HomeMy WebLinkAboutDecision Letter_11-8-18 City of Arcadia Development Services Department Jason Kruckeberg Assistant City Manager/ Development Services Director 240 West Huntington Drive Post Office Box 60021 Arcadia, CA 91066-6021 (626) 574-5415 (626) 447-3309 Fax www.ArcadiaCA.gov November 8, 2018 Wayne Lock 2029 S. 3rd Avenue Arcadia, CA 91006 SUBJECT: Revised Major Administrative Modification No. Major AM 18-10 PROJECT ADDRESS: 2029 S. 3rd Avenue Dear Mr. Lock: The Development Services Department has conditionally approved the revised plans that were submitted on July 25, 2018, and an Administrative Modification to allow the existing garage to be converted into an accessory structure and maintain a 3’-6” foot setback in lieu of the required 9 foot setback at 2029 S. 3rd Avenue. According to Arcadia Development Code Section 9107.05.050, it states that an Administrative Modification may be approved if at least one of the following findings can be made. 1. Secure an appropriate improvement of a lot; 2. Prevent an unreasonable hardship; or 3. Promote uniformity of development. The modification to allow a less than required side yard setback is for an existing detached garage structure. No modifications are made the exterior of the garage or to expand it in size; thus, the modification does not intensify an existing non-conforming situation. However, the modification secures an appropriate improvement on the lot by allowing the owner of the property to utilize the existing garage as a detached accessory structure, and prevents an unreasonable hardship of having to build another detached structure on the lot. The owner of the property will be able to use an existing two-car garage attached to the house to meet the parking requirements for single- family house. Therefore, the conversion of the detached garage does not result in a parking deficiency. Furthermore, the project will allow the owner to utilize the detached accessory structure and promote a uniformity of development with properties in the neighborhood because it will result in no change to the number of structures on the lot or the lot coverage. The proposed conversion of the garage into an accessory structure qualifies as a Class 1 Categorical Exemption from the requirements of the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines. Conditions of Approval 1. A covenant to restrict the use of the accessory structure shall be required to be notarized and recorded with Los Angeles County. Please submit an application for a covenant with Planning. 1. A covenant shall be filed with Planning Services and recorded prior to issuance of any building permit stating that the accessory structure will not be used for overnight stay, rented, or used as a dwelling unit. No bedrooms or closets shall be allowed within the accessory structure, and it may only contain a sink, a toilet and/or a shower. 2. No exterior alteration is permitted with this approval. There is a ten (10) day appeal period for this application. Appeals must be submitted in writing to the Community Development Division with a $600.00 appeal fee by 5:30 p.m. on Wednesday, November 21, 2018. You will be notified if an appeal is filed. Approval of Major AM 18-10 shall not be of effect unless the property owner and applicant have executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of these conditions of approval. The Acceptance Form is due now and if it is not received by December 11, 2018, this approval will become null and void. A building permit must be obtained prior to any installation of a sign(s). Please contact Building Services at (626) 574-5416 to determine the type of documentation, plans, and fees for the appropriate permit. Once the appeal period has passed, this approval letter and two additional sets of plans must be presented to Building Services to initiate the permitting process. This approval shall expire in one year (November 22, 2019) from the effective date unless a permit from Building Services is issued for plan-check, and construction is diligently pursued, or the approval is renewed. The final plans must be consistent with the approved design concept plans and any conditions of approval. Any inconsistency from the approved design concept plans may prohibit the issuance of a building permit.
