Cordova St. Alhambra, CA 91801 SUBJECT: Single-Family Design Review No. SFADR 17-07, Protected Tree Encroachment Permit No. TRE 17-19 PROJECT ADDRESS: 414 East Lemon Avenue Dear Mr. Jer, The public comment period for the Notice of Pending Decision ended on June 21, 2017. Staff received comments from an adjacent neighbor objecting to the preservation of the Moreton Bay Fig, the second story balcony due to privacy concerns, and the selection of plan ts along the westerly property line due to potential maintenance issues. The Development Services Department has conditionally approved the single- family design review project dated June 6, 2017, for a new 3,783 square- foot two-story colonial revival style house at 414 East Lemon Avenue, subject to the following conditions: Conditions of Approval: 1. The project shall comply with the City’s Water Efficient Landscaping Ordinance (WELO). The application shall be submitted with the plans for plan check in Building Services. 2. The entire second story balcony shall be reduced in depth from 12’8” to no more than 6’6,” or omitted entirely. 3. The Carolina Cherry trees along the westerly side yard property line shall be replaced with Yew Pine, or another equivalent shrub that does not produce significant leaf litter, and the proposed bougainvillea vine shall be omitted. 4. The Certified Arborists recommended tree protection measures for the protection of Tree #1, the Ficus macrophylla (Moreton Bay Fig) shall be implemented and reflected on the plans submitted for a building permit for this project. If the tree fails to survive after implementation of the protection measures, it shall be replaced with three 36-inch box oak or sycamore trees on the property. The replacement trees shall be installed under the supervision of a Certified Arborist. There is a ten (10) day appeal period for this application. To file an appeal, a completed Appeal Application form must be submitted to the Community Development Division along with a $600.00 appeal fee by 5:30 p.m. on Monday, July 24, 2017. You will be notified if an appeal is filed. Approval of Single-Family Design Review No. SFADR 17-07 and Protected Tree Encroachment Permit No. TRE 17-19 shall not be of effect unless the property owner and applicant have executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of these conditions of approval. The Acceptance Form is due now and if it is not received by August 23, 2017 this approval will become null and void. This approval shall expire in one year (July 25, 2018) from the effective date unless a building permit is issued and the construction is diligently pursued, a certificate of occupancy has been issued, or the approval is renewed. An extension may be granted by the Development Services Director or designee, or the Review Authority that approved the project for a maximum period of one (1) year from the initial expiration date. An extension can only be granted if the required findings can be made. Please note that acceptance of an extension request does not indicate approval of an extension. A building permit must be obtained prior to any construction activity.
