Encroachment Permit No. TRE 16-43

Dear Mr. Tseng:
The public comment period for the Notice of Pending Decision ended on August
25, 2017. Staff did not receive any comments during the notification period. The
Development Services Department has denied the single-family design review
for improvements to the existing one story, 2,396 square foot, single family
residence that consist of a 533 square foot, single story addition and a new 1,185
square foot second story at 1036 Cyrus Lane. The proposed improvements
would have encroached within the dripline of one Coast Live Oak tree.
It is the Development Services Department’s determination that the proposal is
inconsistent with the City’s Single-Family Residential Design Guidelines on
“Entry”, “Massing”, “Façade Design”, “Details”, and “Additions and Alterations”,
as stated below. Staff does not have any concerns regarding the proposed Oak
Tree encroachments, however they may need to be re-evaluated if the project
changes. The following significant outstanding design issues remain:
1. The front entry does comply with Development Code Section
9102.01.030, Table 2-2, which states that the maximum street-facing
porch height is 14 feet. The porch also does not conform to the City’s
Single Family Residential Design Guidelines because it is not in scale
with the height and design of the building. It is too tall and is
disproportionate to the rest of the building. The height and width of the
entry porch must be in scale with design of the building. The remodeled
porch should match the scale and architectural style of the home and the
eaves of the porch roof should align with the first story.
2. The architectural details and façade treatments should be consistent with
the chosen architectural style and be applied on all sides of the home.
The home lacks details and façade treatments that make the proposed
architectural style apparent. Revisions are necessary to incorporate
architectural details and façade treatments so the architectural style is
recognizable.
3. The proposed second story is still too massive and the overall design is
out of scale and incompatible with the surrounding residences. The height
and bulk of proposed dwellings and structures on the site should be in
scale and in proportion with the height and bulk of dwellings and
structures on surrounding sites. The second floor should be greatly
reduced in width to be more compatible with the neighbors.
4. The proposed second floor is disproportionate to the ground floor resulting in an
unbalanced appearance. Revisions are needed to the massing of the home to create a
more balanced look while still being compatible with the surrounding neighborhood.
There is a ten (10) day appeal period for this application. To file an appeal, a completed Appeal
Application form must be submitted to the Community Development Division along with a
$600.00 appeal fee by 5:30 p.m. on Thursday, September 21, 2017. You will be notified if an
