HomeMy WebLinkAboutDecision letter November 5, 2018 PDS Studio Inc. 711 S. 1st Ave Arcadia, CA 91006 SUBJECT: Tree Permit for the Removal of a Healthy Protected Tree No. TRH 18-19 PROJECT ADDRESS: 15 Corto Road Dear Applicant: The public comment period for the Notice of Pending Decision for the above mentioned application ended on November 1, 2018. The Development Services Department did not receive any comments during the public comment period for your request to legalize the unpermitted removal of a healthy, protected, 18-inch diameter Western Juniper tree. After careful consideration, the Development Services Department has conditionally approved the request to legalize t he unpermitted removal of the protected Western Juniper tree. The application is subject to the following conditions: 1. Within 30 days of this decision, a fine in the amount of $1,000 shall be paid to the City of Arcadia. This fine shall be filed with the Planning Division by 5:30 PM on Wednesday, December 5, 2018. 2. One (1) 36”-box Carrotwood tree and one (1) 36”-box Crape Myrtle tree shall be planted within the rear yard area. Within 30 days of the approval, the property owner/applicant shall submit a revised landscape plan to Building Services. Prior to the issuance of the Certificate of Occupancy, the two trees shall be installed. 3. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. Approval of TRH 18-19 shall not be of effect unless on or before 30 calendar days after approval of this project, the applicant/property owner has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. There is a ten (10) day appeal period for this application. Appeals must be submitted in writing to the Development Services Department with a $600.00 appeal fee by 5:30 p.m. on Thursday, November 15, 2018. Please note that he City Hall will be closed on Friday, November 9, 2018 and Monday, November 12 , 2018 in observance of Veteran’s Day. You will be notified if an appeal is filed. Approval of TRH 18-19 shall not be of effect unless the property owner and ap plicant have executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of these conditions of approval. The Acceptance form is due now and if it is not received by December 5, 2018, this approval will become null and void.
