Declaration This Memorandum of Understanding ("MOU") is entered into between the County of Los Angeles ("County") Department of Public Health ("DPH") and City of Arcadia. 2. Purpose The purpose of this MOU is a voluntary agreement between DPH and City of Arcadia to work cooperatively and collaboratively to mass dispense Medical Countermeasures (MCM), as directed by DPH, in response to a major public health emergency in Los Angeles County in order to protect the health and welfare of the public's health. Pursuant to this voluntary agreement, City of Arcadia would be considered by DPH to be a Public "Medical Point of Dispensing (MPOD)," meaning that City of Arcadia and its employees would partner with DPH to dispense life-saving MCM to the public, open to everyone with no restrictions as outlined in the DPH - City of Arcadia MPOD Dispensing Plan and in accordance with the terms of this MOU. The City of Arcadia understands and acknowledges that this MOU would only be activated by DPH's Public Health Officer (PHO) in the event of a major public health emergency that is accompanied by a declaration of a local, State, and/or federal disaster or emergency. The PHO may, however, in his or her sole discretion, elect to not utilize the City of Arcadia as a Public MPOD. In the event DPH elects to activate this MOU, the City of Arcadia Responsible Person, as identified in Paragraph 14 of the MOU, will be notified by a DPH Responsible Person to activate its Public MPOD site(s) as outlined in the DPH - City of Arcadia MPOD Dispensing Plan. This Plan is public safety sensitive and, as such, is confidential, and not attached to this MOU. This MOU recognizes that City of Arcadia is a critical partner with both the capability and interest in protecting the health of the County's population during a major public health emergency by dispensing MCM preventive medications supplied by, and in accordance with procedures promulgated and/or required by DPH. The City's effort will assist DPH in its efforts to provide preventive medications throughout the County. This MOU provides the policies and procedures to be followed in the event that a major, county-wide public health emergency is declared and the PHO elects to activate the pre- identified Public MPOD site(s) within the jurisdiction of City of Arcadia for the purposes of mass dispense life-saving preventive medications. City of Arcadia will provide personnel resources as outlined in the DPH - City of Arcadia MPOD Dispensing Plan under unified command for the duration of the operations. It is understood that the City and DPH will extend their best efforts to collaboratively mass dispense Medical Countermeasures (MCM), as contemplated by this MOU, consistent with their respective missions and resources. Definitions As used in this MOU, the following terms are defined: • Medical Countermeasure (MCM): FDA-regulated products that may be used in the event of a potential public health emergency stemming from a terrorist attack with a biological, chemical, or radiological/nuclear material; a naturally occurring emerging disease; or a natural disaster. • Mass Dispensing: Provision of antibiotic drugs or vaccine by public health agencies that cannot be provided solely by community clinics and hospitals, or would likely overwhelm their operations. ■ Public Health Emergency: Any situation where, in the judgment of the County DPH's PHO, an emergency condition exists from the introduction of any contagious, infectious, or communicable disease, chemical agent, non- communicable biologic agent, toxin, or radioactive agent, which threatens the health of the general public, and which requires extraordinary actions to protect the public's health. • Medical Point of Dispensing (MPOD): Temporary facilities activated to mass dispense preventive medications to protect the population from the spread of disease during a public health emergency. • The Public Readiness and Emergency Preparedness Act of 2005 (PREP Act): Authorizes the Secretary of the US Department of Health and Human Services (HHS) to issue a PREP Act declaration in response to a public health emergency. A PREP Act declaration provides immunity from liability for any loss caused, arising out of, relating to, or resulting from administration or use of medical countermeasures to disease, threats, and conditions determined in the declaration to constitute a present or credible risk of a future public health emergency. 4. Assumptions • It is anticipated that any public health emergency which results in the PHO determination to seek implementation of the procedures encompassed in this MOU will be preceded by the declaration of a local, State, and/or federal emergency or health emergency by either the PHO or appropriate governmental officer or entity. • The PHO, based upon his/her discretion, in order to contain the spread of contagious, infectious, or communicable disease, may then request the activation of this MOU and opening Public MPOD(s) within the City's jurisdiction in order to quickly and efficiently mass dispense preventive MCM medications. • City of Arcadia, may, at its sole discretion, elect either to accept or decline a request from the PHO to activate Public MPOD(s) and mass dispense preventive MCM medications to the general populous, including the County's and City's population. ■ In the event City of Arcadia accepts the PHO's request to activate its Public MPOD(s), all City of Arcadia personnel involved in the mass dispensing of MOU Between DPH and City of Arcadia Page 2 of 7 preventive MCM medications to the County's population in response to the request of the PHO pursuant to a declared public health emergency and an issued PREP Act declaration, may be provided the same liability protection as all County personnel mass dispensing preventive MCM medication. ■ The preventive MCM medications to be mass dispensed at the activated Public MPOD(s) will be provided to City of Arcadia by DPH at no cost. 5. Creation of Obligation This MOU is not intended to create additional obligations on the part of City of Arcadia or DPH, except as explicitly detailed herein. 6. MOU Activation In the event the PHO determines that it is in the public interest to activate Public MPOD(s) within the jurisdiction of City of Arcadia for mass dispensing preventive medications, the PHO or the DPH Responsible Person will contact one of the City of Arcadia Responsible Persons, or their designee, identified herein below in Paragraph 14, Designation of Responsible Persons. The communication from DPH to City of Arcadia will request the activation of Public MPOD(s) for the purposes of dispensing preventive medications to the general population as outlined in the DPH - City of Arcadia MPOD Dispensing Plan. This communication will also specify the approximate number of preventive medication doses made available by DPH for dispensing at the City of Arcadia MPOD site(s). This determination is made at the sole discretion of the PHO. The allotment of MCM doses may depend upon various factors, including but not limited to, the nature of the communicable or infectious disease present among the population, the availability of preventive medication, and the anticipated effect of the spread of the disease. If the designated City of Arcadia Responsible Person agrees to the PHO's request, that person will coordinate with DPH personnel and confirm the following logistical and operational issues: • Securing and providing access to pre-identified MPOD site(s) • Opening time of the MPOD to public • Duration of MPOD operations • Location and delivery of medications, if different from those identified in the DPH- City of Arcadia MPOD Dispensing Plan • The name and contact information for person(s) responsible for overall operations of the City's Public MPOD (i.e., name, title, phone number, email address), if different from those identified in the DPH-City of Arcadia MPOD Dispensing Plan • Communication of regular situational status reports • Deployment of personnel to operate the Public MPOD(s) under unified command between DPH, City of Arcadia, and Law Enforcement MOU Between DPH and City of Arcadia Page 3 of 7 7. City of Arcadia Responsibilities In the event that City of Arcadia agrees to activate its Public MPOD(s) for the purpose of mass dispensing preventive medication(s), City of Arcadia agrees to perform the following activities: • Deploy City of Arcadia personnel to operate the Public MPOD under unified command between DPH, City of Arcadia, and Law Enforcement as outlined in DPH-City of Arcadia MPOD Dispensing Plan • Provide DPH with access to the pre-identified Public MPOD(s) • Provide facility maintenance and support services throughout the duration of the Public MPOD operations • Coordinate with DPH and Law Enforcement throughout the duration of the Public MPOD operations • Mass dispense preventive medications under the supervision of DPH • Mass dispense preventive medications in accordance with procedures provided by DPH • Communicate on an hourly basis with DPH to provide situational status reports 8. DPH Responsibilities In the event that City of Arcadia activates its Public MPOD(s) at the request of the PHO, DPH agrees that its responsibilities include: • Coordinate and provide an allotment of preventive MCM medications and instructions for their use • Provide procedures and protocols for the mass dispensing of MCM medications • Deliver preventive MCM medications to the City's Public MPOD(s) • Deploy DPH and other County personnel to operate the Public MPOD under unified command as outlined in DPH-City of Arcadia MPOD Dispensing Plan • Mass dispense preventive medications to general population • Provide appropriate personal protective equipment (PPE) to all personnel deployed to operate the Public MPOD under unified command 9. Reimbursements for Costs Incurred It is the responsibility of the respective entities to maintain all records necessary to request federal reimbursement of its own separate costs. Neither party is responsible for the costs incurred by the other in performing any activity related to the DPH-City of Arcadia MPOD Dispensing Plan. DPH will extend good faith efforts to assist City of Arcadia in recovering eligible costs from the Federal Emergency Management Agency ("FEMA"), federal, State, or local government funds, or other permissible sources of recovery. The City of Arcadia agrees to not charge individuals for any medications or costs related to dispensing of preventive medications that have been provided through this MOU, except as otherwise MOU Between DPH and City of Arcadia Page 4 of 7 permitted by the County of Los Angeles or by the Centers for Disease Control and Prevention (CDC). 10. MPOD Activation Plans In coordination with DPH, City of Arcadia agrees to review pre-identified Public MPOD(s), develop and maintain appropriate plans for MPOD activation, maintenance of sustained operations, and dispensing activities as outlined in DPH-City of Arcadia MPOD Dispensing Plan to be reviewed and approved annually. DPH agrees to provide technical assistance including, but not limited to, (a) access to technical expertise, (b) MPOD Dispensing plan templates, (c) MPOD Site Survey toolkit, and (d) recommended dispensing procedures. DPH shall approve final City of Arcadia Public MPOD plans. 11. Training and Exercises To ensure that MPOD Dispensing plans can be effectively operationalized during an actual declared emergency, DPH may request that City of Arcadia personnel participate in trainings and/or exercises to test the capability of City of Arcadia and DPH to jointly implement the MPOD Dispensing Plan, which are performed in accordance with the California Emergency Services Act. Such trainings and exercises shall be scheduled in coordination with City of Arcadia. City of Arcadia agrees to make personnel available for such mutually-agreed upon training and/or exercise events, to the extent that time and resources permit. DPH agrees to assist City of Arcadia in training its personnel in MPOD mass dispensing operations. 12. Assistance in Locating Special Needs Populations City of Arcadia will use good faith efforts to work with DPH to develop procedures and protocols to identify the number of people within the jurisdiction of City of Arcadia, who may require special assistance during a major public health emergency. It is understood that such procedures and protocols must be consistent with all local, State, and federal laws and protect their privacy. 13. Term of Agreement Upon approval by both entities, this MOU shall remain in force until January 1, 2028. Either entity may terminate the MOU by providing sixty (60) calendar days prior written notice to the other. 14. Los Angeles County Department of Public Health (LACDPH) is charged with dispensing life-saving medications to the county's population. To ensure timely delivery of preventive medication in an emergency, there are various strategies to serve the large population of Los Angeles County. The Public Medical Point of Dispensing (Public MPOD) is one of the strategies that LACDPH may activate in response to a public health emergency. Engaging partners to manage and operate Public MPODs to supplement other dispensing strategies strengthens our community's preparedness. Government agencies, private businesses, school districts, and universities are some examples of potential Public MPOD partners with facilities that may serve as a Public MPOD site. Public MPODs are temporary mass dispensing sites that are open to everyone with no restrictions on who can go to them, to receive life-saving preventive medication (vaccine or pills) during a public health emergency. Public MPODs may be activated in the event of a major public health emergency accompanied by a declaration of a Local, State, and/or Federal disaster or emergency, however, may not be utilized at the time of the incident. OVERVIEW A Public MPOD is a large-scale dispensing site to provide preventive medication (i.e. antibiotics, vaccines) to potentially exposed individuals in response to a public health emergency. The Public MPOD is activated by the Department of Public Health under the authority of the PHO, in coordination with partnering agencies after a public health emergency is officially announced and life-saving preventive medication is available. There are different supplies and personnel requirements depending on the type of public health emergency and preventive medication being dispensed at the Public MPOD. LACDPH will provide guidelines for mass dispensing the preventive medications. PURPOSE This document is to serve as a reference for activating a Public MPOD to dispense preventive medication in the event of a public health emergency. This plan involves the voluntary partnership between LACDPH and the City of Arcadia as outlined in the Memorandum of Understanding (MOU) and MPOD site specific plans. The execution of the plan is dependent on the capability of the Public MPOD partner to secure the pre-identified MPOD sites and dispense preventive medications to the population. The Public MPOD will be operated under unified command and situational updates will be provided to LACDPH in accordance to the MOU and public health guidelines. There are MPOD site specific plans for each pre-identified MPOD facility that also includes incident specific action plans. PLANNING ASSUMPTIONS The following planning assumptions are applicable: 1. Speedy provision of preventive medications to potentially exposed individuals is the most effective intervention to prevent disease and save lives in the early phase of a public health emergency incident 2. The PHO in Los Angeles County has requested the activation of the Public MPOD strategy 3. The federal government maintains and will deliver sufficient amounts of preventive medication to Los Angeles County for mass dispensing 4. The incident will trigger: a. Significant public and social concern and anxiety b. Large numbers of "worried well" c. Significant demand for timely public information and risk communication d. Elevated potential for social disruption and disorder e. Significant and wide-spread disruption to economic, transportation, educational, and other aspects of day-to-day activities f. Significant and sustained media attention and requests for information • Management and control of misinformation is essential and significant challenge • The public MPOD sites will be open to provide preventive medications to the entire population • Public MPOD sites will continuously operate until demand has ceased or PHO decides to demobilize MPOD sites 5. Upon activation and pursuant to the MOU, the City of Arcadia has the capability to mobilize their personnel resources to dispense life-saving preventive medication to the population under unified command with DPH. 6. In the event the City of Arcadia activates a Public MPOD, all personnel involved in the mass dispensing of preventive medical countermeasure (MCM) medications in response to the request of the PHO to a public health emergency,will be provided liability immunity provided by a PREP Act ("Public Readiness and Emergency Preparedness Act") declaration. Public MPOD sites will continue to operate and mass dispense preventive MCM medications until demand has ceased and/or demobilized by PHO. GOAL AND COMMAND OBJECTIVES The MCM mass dispensing goal is to protect the public's health by preventing disease and deaths through rapid provision of preventive antibiotics and vaccine. 1. Implement mass dispensing of preventive MCM medications at Public MPOD site(s) with the City of Arcadia 2. Ensure safety for all MPOD response personnel and clients 3. Maintain communication and situational awareness RESPONSIBILITIES City of Arcadia In the event the City of Arcadia activates Public MPOD(s)for the purpose of dispensing preventive medication(s), they agree to perform the following activities: 1) Securing and providing access to the pre-identified Public MPOD site(s) 2) Ensure the opening of the Public MPOD site(s) at the agreed upon designated opening time 3) Ensure pre-identified Public MPOD site(s) are open for the duration of mass dispensing operations. 4) Provide the name and contact information for person(s) responsible for overall operations of the Public MPOD during each operational period 5) Provide facility support services throughout the duration of the Public MPOD operations 6) Deploy City of Arcadia personnel to operate Public MPOD under unified command 7) Ensure presence of law enforcement at Public MPOD site(s) in accordance to Public MPOD site specific plans 8) Assist with dispensing of preventive medications, in accordance with procedures provided by DPH. 9) Communication with DPH, City of Arcadia, and law enforcement emergency operations centers during Public MPOD operations to provide situational status reports. Provide personal protective equipment (PPE) to all personnel deployed to operate Public MPOD under unified command ACTIVATION In accordance with the MOU between LACDPH and the City of Arcadia, the decision to activate Public MPOD is determined under the authority of the Los Angeles County Public Health Officer in response to a major public health emergency accompanied by a declaration of a local, state, and/or federal disaster or emergency. However, it is understood that at the time of the event, pre-identified Public MPOD site(s) may not be activated. The City of Arcadia will utilize the City of Arcadia notification system to contact Public MPOD designated team and dispensing operation personnel. They will be notified to report to the pre-designated Public MPOD site(s) and to bring their work identification. Public MPOD Designated Personnel Each pre-identified Public MPOD site will have designated personnel(s) that will be notified in the event the Public MPOD site(s) are activated to secure and provide access to the facility (see MPOD site specific plans). In addition, a minimum of one (1) City of Arcadia personnel will be identified per MPOD site to fulfill the role of the City of Arcadia MPOD Leader to operate the MPOD in unified command with DPH and Law Enforcement. There will be at minimum two (2) law enforcement present throughout the operational period at he MPOD site. The City of Arcadia will designate and deploy additional personnel for MPOD positions as agreed upon in the MPOD site specific plans. The table below outlines the minimum number of City of Arcadia personnel designated to assist with MPOD response. All other personnel for remaining MPOD positions will be the responsibility of LACDPH. The unified command at each of the MPOD sites will be responsible for taking receipt and confirming delivery of the MPOD supplies and medication. In addition, they will coordinate the setup of table and chairs, stanchions, and station supplies as designated in the MPOD Site Specific plans and IAP in accordance with the MPOD Field Operations Manuals. The MPOD Field Operations Manual provides a step-by-step procedure for all the specific tasks to be completed in preparing for, during, and demobilizing mass dispensing operations.
