CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Dana Nava v. Dominic Lazzaretto; Real Party in Interest: City of Arcadia; California Court of Appeal Second Appellate District Case No.: B266783. b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the Workers’ Compensation matter of Alicia Gallo v. City of Arcadia; Workers’ Compensation Appeals Board Case No.: ADJ 9225051. c. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Kristin Gavrity, et al., v. City of Arcadia; United States District Court [Central District] Case No.: 2:18-cv-5769-DDP-JPR. No reportable action was taken on the Closed Session items. The meeting ended at 7:10 p.m. Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the regular meeting to order at 7:14 p.m. 2. INVOCATION – Reverend Julie Bryant, Church of the Transfiguration 3. PLEDGE OF ALLEGIANCE – Gene Glasco, Elected City Clerk 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Chandler, Verlato, and Tay ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that the City Council met in a Closed Session prior to the regular meeting to consider the three items listed on the posted agenda, and no reportable action was taken. 2 11-20-2018 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto noted that the staff report relating to Consent Calendar Item 10.c, had the wrong date listed on the staff report, which was corrected and distributed to the City Council. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Amundson to read all ordinances and resolutions by title only and waive the reading in full. 8. PUBLIC COMMENTS Helen Romero Shaw, a Public Affairs Manager with the Southern California Gas Company, appeared and spoke about natural gas, and indicated that the State of California is promoting electricity as the only source of energy, and that the Gas Company is promoting customer choice of energy; she explained that electricity is more expensive than natural gas; and indicated that she will be sending additional information to City Manager Lazzaretto. Jolene Cadenbach, representing Arcadia Congregational Church, appeared and explained the reasons why she is opposed to the proposed Historical Preservation Ordinance, and indicated that the Church was placed on the list without notification. Corinne Patera, representing the Arcadia Congregational Church, appeared and provided her reasons why she is opposed to the proposed Historical Preservation Ordinance; and asked the City Council not to put the Church on the Historical Preservation. Mark Shyang Liu, representing the Righteous Quest Foundation, appeared and stated that there will be an event to replace the temporary plaque with a permanent monument for Dr. Robert O. Wilson at the Methodist Church, and asked the City Council to co-host the event. Rabbi Shalom Stiefel appeared and invited the City Council and residents to the Annual Menorah Lighting Event on December 3, at the Transit Plaza. Reverend Julie Bryant, from the Church of the Transfiguration, appeared and responded to questions raised by Mayor Pro Tem Verlato; and expressed her concerns regarding the Historical Preservation Ordinance, and the City not engaging in conversation with the Church on how they intend to use the property for the benefit of the whole community. In response to Council Member Amundson’s inquiry, City Manager Lazzaretto indicated that all property owners on the list were sent notice. Ms. Bryant requested the City postpone the hearing, until there is evidence that all property owners have received notice. 9. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck announced that the Arcadia High School Football Team will be playing for the CIF Championship on December 6, and the Tree Lighting ceremony will also be on 3 11-20-2018 December 6, at the Transit Plaza, that the W indmill at Denny’s Restaurant will be installed next Monday, and will be started up on November 30; and he wished everyone a Happy Thanksgiving. Council Member Chandler announced that he attended the 65th Annual Arcadia Festival of Bands Parade, and that it was a tremendous event; and encouraged residents that received a Community Feedback Survey to fill it out and return it to the City. Council Member Amundson stated that he would like to support the Methodist Church in honoring Dr. Robert O. Wilson, and requested that the matter be placed on a future agenda for discussion (the City Council unanimously (5-0) concurred); he commented on Ms. Shaw’s comments from Southern California Gas Company; he congratulated the Arcadia High School Football team for making it to the CIF finals; he announced that he also attended the 65th Annual Arcadia Festival of Bands; and wished everyone a Happy Thanksgiving. Mayor Pro Tem Verlato noted that she spent Veterans Day at the Vietnam Veterans W ar Monument; she attended a Neighborhood W atch meeting, and encouraged neighborhoods to set up a neighborhood watch program; she announced that she will be attending the Menorah Lighting Ceremony on December 3; she thanked Pastor Bryant for her comments on the Historic Preservation Ordinance and encouraged her to get in touch with Mr. Kruckeberg or Planning/Community Development Administrator Lisa Flores regarding her concerns; and she extended her thoughts and prayers to the victims and those affected by the Border Line Grill shooting, and wildfires in California; she reminded everyone that this is a good time to know where your important documents are, and reminded everyone to be prepared, and give thanks for what we have. City Clerk Glasco announced that he also attended the 65th Annual Arcadia Festival of Bands parade, and on December 1, is the Annual Snow Festival, and the Balinese Shadow Puppet Storytelling at the Floretta K. Lauber Museum Education Center; and stated that the Recreation and Community Services Department will be mailing Letters to Santa to the North Pole received between November 12 and December 21. Mayor Tay stated that the City is a member of the CPA Green Power Alliance, and noted that in December residents will receive information regarding renewable energy rates; he announced the Snow Festival on December 1, and the Police Department Ring Security Rebate Program Launch event at the Masonic Lodge on December 5, and on December 6, is the Holiday Tree Lighting event at the Transit Plaza. 10. CONSENT CALENDAR a. Regular Meeting Minutes of October 2, 2018. Recommended Action: Approve b. Cancellation of the January 1, 2019, Regular City Council Meeting. Recommended Action: Approve c. Donations in the amount of $1,100 from the Community in support of the “Summer at Your Library” Program at the Arcadia Public Library. Recommended Action: Accept 4 11-20-2018 d. Professional Services Agreement with Mariposa Landscapes, Inc. for Landscape Maintenance Services in the amount of $522,936. Recommended Action: Approve e. Extension to the Professional Services Agreement with Scientia Consulting Group, Inc. for IT Consulting Services in the amount of $362,280. Recommended Action: Approve f. Electric Vehicle Charge Station Site Host Agreement with EV Connect for the installation and maintenance of electric vehicle charging stations. Recommended Action: Approve g. Management Agreement with Touchstone Golf, LLC for the Management of Operations and Maintenance of the Arcadia Par 3 Golf Course. Recommended Action: Approve h. Contract with Cedro Construction, Inc. for the Water Main Replacement Project in the amount of $302,302. Recommended Action: Approve i. Contract with Perry C. Thomas Construction, Inc. for the Rehabilitation of the Pressure Reducing Station Project in the amount of $94,926. Recommended Action: Approve. j. Purchase Order with George Chevrolet for the purchase of a new 2019 four-wheel drive Chevrolet Silverado pick-up in the amount of $42,475.42. Recommended Action: Approve k. Purchase of a 3-D Laser Scanner System (Forensic ScanStation) by Leica Geosystems from Precision Survey Supply, LLC in an amount not to exceed $90,000. Recommended Action: Waive the Formal Bid Process and Approve Council Member Beck requested Consent Calendar item 10.k be pulled for comment and discussion. Council Member Chandler requested Consent Calendar item 10.c be pulled for comment and discussion. It was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote to approve Consent Calendar Items 10.a, 10.b, and 10.d. through 10.j. AYES: Beck, Chandler, Amundson, Verlato, and Tay NOES: None ABSENT: None Regarding Consent Calendar Item 10.c, Council Member Chandler thanked those businesses who donated to the Library’s “Summer at your Library” Program, and read the names of those businesses. 5 11-20-2018 It was moved by Council Member Chandler, seconded by Beck, and carried on roll call vote to approve Consent Calendar Item 10.c. AYES: Chandler, Beck, Amundson, Verlato, and Tay NOES: None ABSENT: None Regarding Consent Calendar 10.k, Council Member Beck explained his reasons why he feels $90,000 could be used for other things, like police overtime, especially during the deficit budget. Police Chief Guthrie explained the purpose of the 3-D Laser Scanner System (Forensic ScanStation) as it relates to criminal investigations, major traffic investigations, etc., and noted that the current scanner was purchased in 2005. In response to Council Member Chandler’s inquiry, City Manager Lazzaretto responded that the $90,000 for the scanner was budgeted in the FY 2018-19 budget, and approved. In response to Mayor Pro Tem Verlato’s inquiry, Police Chief Guthrie guesstimated the usage of the 3-D Laser Scanner. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Verlato, and carried on roll call vote to approve Consent Calendar Item 10.k. AYES: Chandler, Verlato, Amundson, and Tay NOES: None ABSTAIN: Beck 11. CITY MANAGER a. Appointment of a Delegate to the San Gabriel Valley Mosquito and Vector Control District Board of Trustees. Recommended Action: Make 4-Year Appointment City Manager Lazzaretto presented the staff report. It was moved by Council Member Beck, seconded by Mayor Pro Tem Verlato, and carried on roll call vote to appoint Council Member Chandler as a Delegate to the San Gabriel Valley Mosquito and Vector Control District Board of Trustees, for a term of four years. CALL TO ORDER – Mayor Tay called the regular meeting to order at 7:00 p.m. 2. INVOCATION – Director of Religious Services, Riaz Khan – Masjid Jibrael (Mosque of San Gabriel) 3. PLEDGE OF ALLEGIANCE – Gene Glasco, Elected City Clerk 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Chandler, Verlato, and Tay ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS Mayor Tay announced that the agendized Closed Session was cancelled. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS Assistant City Manager/Development Services Director Kruckeberg stated that there was no supplemental information. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler and seconded by Council Member Amundson to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Presentation of new Arcadia Tourism Video. 9. PUBLIC COMMENTS Susan Guo, an Arcadia resident, appeared and indicated that the City of El Monte has received 11 applications for commercial cannabis cultivation and/or distribution, including one large operation near the Home Depot on Lower Azusa Road in El Monte; she explained that the City of El Monte Planning Commission has already approved one application, and the City of Temple City has hired the law firm of Burke, Williams & Sorenson to begin legal action against the City of El Monte for various environmental issues relating to the project; and she urged the City Council to take official legal action against the City of El Monte. She distributed a fact sheet to the City Council. 2 12-04-2018 Riaz Khan, of the Masjid Jibrael (Mosque of San Gabriel), appeared and invited the City Council to the All Saints Church in Pasadena for a Homeless Memorial Service on December 11, which acknowledges lives of people who died while homeless. 10. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck addressed Susan Guo’s comments regarding cannabis businesses and what Arcadia’s restrictions are, and stated he does not feel it worth the fight and the use of taxpayer money to get involved legally; he thanked Mr. Khan for his invocation and the invitation to the Homeless Memorial Service; he commended the Highland Oaks Homeowners’ Association on a very informative newsletter; he complimented the look of the Bridge on Santa Anita and the Windmill at Denny’s, and thought they looked very festive; he announced the Arcadia Chinese Association Gala on December 15, and the Tree Lighting Ceremony at the Transit Plaza on December 6, which he will be attending. Council Member Chandler complimented staff on the Arcadia Tourism video; he commented on the cannabis cultivation business in El Monte, and asked if staff can reach out to Temple City and find out what their plans are in challenging the project, if they feel they have a winning chance in their lawsuit, and what the cost to Temple City would be to defend. Assistant City Manager/Development Services Director Kruckeberg responded to Council Member Chandler’s concerns and request. Council Member Amundson and Council Member Beck were both in favor of staff reaching out to Temple City for additional information, but were not in favor of joining in any lawsuit. Council Member Amundson announced that on December 1, he attended the Snow Festival and Breakfast with Santa, on December 3, he attended the Menorah Lighting at the Transit Plaza; he also announced the Ring Security Rebate Program Launch event on December 5 at the Masonic Lodge; and spoke about an email the City Council received from the Chief of Police relating to some of recent burglary successes of the Police Department. In response to Council Member Amundson’s request, Police Chief Guthrie spoke about a recent burglary ring in the area, and provided additional information on certain techniques and processes the police use in order to investigate and catch burglars; he commended the officers, investigators and LAPD for their support in assisting with securing filings; he noted that they have seen a decrease in burglaries, and spoke about gang filings and enhancements which keeps criminals in jail longer. Police Chief Guthrie reported on a street robbery that occurred in town last night, and provided tips on how not to be a victim of theft or robbery during this holiday season. Mayor Pro Tem Verlato stated that she was glad to see the Denny’s Windmill working and thanked Denny’s for the money they invested in it; she announced that she attended the Menorah lighting last night with Council Member Amundson and Mayor Tay, and wished everyone a Happy Hanukkah; she announced the Holiday Tree Lighting Ceremony at the Transit Plaza on December 6, and noted the Downtown Business Association will also have a photo booth and will donate $5 to the Arcadia Fire Fighters Association Benevolent Fund; on December 8, Representative Judy Chu will be having her annual toy drive at the Elks Lodge; on December 9, she will be at the Sunday with Santa Festival at the Performing Arts Center; and announced on December 11, she will be participating in the Arcadia Holiday Decoration Awards; 3 12-04-2018 and she thanked Susan Guo for bringing the EL Monte cannabis cultivation matter to their attention. City Clerk Glasco announced that he attended the Santa Anita Park Winter Fest last month; he also announced the Tree Lighting Ceremony at the Transit Plaza on December 6, and Judy Chu and Mike Eng’s annual toy drive at the Elk’s Lodge on December 8, and invited everyone to attend with an unwrapped toy; and on December 9, he stated that he will be assisting Representative Judy Chu in interviewing, evaluating and nominating students for appointment to the various service academies. Mayor Tay stated that he also attended the Menorah Lighting Ceremony on December 3; he announced the Tree Lighting Ceremony on December 6, at the Transit Plaza, and on December 5, the Police Department will be having their Ring Security Rebate Program Launch event at the Masonic Lodge; and he reminded everyone that property taxes are due December 10. Council Member Amundson also reminded everyone that proof of residency is required to qualify for the Ring Rebate Program. 11. CONSENT CALENDAR a. Special Meeting Minutes of October 3, 2018, Regular Meeting Minutes of October 16, 2018, and Special and Regular Meeting Minutes of November 6, 2018. Recommended Action: Approve b. Resolution No. 7237 approving and adopting an amended Conflict of Interest Code pursuant to the Political Reform Act of 1974. Recommended Action: Adopt c. Final Map No. 76053 with a categorical exemption under the California Environmental Quality Act (“CEQA”) for an eight-unit multi-family residential condominium subdivision at 141-145 Alice Street. Recommended Action: Approve d. Final Map No. 73453 with an adopted Mitigated Negative Declaration under the California Environmental Quality Act (“CEQA”) for a 37 residential unit and one commercial airspace lot subdivision for the mixed use development at 56 E. Duarte Road. Recommended Action: Approve e. Professional Services Agreement with the City of Glendale for Crime Laboratory Services in an amount not to exceed $50,000. Recommended Action: Approve Council Member Chandler requested Consent Calendar item 11.e be pulled for discussion. AYES: Chandler, Amundson, Beck, Verlato, and Tay NOES: None ABSENT: None 4 12-04-2018 With regard to item 11.e, in response to Council Member Beck’s inquiry, Police Chief Guthrie explained how the payment of $15,000 is disbursed, and if not used it is rolled over to the next fiscal year. In response to Council Member Chandler’s inquiry, Police Chief Guthrie provided an overview on the importance of expediting results and speeding up the evidence process. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Verlato, and carried on roll call vote to approve Consent Calendar Item 11.e. Recommended Action: Adopt Resolution No. 7236 setting City Sewer Rates and finding the rates will not exceed the estimated amount necessary to fund the operation of the City Sewer System for Calendar Year 2019. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that prior to the regular meeting, the City Council met in a Closed Session to consider Items (a) and (b) on the posted agenda, and no reportable action was taken; he also reported that Item (c) has not yet been considered, and stated that after the regular meeting, the City Council will recess to a Closed Session to consider Item (c) on the posted agenda, and that no reportable action is anticipated. 6. Resolution No. 7239 establishing and/or adjusting various fees for City services; and finding that this Resolution is exempt from the requirements of the California Environmental Quality Act (“CEQA”). Recommended Action: Conduct the Public Hearing and Adopt City Manager Lazzaretto presented the staff report. Mayor Tay opened the Public Hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Amundson, and seeing no objection, Mayor Tay declared the public hearing closed. Mayor Pro Tem Verlato suggested the City Manager be given flexibility to waive fees for businesses depending on the type of business. Council Member Chandler made a motion to adopt Resolution No. 7239 as proposed by staff, which died for lack of a second. 3 12-18-2018 Council Member Beck made an alternate motion, seconded by Council Member Amundson, and carried on roll call vote to give authority to the City Manager or Assistant City Manager/Development Services Director the discretion to write down the small business micro enterprise start up fees from the proposed 50% down to 0% depending on the business; and adopt Resolution No. 7239 establishing and/or adjusting various fees for City services; and finding that this Resolution is exempt from the requirements of the California Environmental Quality Act (“CEQA”). PUBLIC COMMENTS Laurie Balierie, from the Arcadia Congregational Church, appeared and thanked the City for the additional information posted on the City’s website regarding Historical Preservation, and indicated that they cannot sell the property because the property is proposed on the Historical Preservation list. Jolene Cadenbach, from the Arcadia Congregation Church, appeared and supported the comments made by Laurie Balierie, and provided the City Council a letter relating to historical preservation. 11. Mayor Pro Tem Verlato announced that on December 8, she attended Congresswoman Judy Chu and Mike Ing’s Annual Toy Drive at the Elk’s Lodge; on December 9, she attended the Sunday with Santa Festival at the Performing Arts Center and presented certificates to the volunteers; on December 11, she participated in the City’s Holiday Decoration Awards and presented certificates to the winners; she attended the Foothill Unity Center Christmas event, and thanked all the volunteers, and thanked all the businesses who donated; on December 15, she attended the Arcadia Chinese Association Benefit Gala, and noted that all proceeds from the event will go to the California Wildfire Relief Fund; she stated that, unfortunately, there was no tree lighting ceremony because of the rain; she stated that on January 15, she will be in Sacramento chaperoning two Arcadia High School students to the California PTA Legislative Conference, and will not be attending the January 15, City Council meeting; and wished everyone Happy Holidays. Council Member Amundson indicated that he is looking forward to the New Year, and quoted mid-19th Century Parliament; he spoke about the new governor signing new laws that Governor Brown vetoed, and indicated that he is concerned; and he wished everyone a great Christmas Season. Council Member Beck stated that he attended the employee holiday party on December 13; on December 15, he attended the Arcadia Chinese Association Benefit Gala which he enjoyed; and wished everyone Happy Holidays, and a Happy New Year. Council Member Chandler indicated that he also attended the employee holiday party and the Arcadia Chinese Association Benefit Gala, and admired them for donating the proceeds to the California Wildfire Relief Fund; and wished everyone Happy Holidays. 4 12-18-2018 Council Member Amundson mentioned City Manager Lazzaretto’s “Above and Beyond Award” and congratulated Officer Ken Lee on receiving that deserving award. City Clerk Glasco announced that he also attended Congresswoman Judy Chu and Mike Ing’s Annual Toy Drive on December 8, which was a success, and the Arcadia Chinese Association Benefit Gala on December 15; he indicated that on December 9, he was on a committee which assisted Congresswoman Judy Chu in interviewing and evaluating 16 candidates for appointment to West Point, Annapolis, and the Air Force and indicated that Daniel Black was one of the candidates, and that all applicants received nominations, including 3 from Arcadia; and he further announced that VJ’s Auto Service is giving away a pre-owned Honda Prius to a deserving Veteran and provided details. Mayor Tay noted that December 15 was the Arcadia Chinese Association Benefit Gala, and that Council Member Amundson was out of town but donated some gifts, and thanked him for his donation; he noted that when he was on vacation in Costa Rica, Mayor Pro Tem Verlato represented him at various events, and thanked her for that; he indicated that the Arcadia Chinese Association has been serving the community for 36 years; he indicated that the January 1 City Council meeting was cancelled, and announced the next regular meeting is on January 15; and wished everyone a Merry Christmas and Happy New Year. 12. Council Member Beck recommended imposing reasonable time limitations similar to construction restrictions in the residential zones. In response to an inquiry by the City Council, Police Chief Guthrie explained that he personally did not think that doing a background check on vendors was consistent with who they currently do background checks on because they are a different classification, but he assured the City Council that the Police Department will make sure licenses are displayed and that they follow the rules. City Attorney Deitsch pointed out revisions to various sections in the Ordinance to include the display of licenses, restrictions on times, and Sundays and holidays consistent with construction restrictions.
