HomeMy WebLinkAbout11/06/2018 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, NOVEMBER 6, 2018 CALL TO ORDER— Mayor Tay called the meeting to order at 6:41 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Chandler, Verlato, and Tay ABSENT: None PUBLIC COMMENTS — No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(4) to confer with legal counsel regarding the initiation of potential litigation —one (1) case. No reportable action was taken on the Closed Session item. The meeting ended at 6:46 p.m. Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER— Mayor Tay called the regular meeting to order at 7:00 p.m. 2. INVOCATION — Director of Religious Services, Riaz Khan — Masjid Jibrael (Mosque of San Gabriel) 3. PLEDGE OF ALLEGIANCE — Gene Glasco, Elected City Clerk 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Chandler, Verlato, and Tay ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that the City Council met in a Closed Session prior to the regular meeting to consider the one item listed on the posted agenda, where no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto noted that, regarding Public Hearing 9.a, the applicant has requested a revision to the hours of operation, and that a copy of the revised Condition of Approval No. 1 was previously provided to the City Council. 1 11-06-2018 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Amundson, to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Pasadena Humane Society presentation of adoptable dog. b. Presentation of Mayor's Certificates of Commendation to the participants of the 2018 Leadership Academy. c. Presentation of Proclamation to Arcadia High School Drum Major Carolyne Kim for the 2018 Festival of Bands event. 9. PUBLIC HEARING a. Temporary Use Permit with a Categorical Exemption under the California Environmental Quality Act ("CEQA") for a Winter Festival that includes a variety of Holiday Activities, and Ice Skating Rink, Tree Lot, and over 60 Pop-up Shops and Food Stands in the Santa Anita Park Infield from November 23, 2018, through January 6, 2019, at 285 W. Huntington Drive. Recommended Action: Approve Senior Planner Luis Torico presented the staff report. Mayor Tay opened the Public Hearing. No one appeared. Mayor Tay closed the Public Hearing. It was moved by Council Member Chandler, seconded by Council Member Beck, and carried on roll call vote to approve a Temporary Use Permit with a Categorical Exemption under the California Environmental Quality Act ("CEQA") for a Winter Festival that includes a variety of Holiday Activities, and Ice Skating Rink, Tree Lot, and over 60 Pop-up Shops and Food Stands in the Santa Anita Park Infield from November 23, 2018, through January 6, 2019, at 285 W. Huntington Drive, and the amended Condition of Approval #1 (hours of operation). AYES: Chandler, Beck, Amundson, Verlato, and Tay NOES: None ABSENT: None 10. PUBLIC COMMENTS Lois Merritt, an Arcadia resident, appeared and thanked the City Council on behalf of her neighbors for putting in a nice safe sidewalk, and she also thanked Associate Engineer Kevin Merrill for his assistance in the project. Laurie Baglieri, representing the Arcadia Congregational Church, appeared and indicated that they are in the process of selling the Church, which is on the potential historical preservation list, and requested the City expedite the process so they can get it off the list and sell the property. 2 11-06-2018 Brian Goldin, an Arcadia resident, appeared and spoke about Ordinance No. 1057w which prohibits individuals from feeding animals or fowl on any streets or sidewalks, and feels the ordinance should be amended to prohibit the feeding of any wildlife on any street, sidewalk, or private property. Susan Guo, an Arcadia resident, appeared and read a letter on behalf of Dr. Sheng Chang regarding his opposition to the proposed historical preservation ordinance. 11. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense(AB 1234]). Council Member Beck congratulated all the Leadership Academy participants; he thanked the Humane Society for bringing the adoptable dog; he commended the Arcadia Police Foundation for their donation to the Police Department's K-9 program; he stated that in compliance with AB1234, he received a free ticket to the Moonlight Forest Festival at the Arboretum; he congratulated Council Member Amundson and Mayor Pro Tern Verlato on a successful Halloween Harvest Festival on October 27; and announced that on November 10, the Historical Society will be having a mystery dinner, which he is unable to attend. Council Member Chandler commented on a Fish and Game provision that prohibits the feeding of wildlife. Council Member Amundson reminded everyone that there is still time to vote; he noted that last weekend he was walking precincts for a City Council candidate in Orange County, and residents there could not wait until the election was over; he provided a status report on the Redondo Beach case regarding municipal elections and SB 415; he commented on the pension problem in California; he noted that last week he received a questionnaire from the League of California Cities asking what is the most important priority for next year, and urged the City Council to get a hold of the League and let them know by November 9 that pensions matter and it needs to be resolved; he noted that when he was recently travelling, he met someone from the Bay area who was familiar with Arcadia because his daughter participated in the Track and Field Invitational; and announced Veteran's Day on Sunday, November 11. Mayor Pro Tem Verlato noted she gave a presentation to four Cub Scouts at Holy Angels School who had all earned a Super Nova award through the Cub Scouts for their achievement in STEM (Science, Technology, Engineering, Math); on October 18, she attended the Library Board meeting for Council Member Beck; on October 19, she attended the Epic Media Health Fair; on October 25, she attended the Moonlight Forest Festival at the Arboretum; she stated that October 27 was the Halloween Harvest Festival and reported that more than 3,000 people attended, and later she attended the Trick or Chief Police Foundation fundraiser; she stated that on October 31, she attended Assemblyman Ed Chau's Urban Wildlife round table and the topic was "how to learn to live with and how to interact with the wildlife"; she also noted that this morning she attended the School District Council PTA, and spoke about some of the joint ventures City and the School District are engaged in, and noted some of the partnered services provided to the kids; she also congratulated all the Leadership Academy participants; she noted that on November 8, she will be attending the Annual Veteran's Day Luncheon, and the Foothill Unity Center Open House, and the Downtown Business Association will be presenting them with a check for $1,000 from the Halloween Harvest Festival Beer and Wine sales; she also noted that she will be attending the Vietnam Veteran's War Monument Memorial event on November 11; and noted that she has filled in for the Mayor the last couple of weeks while he 3 11-06-2018 was in China, but that she was disappointed to learn that Mayor Tay was saying some negative things about her on We Chat, and would appreciate him saying some nice things about her. City Clerk Glasco announced the Annual Veteran's Day Celebration Luncheon on November 8, and November 11, is Veteran's Day and invited everyone to visit the Vietnam Veteran's War Memorial Monument; and noted that November 17, is the 65th Annual Festival of Bands Parade. Mayor Tay responded to Mayor Pro Tern Verlato's comments that he was making negative comments about her, he asked for proof of the comments he allegedly said, and apologized; he thanked the Arcadia Police Foundation for the $8,000 donation to the Arcadia Police Department K-9 program, and noted that residents can also donate by contacting the Arcadia Police Foundation; he reminded everyone that from November 1 to April 30, is the winter watering schedule, and urged everyone to adjust their water sprinklers to the Tuesday and Saturday schedule; he stated the Citizen's Financial Advisory Committee is in the process of preparing their final report to the City Council, and invited the public to attend the meeting tomorrow morning, November 7; he announced today is election day, and spoke about working together even if there are different opinions and point of views; and noted that he was in China and visited the Dr. Robert O. Wilson monument; and announced that November 17, is the 65th Annual Festival of Bands Parade, and warned residents to avoid driving in that area. 12. CONSENT CALENDAR a. Special and Regular Meeting Minutes of September 18, 2018, Continued Special Meeting Minutes of September 18, 2018, and Special Meeting Minutes of September 19, 2018. Recommended Action: Approve b. Donation of $8,000 from the Arcadia Police Foundation for the Arcadia Police Department's Police Service Dog (K-9) Program for FY 2018-19. Recommended Action: Accept c. Contract with Sheldon Mechanical Corporation for HVAC Preventative Maintenance and Repair Services at various City facilities in the amount of$151,046. Recommended Action: Approve d. Purchase Order with Waxie's Enterprises, Inc. dba Waxie Sanitary Supply for the purchase of janitorial supplies and related products for various City facilities in an amount not to exceed $65,000. Recommended Action: Approve e. Accept all work performed by Commercial Roofing Systems, Inc. for the Fire Station 105 Roof Restoration Project as complete. Recommended Action: Approve f. Accept All Work Performed by Vincor Construction, Inc. for the Library and Police Department Carpet Tile Installation Project as complete. Recommended Action: Approve g. Accept all work performed by Ramona, Inc. for Phase 3 of the Huntington Drive Sewer Capacity Improvement Project as complete. Recommended Action: Approve 4 11-06-2018 h. Accept all work performed by Golden State Constructors, Inc. for City Facilities ADA Improvements at the Community Center, Chamber of Commerce and Council Chambers as complete. Recommended Action: Approve i. Accept all work performed by Golden State Constructors, Inc. for the Colorado Boulevard Sidewalk Gap Closure Project at Newcastle Park as complete. Recommended Action: Approve j. Street Closures for Arcadia High School Music Club's 65th Annual Festival of Bands Parade, held on Saturday, November 17, 2018. Recommended Action: Approve. It was moved by Council Member Chandler, seconded by Council Member Amundson, and carried on roll call vote to approve Consent Calendar Items 12.a through 12.j. AYES: Chandler, Amundson, Beck, Verlato, and Tay NOES: None ABSENT: None 13. CITY MANAGER a. Professional Services Agreement with Gibson Transportation Consulting, Inc. for a Downtown Arcadia Parking Evaluation and Plan in the amount of$48,765. Recommended Action: Approve City Manager Lazzaretto reminded the City Council that City Attorney Deitsch has advised that Mayor Pro Tern Verlato has a conflict because she owns property in the project area. Mayor Pro Tern Verlato noted that she has a conflict because she owns property in the project area, and will recuse herself from discussion and participation, but will reserve time for comment as a member of the public, and not as a member of the City Council. Mayor Pro Tern Verlato left the room, and was not present for any discussion on this item. Deputy Development Services Director/Civil Engineer Wray presented the staff report. April Verlato, property owner of 33 Huntington Drive, and Board Member of the Downtown Arcadia Business Improvement Association, appeared and indicated that she is now in favor of the study and expenditure, but would like them to stay focused on parking in the future, and what is the best use for the public parking spaces that currently exist. It was moved by Council Member Chandler, seconded by Council Member Amundson, and carried on roll call vote to approve a Professional Services Agreement with Gibson Transportation Consulting, Inc. for a Downtown Arcadia Parking Evaluation and Plan in the amount of$48,765.
