REGULAR MEETING MINUTES
TUESDAY, DECEMBER 18, 2018
CALL TO ORDER— Mayor Tay called the meeting to order at 6:00 p.m.
ROLL CALL OF CITY COUNCIL MEMBERS
PRESENT: Amundson, Beck, Chandler, Verlato, and Tay
ABSENT: None
PUBLIC COMMENTS — No one appeared.
CLOSED SESSION
a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel
regarding the matter of Kristin Gavrity, et al., v. City of Arcadia; United States District
Court[Central District] Case No.: 2:18-cv-5769-DDP-JPR.
b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel
regarding the Workers' Compensation matter of Donald Shawver—ADJ 10992392.
c. Pursuant to Government Code Section 54957.8 to confer with Real Property
Negotiators.

Mayor Tay announced that at the end of the regular meeting, the City Council will recess to a
Closed Session to consider and discuss Item (c) on the posted agenda.

Regular Meeting

1. CALL TO ORDER— Mayor Tay called the regular meeting to order at 7:00 p.m.

5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS
City Attorney Deitsch reported that prior to the regular meeting, the City Council met in a Closed
Session to consider Items (a) and (b) on the posted agenda, and no reportable action was
taken; he also reported that Item (c) has not yet been considered, and stated that after the
regular meeting, the City Council will recess to a Closed Session to consider Item (c) on the
posted agenda, and that no reportable action is anticipated.
6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA
ITEMS
City Manager Lazzaretto stated that there was no supplemental information.
7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND
WAIVE THE READING IN FULL
A motion was made by Council Member Chandler and seconded by Council Member Amundson
to read all ordinances and resolutions by title only and waive the reading in full.
8. PRESENTATIONS
a. Presentation of Mayor's Certificates of Commendation to the Arcadia High School
Apaches Football Team in recognition of their outstanding season and first CIF finals
appearance in 40 years.
9. PUBLIC HEARING
a. Resolution No. 7239 establishing and/or adjusting various fees for City services; and
finding that this Resolution is exempt from the requirements of the California
Environmental Quality Act ("CEQA").
Recommended Action: Conduct the Public Hearing and Adopt
City Manager Lazzaretto presented the staff report.
Mayor Tay opened the Public Hearing. No one appeared.
A motion to close the public hearing was made by Council Member Chandler, seconded by
Council Member Amundson, and seeing no objection, Mayor Tay declared the public hearing
closed.
Mayor Pro Tern Verlato suggested the City Manager be given flexibility to waive fees for
businesses depending on the type of business.
Council Member Chandler made a motion to adopt Resolution No. 7239 as proposed by staff,
which died for lack of a second.

Council Member Beck made an alternate motion, seconded by Council Member Amundson, and
carried on roll call vote to give authority to the City Manager or Assistant City
Manager/Development Services Director the discretion to write down the small business micro
enterprise start up fees from the proposed 50% down to 0% depending on the business; and
adopt Resolution No. 7239 establishing and/or adjusting various fees for City services; and
finding that this Resolution is exempt from the requirements of the California Environmental
Quality Act ("CEQA").

10. PUBLIC COMMENTS
Laurie Balierie, from the Arcadia Congregational Church, appeared and thanked the City for the
additional information posted on the City's website regarding Historical Preservation, and
indicated that they cannot sell the property because the property is proposed on the Historical
Preservation list.
Jolene Cadenbach, from the Arcadia Congregation Church, appeared and supported the
comments made by Laurie Balierie, and provided the City Council a letter relating to historical
preservation.
11. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports
from the City Council related to meetings attended at City expense(AB 1234]).
Mayor Pro Tern Verlato announced that on December 8, she attended Congresswoman Judy
Chu and Mike Ing's Annual Toy Drive at the Elk's Lodge; on December 9, she attended the
Sunday with Santa Festival at the Performing Arts Center and presented certificates to the
volunteers; on December 11, she participated in the City's Holiday Decoration Awards and
presented certificates to the winners; she attended the Foothill Unity Center Christmas event,
and thanked all the volunteers, and thanked all the businesses who donated; on December 15,
she attended the Arcadia Chinese Association Benefit Gala, and noted that all proceeds from
the event will go to the California Wildfire Relief Fund; she stated that, unfortunately, there was
no tree lighting ceremony because of the rain; she stated that on January 15, she will be in
Sacramento chaperoning two Arcadia High School students to the California PTA Legislative
Conference, and will not be attending the January 15, City Council meeting; and wished
everyone Happy Holidays.
Council Member Amundson indicated that he is looking forward to the New Year, and quoted
mid-19th Century Parliament; he spoke about the new governor signing new laws that Governor
Brown vetoed, and indicated that he is concerned; and he wished everyone a great Christmas
Season.
Council Member Beck stated that he attended the employee holiday party on December 13; on
December 15, he attended the Arcadia Chinese Association Benefit Gala which he enjoyed; and
wished everyone Happy Holidays, and a Happy New Year.
Council Member Chandler indicated that he also attended the employee holiday party and the
Arcadia Chinese Association Benefit Gala, and admired them for donating the proceeds to the
California Wildfire Relief Fund; and wished everyone Happy Holidays.

Council Member Amundson mentioned City Manager Lazzaretto's "Above and Beyond Award"
and congratulated Officer Ken Lee on receiving that deserving award.
City Clerk Glasco announced that he also attended Congresswoman Judy Chu and Mike Ing's
Annual Toy Drive on December 8, which was a success, and the Arcadia Chinese Association
Benefit Gala on December 15; he indicated that on December 9, he was on a committee which
assisted Congresswoman Judy Chu in interviewing and evaluating 16 candidates for
appointment to West Point, Annapolis, and the Air Force and indicated that Daniel Black was
one of the candidates, and that all applicants received nominations, including 3 from Arcadia;
and he further announced that VJ's Auto Service is giving away a pre-owned Honda Prius to a
deserving Veteran and provided details.
Mayor Tay noted that December 15 was the Arcadia Chinese Association Benefit Gala, and that
Council Member Amundson was out of town but donated some gifts, and thanked him for his
donation; he noted that when he was on vacation in Costa Rica, Mayor Pro Tem Verlato
represented him at various events, and thanked her for that; he indicated that the Arcadia
Chinese Association has been serving the community for 36 years; he indicated that the
January 1 City Council meeting was cancelled, and announced the next regular meeting is on
January 15; and wished everyone a Merry Christmas and Happy New Year.
12. CONSENT CALENDAR
a. Resolution No. 7238 approving wage adjustments for unrepresented, non-benefitted
part-time employees in accordance with California's minimum wage increase
effective January 1, 2019.
Recommended Action: Adopt
b. Professional Services Agreements for On-Call Environmental Services with Dudek,
Michael Baker International, and Psomas for Environmental Consultinq Services.
Recommended Action: Approve
c. Professional Services Aqreement with Willdan for Engineering Services for the 2019
Citywide Traffic Counts and Engineering and Traffic Survey in the amount of
$23,956.
Recommended Action: Approve
d. Purchase Order with RDO Equipment Company for the purchase of one Vermeer
SC60TX Stump Cutter in the amount of$59,677.50.
Recommended Action: Approve
e. Donation of various stuffed animals from PetSmart for children participating in the
Elementary Afterschool Program.
Recommended Action: Accept
f. Agreement for General Liability Claims Administration Services with Carl Warren &
Company and the California Insurance Pool Authority ("CIPA") on behalf of the City
of Arcadia for Claims Administration Services in the amount of$62,000.
Recommended Action: Approve
Council Member Chandler thanked PetSmart for their donation to the Elementary Afterschool
Program.

carried on roll call vote to approve Consent Calendar Items 12.a. through 12.f.

13. CITY MANAGER
a. Ordinance No. 2357 adding Sections 6439.3 through 6439.12 to Article VI, Chapter
4, Part 3, Division 9, of the Arcadia Municipal Code, with an exemption under the
California Environmental Quality Act ("CEQA"), imposing regulations on sidewalk
vending.
Recommended Action: Introduce
Assistant City Manager/Development Services Director Kruckeberg presented the staff report.
Council Member Beck recommended imposing reasonable time limitations similar to
construction restrictions in the residential zones.
In response to an inquiry by the City Council, Police Chief Guthrie explained that he personally
did not think that doing a background check on vendors was consistent with who they currently
do background checks on because they are a different classification, but he assured the City
Council that the Police Department will make sure licenses are displayed and that they follow
the rules.
City Attorney Deitsch pointed out revisions to various sections in the Ordinance to include the
display of licenses, restrictions on times, and Sundays and holidays consistent with construction
restrictions.
It was moved by Council Member Chandler, seconded by Mayor Pro Tern Verlato, and carried
on roll call vote to introduce Ordinance No. 2357 adding Sections 6439.3 through 6439.12 to
Article VI, Chapter 4, Part 3, Division 9, of the Arcadia Municipal Code, with an exemption under
the California Environmental Quality Act ("CEQA"), as amended by the City Attorney.

b. Ordinance No. 2358 amending the City Uniform Traffic Ordinance to create
additional parking zone restrictions.

It was moved by Mayor Pro Tem Verlato, seconded by Council Member Chandler, and carried
on roll call vote to introduce Ordinance No. 2358 amending the City Uniform Traffic Ordinance
to create additional parking zone restrictions.

14. SUCCESSOR AGENCY
a. Successor Agency Resolution No. SA-16 approving and adopting the Recognized
Obligation Payment Schedule for the period of July 1, 2019, through June 30, 2020,
pursuant to Health and Safety Code Section 34177(m).
Recommended Action: Adopt
Management Analyst Tim Schwehr presented the staff report.
It was moved by Council Member Chandler, seconded by Mayor Pro Tem Verlato, and carried
on roll call vote to adopt Successor Agency Resolution No. SA-16 approving and adopting the
Recognized Obligation Payment Schedule for the period of July 1, 2019 through June 30, 2020,
pursuant to Health and Safety Code Section 34177(m).

15. ADJOURNMENT
At 8:43 p.m., Mayor Tay announced the City Council will recess to Closed Session to consider
Item (c) on the posted agenda.

The City Council meeting adjourned at 9:23 p.m. to January 15, 2019, 6:00 p.m. in the Council
Conference Room.
