SUBJECT: Single-Family Design Review No. SFADR 16-29 and Tree
Encroachment Permit No. TRE 16-50

Dear Mr. Ou:
The public comment period for the Notice of Pending Decision ended on
December 30, 2016. During the public comment period, staff received two letters
of oppositions. The neighbors were concerned with the privacy, mass, scale, and
architectural style of the proposal in comparison to the other homes in the
neighborhood. As a result, the applicant requested additional time to examine the
neighbors and staff’s concerns, and no changes were made.
Staff determined that the proposed 9,503 square foot, two-story Spanish style
residence is not consistent with the City’s Single-Family Design Guidelines
because the neighborhood comprises of smaller lots and homes and the
proposed residence that sits on the largest lot in this area would appear out of
character and scale with the other homes in this neighborhood. Therefore, the
Development Services Department has denied the single-family design review
project and the related oak tree encroachment permit to allow the new residence
to encroach within the dripline of nine protected trees.
There is a ten (10) day appeal period for this application. To file an appeal, a
completed Appeal Application form must be submitted to the Community
Development Division along with a $600.00 appeal fee by 5:30 p.m. on Tuesday,
February 21, 2017. Please note that City Hall is closed on Monday, February 20,
2017, in observance of Presidents’ Day. You will be notified if an appeal is filed.
