Wray, Deputy Director of Development Services/City Engineer By: Kevin Merrill, Principal Civil Engineer SUBJECT: CONTRACT WITH BELCO ELECNOR GROUP FOR TRAFFIC SIGNAL IMPROVEMENTS, INCLUDING TRAFFIC SIGNALIZATION OF MID- BLOCK CROSSWALKS ON HUNTINGTON DRIVE BETWEEN SANTA ANITA AVENUE AND SECOND AVENUE, AND MISCELLANEOUS TRAFFIC SIGNAL IMPROVEMENTS AT MULTIPLE LOCATIONS ON HUNTINGTON DRIVE FROM SANTA CLARA STREET TO GATEWAY DRIVE IN THE AMOUNT OF $658,472 Recommendation: Approve SUMMARY This project proposes new traffic signals at the two mid-block crosswalks on Huntington Drive between Santa Anita Avenue and Second Avenue, and other miscellaneous signal improvements at multiple locations on Huntington Drive from Santa Clara Street to Gateway Drive. The need for the two new traffic signals evolved from two studies of uncontrolled and mid- block crosswalks at various locations throughout the City. KOA Corporation (“KOA”) and Gibson Transportation Consulting, Inc., (“GTC”), both traffic engineering firms with expertise in crosswalks, completed studies that included establishing evaluation criteria for mid-block and uncontrolled crosswalks, evaluation of specific locations. GTC used the criteria to evaluate the need for the two mid-block crosswalks on Huntington Drive, and recommended that traffic signals be installed. The traffic signals were designed by KOA Corporation, and added to the existing Arterial Rehabilitation Project on Huntington Drive from Santa Clara Street to Fifth Avenue. This traffic signal project includes other miscellaneous traffic signal improvements along Huntington Drive, such as conduit and Huntington Drive Traffic Signal Improvements February 5, 2019 Page 2 of 6 fiber optics extensions, vehicle detection improvements, and protective-permissive left turn phases. The project was advertised for bids in January 2019, and eight (8) bids were received, with Belco Elecnor Group (“Belco”) being the low bidder. It is recommended that the City Council approve, and authorize and direct the City Manager to execute, a contract with Belco Elecnor Group for the project in the amount of $658,472, and approve a 10% contingency. It should be noted that Mayor Pro Tem Verlato owns property at 33 E. Huntington Drive, in close proximity to the proposed traffic signal between Santa Anita Avenue and First Avenue. As a result, the City Attorney recommends th at Mayor Pro Tem Verlato recuse herself from this discussion. BACKGROUND In 2015, KOA Corporation was retained to evaluate the need for five (5) mid-block and uncontrolled crosswalks along Duarte Road and Santa Anita Avenue. Because there are no adopted State or City standards for crosswalk installations or removals, KOA used evaluation criteria from other cities to evaluate the need for the five crosswalks. On March 15, 2016, the City Council received and filed the final report with the evaluation criteria and directed staff to proceed with the recommendations for the five crosswalks. In late 2016, Gibson Transportation Consulting, Inc. (“GTC”) was retained to evaluate the need for the two mid-block crosswalks on Huntington Drive between Santa Anita Avenue and Second Avenue. For consistency, GTC used the evaluation criteria from the KOA report to determine the need for the two crosswalks. The results of the GTC analysis determined the following:  Although the pedestrian crossing volumes were relatively low, there is a potential for higher pedestrian usage based on future use changes in the downtown.  The crosswalks serve a greater purpose than simply to provide street crossings, like linking nearby passages to parking facilities and businesses north of Huntington Drive.  Because each block on Huntington Drive is over 800 feet long, the crosswalks help connect businesses and parking facilities on each side of the street by providing more convenient pedestrian options. The conclusion from the GTC report was that the crosswalks are needed for current and future access, function, and convenience in downtown. Huntington Drive Traffic Signal Improvements February 5, 2019 Page 3 of 6 With regard to additional safety measures, GTC made the following observations:  Huntington Drive is a busy four-lane street carrying, on average, 28,000 vehicles per day.  The street trees, and the planted parkways and medians, obstruct the sightlines from vehicles to waiting pedestrians.  The crosswalk stripes and signs tend to get lost with all the other signs, hardscape, poles, banners, street furniture and parked vehicles in the area. Based on their observations, GTC recommended full traffic signals with pedestrian crossing phases. Although these are more expensive than flashing warning light systems, a full traffic signal is superior in providing pedestrian safety, potentially less expensive to maintain, and more reliable. Within the Fiscal Year 2017-18 Capital Improvement Program, a project was budgeted for the pavement rehabilitation of Huntington Drive from Santa Clara Street to Fifth Avenue. The project includes other elements such as traffic signal improvements, sidewalk repairs, drainage improvements, and additional electrical service for street decorations. The traffic signal improvements include the two new traffic signals, fiber optics connections to the City’s Traffic Signal Control System , and miscellaneous signal improvements at other Huntington Drive signalized intersections. The two new traffic signals will be interconnected to the City’s Signal Control System to coordinate the signal timing with adjacent signals to optimize traffic flow through this corridor. On August 15, 2017, the City Council approved a Professional Services Agreement with KOA Corporation for miscellaneous traffic signal design. These services were set up with two phases. The first phase was the design of the two new traffic signals at Duarte Road and Lovell Avenue, and Sunset Boulevard and Fairview Avenue. Those traffic signals are now under construction. The second phase was the design of the two mid-block traffic signals on Huntington Drive. The final design was completed in December 2018 with an Engineer’s Estimate of $700,000. DISCUSSION This project will complete all of the traffic signal improvements on Huntington Drive from Santa Clara Street to Gateway Drive (except Huntington Drive and Second Avenue completed earlier by separate contract) and has the following scope elements:  New traffic signal at the mid-block crosswalk of Huntington Drive between Santa Anita Avenue and First Avenue.  New traffic signal at the mid-block crosswalk of Huntington Drive between First Ave and Second Avenue. Huntington Drive Traffic Signal Improvements February 5, 2019 Page 4 of 6  Conduit and fiber optics lines to create redundancy between Santa Anita Avenue and Santa Clara Street, and conduit from Gateway Drive to Fifth Avenue for future connectivity.  Right turn overlap for the Santa Anita Avenue direction of the Santa Anita Avenue and Huntington Drive traffic signal.  Protected/permissive left turn phase for the First Avenue direction of the First Avenue and Huntington Drive traffic signal.  Protected/permissive left turn phase for the Huntington Drive direction of the Huntington Drive and Gateway Drive traffic signal.  Miscellaneous traffic signal upgrades including vehicle detection improvements at the signalized intersections and at the two mid-block crosswalks, new traffic signal cabinets, controllers and equipment for technology advancements in the field of intelligent transportation systems. The project was advertised for bids in January 2019, and on January 22, 2019, eight (8) bids were received for the project as follows: COMPANY BID AMOUNT Belco Elecnor Group $658,472 Select Electric, Inc. $688,647 Comet Electric, Inc. $770,969 California Professional Engineering, Inc. $787,484 JFL Electric, Inc. $800,310 Dynalectric $887,245 DBX, Inc. $1,031,360 Calpromax Engineering $1,115,200 The low bidder, Belco Elecnor Group, has the required license, and is fully qualified to perform the work. Belco has recently completed the Foothill Boulevard Corridor Traffic Signal Improvements for the County of Los Angeles, which included significant work in the City of Arcadia. Belco is currently under contract with the City for the new traffic signals at Duarte Road and Lovell Avenue, and Sunset Boulevard and Fairview Avenue, including signal work at Huntington Drive and Second Avenue. Both the County and the City were satisfied with Belco’s previous work, which was completed in a timely manner with minimal change orders, and their current work is progressing well. At the bid opening, the Belco representative submitted their bid to the City Clerk’s Office a few seconds after 11:00 AM but prior to 11:01 AM. The Notice Inviting Bids states that bids are due no later than 11:00 AM. The Chief Deputy City Clerk made the determination, at that time, that the submittal met the intent of the 1 1:00 AM deadline, and accepted the bid. After the bid opening, the second low bidder, Select Electric, filed a protest with the City claiming that Belco’s bid was late, and should have been rejected, Huntington Drive Traffic Signal Improvements February 5, 2019 Page 5 of 6 making them the low bidder. The City Attorney reviewed the protest and concluded that the Bid Documents are not specific on the exact bid cutoff time, and that the Chief Deputy City Clerk has the authority to accept bids immediately at the cutoff time. A response letter was sent to Select Electric rejecting their protest. It should be noted that Mayor Pro Tem Verlato owns property at 33 E. Huntington Drive, in close proximity to the proposed traffic signal between Santa Anita Avenue and First Avenue. As a result, the City Attorney recommends that Mayor Pro Tem Verlato recuse herself from this action. ENVIRONMENTAL IMPACT This project is categorically exempt per Section 15301(c) of the California Environmental Quality Act (“CEQA”), as an existing highway or street. FISCAL IMPACT This project is funded as part of the Arterial Rehabilitation Project for Huntington Drive from Santa Clara Street to Fifth Avenue. The funding breakdown for the overall project is as follows: PROJECT BUDGET FY FUND Arterial Rehab. Program - Huntington Dr $500,000 2017-18 Capital Outlay Arterial Rehab. Program - Huntington Dr $800,000 2017-18 Prop. C Arterial Rehab. Program - Huntington Dr $450,000 2018-19 Prop. C Arterial Rehab. Program - Huntington Drive (Traffic Signal Improvements including 2 new mid-block traffic signals) $700,000 2017-18 Transportation Impact Total Funds Available $2,450,000 The traffic signal work will be funded by the Proposition C and the Transportation Impact Fee funding portions of the overall budget. There are sufficient funds in the budget to cover this traffic signal contract in the amount of $658,472, including a 10% contingency, and design costs. RECOMMENDATION It is recommended that the City Council approve, and authorize and direct the City Manager to execute a contract with Belco Elecnor Group for traffic signal improvements, including traffic signalization of mid-block crosswalks on Huntington Drive between Santa Anita Avenue and Second Avenue, and miscellaneous traffic signal impr ovements at Huntington Drive Traffic Signal Improvements February 5, 2019 Page 6 of 6 multiple locations on Huntington Drive from Santa Clara Street to Gateway Drive, in the amount of $658,472, with a 10% contingency. Contractor shall perform and complete all Work under this Contract within 60 calendar days, beginning ten (10) calendar days after the date on which the Notice to Proceed is sent by the Owner to the Contractor. Moreover, Contractor shall perform its Work in strict ac cordance with any completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications. Contractor agrees that if such Work is not completed within the aforementioned period and/or pursuant to any such completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications, it is understood, acknowledged and agreed that the Owner will suffer damage. Contractor maintains that he is aware of the provisions of Section 3700 of the California Labor Code which require every employer to be insured against liability for Worker's Compensation or to undertake self-insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Work. If either party commences an action against the other party, either legal, administrative or otherwise, arising out of or in connection with this Contract, the prevailing party in such action shall be entitled to have and recover from the losing party reasonable attorneys' fees and all other costs of such action. 3.8 Successors. The parties do for themselves, their heirs, executors, administrators, successors, and assigns agree to the full performance of all of the provisions contained in this Contract. Contractor may not either voluntarily or by action of law, assign any obligation assumed by Contractor hereunder without the prior written consent of the Owner.
