Dear applicant:
The public comment period for the Notice of Pending Decision ended on
November 9, 2016. Two comments were received, one opposing the pro-
ject due to its size, and one asking for revisions to the landscaping plan.
The City has determined that the house is compatible with the neighbor-
hood, and the City’s Single Family Architectural Design Guidelines, in
terms of style, size and massing. After consultation with the City, the ap-
plicant has agreed to modify the landscaping plans to resolve the con-
cerns of the commenter. Therefore, The Development Services Depart-
ment has conditionally approved the single-family project as shown on
the plans dated October 24, 2016, for a new 4,683 square foot, two-story,
Prairie-style house with attached one and two-car garages totaling 691
square feet, at 1531 Hyland Avenue, subject to the following conditions:
1. The three most westerly Carolina Cherry shrubs proposed on the
southerly property line shall be replaced with a smaller, lower grow-
ing shrub from the list on the approved plans.
2. This project shall comply with the City’s Water Efficient Landscap-
ing Ordinance.
There is a five (5) working day appeal period for this application. Appeals
must be submitted in writing to the Community Development Division with
a $210.00 appeal fee by 5:30 p.m. on Tuesday, November 29, 2016. You
will be notified if an appeal is filed.
This approval shall expire in one year (November 30, 2017) from the ef-
fective date unless a building permit is issued and the construction is dili-
gently pursued, a certificate of occupancy has been issued, or the approv-
al is renewed. The final plans must be consistent with the approved design
concept plans and any conditions of approval. Any inconsistency from the
approved design concept plans may preclude the issuance of a building
permit.

If you have not submitted your construction plans to Building Services for plan-check by
August 30, 2017, you may want to consider applying for an extension. The extension
request must be filed at least thirty (30) days prior to the above expiration date with the
extension form, and a fee of $105.00. Only one (1) time extension may be granted by
the Development Services Director or designee, or the body that approved the project
for a maximum period of one (1) year from the initial expiration date. An extension can
only be granted if it is determined that the findings for the approval are still valid. Please
note that acceptance of an extension request does not indicate approval of an
extension.
A building permit must be obtained prior to any construction activity. Please contact
Building Services at (626) 574-5416 to determine the type of documentation, plans, and
fees for the appropriate permit. This approval letter must be presented to Building
Services to initiate the permitting process.
