SUBJECT: ADDITIONAL APPROPRIATION FOR THE SIDEWALK ACCESSIBILITY/
ADA RAMPS PROJECT FROM TRANSPORTATION DEVELOPMENT
ACT, ARTICLE 3 FUNDS IN THE AMOUNT OF $29,000
Recommendation: Approve
SUMMARY
The City annually receives funding from the State Transportation Development Act
(“TDA”) Article 3 program, exclusively for bicycle, pedestrian, and ADA improvements.
The funding must be spent within three (3) years of the initial authorization. The City
currently has approximately $21,000 in TDA Article 3 funding that will lapse if not spent
by June 2019. Therefore, it is recommended that the City Council approve an additional
appropriation of $29,000 from TDA Article 3 funds for the Sidewalk Accessibility/ADA
Ramp project that is already budgeted in the Capital Improvement Program (“CIP”).
BACKGROUND
Every year, the City receives TDA Article 3 fund s exclusively for bicycle, pedestrian, and
Americans with Disabilities Act (“ADA”) improvements. The amount has been steadily
increasing over the years, and currently is approximately $35,000 annually. The funds
must be spent within three years of the initial allocation. Projects have been budgeted
every two years in the City’s CIP in the amount of $50,000 to utilize the funding where the
needs are the greatest. Historically, these funds have been used to fund the City’s
Sidewalk Transition Plan, adopted in 2003, which identifies and prioritizes ADA upgrades
and sidewalk improvements throughout the City.
In the 2017-18 Fiscal Year CIP, $50,000 in TDA Article 3 funds were budgeted for the
Sidewalk Accessibility/ADA Ramp project. The majority of this budget was used to
construct the missing sidewalk segment on Colorado Boulevard from the Newcastle Park
driveway to the Gold Line Bridge, thus connecting a pedestrian access from San Antonio
Road to Santa Anita Avenue. The remaining balance in the project budget is
approximately $1,600.

Upon reporting the expenditure of the $48,000 in TDA Article 3 funds to the State, it was
discovered that the City has an additional $21,000 in TDA Article 3 funding available that
will lapse if not spent by June of 2019.
DISCUSSION
A supplemental project has been assembled for the sidewalk accessibility/ADA Ramps
project, which includes the following elements:
1. An ADA Accessible curb ramp on the northwest corner of Virginia Drive and
Oakwood Avenue across from Highland Oaks Elementary School
2. An ADA Accessible curb ramp on De Anza Place in front of Hugo Reid Park
3. Sidewalk extension on the west side of Encino Avenue from north of Camino
Grove Avenue to Encino Court including a ADA Accessible curb ramp at the
corner
The estimated total cost of the project is $25,000. Because the project will be under the
$30,000 informal bidding limit, the project will be informally bid and administratively
approved. However, additional funding must be appropriated by the City Council before
this project can proceed.
It is recommended that an additional appropriation of $29,000 be provided in TDA Article
3 funds to cover the lowest bid for the project, along with a small contingency.
ENVIRONMENTAL IMPACT
This project is categorically exempt per Section 15301(c) of the California Environmental
Quality Act (“CEQA”), because it involves minor modifications to existing public parkways.
FISCAL IMPACT
The $29,000 in TDA Article 3 funds has been authorized by the State, and is available for
expenditure. TDA Article 3 funds are limited in their use and must be spent on bicycle,
pedestrian, and ADA projects. If the City does not spend at least $21,000 by June 2019,
that portion of the funding will lapse.
RECOMMENDATION
It is recommended that the City Council approve an additional appropriation for the
Sidewalk Accessibility/ADA Ramp project from Transportation Development Act, Article
3 funds in the amount of $29,000.
