HomeMy WebLinkAboutItem 11a - Regular Meeting Minutes of March 5, 2019 1 03-05-2019 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, MARCH 5, 2019 CALL TO ORDER – Mayor Tay called the meeting to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, and Tay ABSENT: Amundson It was moved by Council Member Chandler, seconded by Mayor Pro Tem Verlato, that Council Member Amundson be excused from this meeting. PUBLIC COMMENTS – No one appeared. STUDY SESSION a. Report, discussion, and direction regarding the Eisenhower Memorial Park Renovation Project. Director Recreation and Community Services Somogyi and Public Works Services Director Tait provided a report regarding the Eisenhower Memorial Park Renovation Project. The City Council conceptually approved the project, which will be brought back to the City Council at a future meeting for consideration. The City Council asked staff to follow up on the type of trees that are being proposed to be removed near the parking lot side of the project, and, depending on the type of trees, asked that they be saved if possible and appropriate. Public Works Services Director Tait will follow-up and report back to the City Council. The meeting ended at 6:42 p.m. Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the regular meeting to order at 7:00 p.m. 2. INVOCATION – Rabbi Sholom Stiefel, Chabad of Arcadia 3. PLEDGE OF ALLEGIANCE – Gene Glasco, Elected City Clerk 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, and Tay ABSENT: Amundson 2 03-05-2019 It was moved by Council Member Beck, seconded by Council Member Chandler, that Council Member Amundson be excused from this meeting. 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that the City Council met in a Study Session, prior to the regular meeting, to hear a report from staff and discuss the Eisenhower Memorial Park Renovation Project; and that there was no other reportable action. He did note that the City Council provided some direction to staff regarding some of the amenities, which will be included in the proposed park renovation. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto confirmed that the Eisenhower Memorial Park Renovation Project will be paid with Development Park Funds, not General Fund money; and also noted that Mike Willman, the Public Information Officer from Santa Anita Park will provide comments, after the presentations portion of the agenda, regarding incidents that have been developing at the racetrack. The City Council concurred. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Beck, to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Pasadena Humane Society presentation of adoptable dog. b. Arbor Day Proclamation presented to the Arcadia Beautiful Commission. c. Arcadia High School Music Club Presentation of vintage Arcadia High School Marching Band uniforms to the City of Arcadia. Mike Willman, Santa Anita Park Public Information Officer, appeared and provided information and an update regarding the recent horse fatalities at the racetrack, and indicated that horseracing has been suspended effective immediately until further notice. 9. PUBLIC COMMENTS Dean Radle, an Arcadia resident, appeared and commented on the proposed sales tax increase and indicated that he supports police and fire services, and feels that a lot of transparency will be needed, and that scare tactic fliers is not the way to do it; he thinks the historic preservation has lost the City a lot of voters; he feels that with the racetrack closing, the City will lose some revenue, and provided some alternate options for the property; he spoke about a hiring freeze, and temporary pay reductions, and hopes that all options will be discussed; and indicated that until there is more transparency, he and his wife will be voting no on the sales tax increase due to lack of communication. 3 03-05-2019 Raina Martinez, representing the Foothill Unity Center, appeared and invited the City Council to the Community Health Fair at the Foothill Unity Center on Saturday, March 16, and provided information on the activities and services that will be provided. Sheng Chang, former Council Member, appeared and thanked Public Works Services Department employee John Corona who recently assisted him resolve a plumbing issue on his property, and he also thanked Mike Vercillo of the Arcadia Police Department who assisted him with his Ring security device; he spoke in opposition of the Historical Preservation Ordinance, and recommended that the City Council reconsider it, and he provided his reasons. 10. MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck thanked Mayor Tay for continuing the adoptable dog presentations; he thanked the Lions Club for their donation to Library; he indicated that the Oaks called a special meeting at the Police Department to discuss safety and burglaries, and reminded everyone that anyone can go to www.crimemapping.com to find out about crime in their neighborhood; and he noted that on Friday, he was invited to speak to the leadership students at Arcadia High School. Council Member Chandler responded to Mr. Radle’s comments regarding the City’s educational efforts; he commented on a recent State ruling of buying air time, and the PERS deficit; and he explained the purpose of the ¾ cent sales tax increase, and welcomed Mr. Radle to meet with him. Mayor Pro Tem Verlato indicated that on February 23, she attended the Santa Anita Little League opening day ceremonies, then Senator Rubio’s Coffee, and later that evening she attended the Arcadia High School Music Club fundraiser; she stated that last week she and City Manager Lazzaretto and Director of Recreation and Community Services Somogyi met with Supervisor Kathryn Barger regarding homelessness; and she also thanked Public Works Services for assisting her with her emergency over the weekend. City Clerk Glasco indicated that last Thursday, he attended the Elks Lodge Annual Public Safety Appreciation luncheon; and noted that the marching band uniforms brought back some memories, and was happy to hear that will be added to the Gilb Museum’s collection. Mayor Tay indicated that on behalf of Council Member Amundson, who is absent from this meeting, he announced that March 14, at the Library is “Meet your Beat Commander for District 4”, that Lt. Whalen will discuss public safety. He also indicated that on February 23, he attended the Arcadia High School Music Club fundraiser at the Masonic Center; he announced that on March 8, there will be a Senior Expo at the Community Center, and March 20, the Public W orks Services Department will be having a free “leak detection” workshop, and those interested should contact Public Works Services to make a reservation, and noted that participants will receive a free leak detection kit, and on April 14, and May 11, at the Library, the Public W orks Services Department will be giving out 2 cubic yards of mulch to Arcadia residents. 11. CONSENT CALENDAR a. Regular Meeting Minutes of February 5, 2019. Recommended Action: Approve 4 03-05-2019 b. Donation from the Arcadia Lion’s Club Foundation in the amount of $1,000 for the purchase of large print materials. Recommended Action: Accept c. Professional Services Agreement with CentralSquare Technologies, LLC for False Alarm Program Management Services. Recommended Action: Approve d. Extension to the Professional Services Agreement with Westerly Meter Service Company for large water meter testing, repair, and calibration services in an amount not to exceed $28,000. Recommended Action: Approve e. Contract with R Dependable Construction, Inc. for the Guardrail Retrofit at Arcadia Wash Project in the amount of $29,700. Recommended Action: Approve f. Contract with All American Asphalt for the Fiscal Year 2018-19 Pavement Rehabilitation Project in the amount of $2,517,700. Recommended Action: Approve g. Waive expenses related to Traffic Control Services for the Twenty-Fifth Annual Santa Anita Derby Day 5K Run & Walk to be held on Saturday, April 6, 2019. Resolutions relating to an All-Mail Ballot Special Municipal Election to be held on Tuesday, June 4, 2019; and approve a Supplemental Budget Appropriation in the amount of $225,000. City Manager Lazzaretto presented the staff report. Resolution No. 7246 calling for the placement of a General Tax Measure on the ballot at the June 4, 2019, Special Municipal Election for the submission to the qualified voters of a proposed ordinance adding Part 5.5 to Chapter 6 (Taxes) of Article II (Administration) of the Arcadia Municipal Code to establish a three-quarters percent (three-quarter cent) General Transactions and Use Tax (Sales Tax). Recommended Action: Adopt It was moved by Council Member Chandler, seconded by Council Member Beck, and carried on roll call vote to adopt Resolution No. 7247 requesting the Board of Supervisors of the County of Los Angeles to render full services to the City relating to the conduct of a Special Municipal Election to be held on Tuesday, June 4, 2019. AYES: Chandler, Beck, Verlato, and Tay NOES: None ABSENT: Amundson Resolution No. 7248 providing for the filing of primary and rebuttal arguments and setting rules for the filing of written arguments regarding a City Measure to be submitted at the June 4, 2019, Special Municipal Election. Recommended Action: Adopt It was moved by Council Member Chandler, seconded by Council Member Beck, and carried on roll call vote to adopt Resolution No. 7248 providing for the filing of primary and rebuttal arguments and setting rules for the filing of written arguments regarding a City Measure to be submitted at the June 4, 2019, Special Municipal Election. Report, discussion and direction regarding the Los Angeles County Flood Control District’s Santa Anita Dam Stormwater Flood Management & Seismic Strengthening Project. Recommended Action: Provide Direction Mayor Pro Tem Verlato provided an update on the spreading grounds, and feels that the City needs to stay on top of the County, and the project. Public Works Services Director Tait indicated that after the last City Council meeting, he reached out to the project manager for the County, and was told they were having problems with the contractor; he further indicated that after his telephone call with the project manager, and putting pressure on the County, they were able to manually get water into the spreading grounds; he provided additional information regarding the other local spreading grounds; and suggested writing a letter to the County or bring ing the County to a future City Council meeting for a presentation and update on the project. 6 03-05-2019 In response to an inquiry by City Manager Lazzaretto, Public Works Services Director explained the components that make up the entire $52 million project. It was the consensus of the City Council that a letter from the City Council to the County thanking them for their efforts to date, but nicely urging them to get the project finished as quickly as possible was warranted. No other action was requested or taken on this item. c. Report, discussion and direction regarding Cannabis Control Regulations, Industrial Facilities, and Marijuana Deliveries. Recommended Action: Approve and Authorize Sending a Letter to the City of El Monte and Provide Direction Regarding Bureau of Cannabis Control Regulations City Manager Lazzaretto presented the staff report. It was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote to lend Arcadia’s name in the lawsuit, but to provide no financial contributions to the effort. AYES: Beck, Chandler, Verlato, and Tay NOES: None ABSENT: Amundson It was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote to approve the draft letter to the City of El Monte, and authorize the Mayor to sign on behalf of the City.
