration, the Development Services Department has
conditionally approved the request to legalize the unpermitted removal of the
healthy Coast Live Oak tree. The application is subject to the following conditions:
1. Within 30 days of this decision, a fine in the amount of $1,000 shall be paid
to the City of Arcadia. This fine shall be filed with the Planning Division by
5:30 PM on Wednesday, November 21, 2018.
2. Within 90 days of this decision (Monday, January 21, 2019), one (1) 36-inch
box Coast Live Oak tree shall be planted on the subject site at 155 E.
Longden Ave. The location of the tree shall be determined by a Certified
Arborist. The Certified Arborist shall supervise the planting of the Oak tree
and shall submit a follow-up report to Planning Services to verify the
fulfillment of this condition. This report shall also be submitted by January
21, 2019.
3. The Property Owner/Applicant shall defend, indemnify, and hold harmless
the City of Arcadia and its officials, officers, employees, and agents from
and against any claim, action, or proceeding against the City of Arcadia, its
officials, officers, employees or agents to attack, set aside, void, or annul
any approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, including but not limited to any approval or
conditional approval of the City Council, Planning Commission, or City Staff,
which action is brought within the time period provided for in Government
Code Section 66499.37 or other provision of law applicable to this project or
decision. The City shall promptly notify the Applicant of any claim, action, or
proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of the matter. The City reserves the
right, at its own option, to choose its own attorney to represent the City, its
officials, officers, employees, and agents in the defense of the matter.
4. Within 30 calendar days of this decision (November 21, 2018), the property
owner/applicant shall execute and file with the Planning & Community
Development Administrator or designee the enclosed Acceptance Form to
indicate awareness and acceptance of the restitution requirements.
There is a ten (10) day appeal period for this application. To file an appeal, a completed Appeal
Application form must be submitted to the Community Development Division along with a $600.00
appeal fee by 5:30 p.m. on Thursday, November 1, 2018. You will be notified if an appeal is filed.

Approval of your application shall not be of effect unless the property owner and
applicant have executed and filed this Acceptance Form to indicate awareness
and acceptance of these conditions of approval. The Acceptance form is due
now and if it is not received by (November 21, 2018), this approval will become
null and void and all fees will be forfeited.
