HomeMy WebLinkAboutItem 9a - Regular Meeting Minutes of March 19, 2019 1 03-19-2019 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, MARCH 19, 2019 CALL TO ORDER – Mayor Tay called the meeting to order at 6:03 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Chandler, Verlato, and Tay ABSENT: None PUBLIC COMMENTS – No one appeared. STUDY SESSION a. Report, discussion, and direction regarding Driveway Study in Single-Family Zoned Areas and Annual Overnight Parking Street Permit Fees. City Manager Lazzaretto, Assistant City Manager/Development Services Director Kruckeberg , and Management Aide Alana Bautista presented the staff report. It was moved by Council Member Beck, seconded by Mayor Pro Tem Verlato, and failed on a roll call vote to limit the number of vehicles parked on any lot between the front façade of the house to the street to no more than six (6). AYES: Beck and Verlato NOES: Amundson, Chandler, and Tay ABSENT: None It was moved by Mayor Pro Tem Verlato, seconded by Council Member Beck, and carried on roll call vote to prepare a resolution increasing the overnight parking street permit fee from $84 to $125. AYES: Verlato, Beck, Amundson, Chandler, and Tay NOES: None ABSENT: None CLOSED SESSION a. Conference with Legal Counsel – Anticipated Litigation - Significant exposure to litigation pursuant to Government Code Sec. 54956.9(d)(2) – one (1) case. No reportable action was taken on the Closed Session item. The meeting ended at 6:41 p.m. 2 03-19-2019 Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the regular meeting to order at 7:02 p.m. 2. INVOCATION – First Reader, Kristin Bennett – First Church of Christ, Scientist 3. PLEDGE OF ALLEGIANCE – Gene Glasco, Elected City Clerk 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Chandler, Verlato, and Tay ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that prior to the regular meeting, the City Council met in a Study Session to hear a report from staff regarding a driveway study in single-family zoned areas and annual overnight parking street permit fees. Regarding the driveway study in single-family residential areas, City Attorney Deitsch reported that Council Member Beck made a motion, which was seconded by Mayor Pro Tem Verlato, to limit the number of vehicles parked between the front façade of the home and the street on any lot to six (6); and stated that the motion was defeated on a 2-3 vote (3 opposed), with Mayor Tay, and Council Members Amundson and Chandler voting No. Regarding the overnight parking street permit fees, City Attorney Deitsch stated that the existing fee of $84 was established by the City Council in 1997, and has not increased since that time; he reported that on motion by Mayor Pro Tem Verlato, and seconded by Council Member Beck, the City Council unanimously 5-0 directed staff to bring back for City Council consideration at a future meeting, an increase in the overnight parking street permit fees from $84 to $125, effective July 1, 2019, if approved by the City Council. City Attorney Deitsch further announced that the City Council also conducted a Closed Session to discuss anticipated litigation, with the City Attorney, regarding the threat of litigation relating to City Manager item 12.a, the Historical Preservation Ordinance, and that no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto indicated that several emails received since the agenda was posted on the City’s website last Friday, up to the time of meeting, were distributed to the City Council relating to City Manager item 12.a (the Historic Preservation Ordinance); and that new pages to the draft Ordinance were also distributed to the City Council because some section headings, and page numbers were missing when it was printed. 3 03-19-2019 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, and seconded by Council Member Amundson, to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Presentation of Donate Life Month Proclamation to Ambassador Rachel Rodriguez. b. Presentation of Red Cross Month Proclamation to Erica Frausto, Executive Director of the American Red Cross San Gabriel Pomona Valley. c. Presentation by Census Bureau representatives Lydia Lee and Michael Khouri to promote the 2020 Census count. City Manager Lazzaretto indicated that under City Manager Supplemental Information he failed to mention, that City Manager item 12.b relating to the proposed Dr. Robert Wilson Memorial be pulled from the agenda indefinitely; he stated that the requestor and site host are still having some discussions on this matter, and that the item will be brought back at a later date. 9. PUBLIC COMMENTS Mayor Tay indicated that prior to the public comment period, City Attorney Deitsch will address a couple of procedural issues. Regarding City Manager item 12.a, the historical preservation item, City Attorney Deitsch indicated that a public hearing was held on February 19, 2019, which was closed, and that if anyone feels the need to speak again on this matter, they may do so, but stated that any comments made will not be part of the public hearing record. He further indicated that the City Council would appreciate it if those individuals who spoke at the public hearing on February 19, 2019, not speak again, but if they feel the need to speak, they should try not to repeat what has already been spoken in order to expeditiously move this item on to the introduction of the Ordinance. City Manager Lazzaretto reminded everyone in the audience that this is a business meeting; and stated that the Mayor has limited the public comment period to 3 minutes. Mayor Tay called for Public Comments, and the following individuals appeared and spoke regarding the Historical Preservation Ordinance. MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck thanked Rachel Rodriguez for sharing her heart-breaking story; he congratulated Courtney Ziska who is receiving an award from the School District on March 26; and he announced the Silver Circle Volunteer Dinner on March 28. Council Member Chandler also thanked Rachel Rodriguez for sharing her story. Council Member Amundson thanked Lt. Vaughn Whalen and Community Affairs Officer Mike Vercillo for attending the “Meet Your Beat Commander” safety workshop last week and for speaking to the residents about safety and burglaries, and indicated that anyone can go to www.crimemapping.com to find out about crime in their neighborhood; he spoke about gas tax money that may be taken away from cities for the repair of roads; he explained his concerns that the Gold Line in Downtown Arcadia will begin charging for parking; and he announced the Patriotic Festival on June 29, and if anyone is interested in being a sponsor, they should see him. Mayor Pro Tem Verlato announced “Peacock Day” at the Arboretum on March 23, and March 30, “Chicago” will be performing at the Performing Arts Center, and encouraged everyone to attend; and she indicated that all 15 basins in the Santa Anita Wash are now full of water. City Clerk Glasco announced the Arcadia Vietnam Memorial is getting ready for the 22nd Annual Tribute to Veterans and Military Families on May 25, hosted by L.A. County Supervisor Barger, and that they will be selling baseball caps and shirts with all proceeds going to the Monument Memorial Fund; and he further announced that a very generous Arcadia business, whose name will be given at a later date, will be donating a clean dependable later model used car to a deserving veteran. Mayor Tay announced that tomorrow, Wednesday, March 20, from 7-8pm, the Chief of Police will be at the Masonic Center to answer questions from the residents. City Manager Lazzaretto noted that there will be Mandarin translators available at that event. 11. CONSENT CALENDAR a. Regular Meeting Minutes of February 19, 2019. Recommended Action: Approve b. Resolution No. 7249 electing to be exempt from the Los Angeles County Metropolitan Transportation Authority’s Congestion Management Program. Recommended Action: Adopt c. Additional appropriation for the Sidewalk Accessibility/ADA Ramps Project from Transportation Development Act, Article 3 funds in the amount of $29,000. Recommended Action: Approve d. Purchase Order with Play and Park Structures for the purchase and installation of playground equipment at Hugo Reid Park and authorize an appropriation in the amount of $72,335.77. Recommended Action: Approve 5 03-19-2019 It was moved by Council Member Chandler, seconded by Council Member Amundson, and carried on roll call vote to approve Consent Calendar Items 11.a, through 11.d. AYES: Chandler, Amundson, Beck, Verlato, and Tay NOES: None ABSENT: None 12. CITY MANAGER a. Ordinance No. 2359 amending various Sections of Article IX, Chapter 1 of the Arcadia Municipal Code (the “Development Code”), with an exemption under the California Environmental Quality Act (“CEQA”), to implement a Historic Preservation Ordinance. Recommended Action: Introduce Assistant City Manager/Development Services Director Kruckeberg presented the staff report. During the discussion on the Draft Ordinance, it became the consensus of the City Council to implement a Historic Preservation Ordinance, but that it should be revised to make participation in the historic designation process fully voluntary by removing the ability for the City Council to supersede an owner’s objection to a designation request. In addition, the City Council generally wished to modify the criteria for formation of a Historic District such that not only would 75% of the property owners overall in a proposed Historical District need to approve of the District, but also 100% of the contributing properties within the District would need to consent to the formation. It was moved by Council Member Chandler, seconded by Council Member Amundson, and carried on roll call vote to introduce Ordinance No. 2359 amending various Sections of Article IX, Chapter 1 of the Arcadia Municipal Code (the “Development Code”), with an exemption under the California Environmental Quality Act (“CEQA”), to implement a Historic Preservation Ordinance , as revised to: (1) make participation in the historic designation process fully voluntary; (2) remove the ability for the City Council to supersede an owner’s objection to a designation request; and (3) modify the criteria for formation of a Historic District. AYES: Chandler, Amundson, Verlato, and Tay NOES: None ABSENT: None ABSTAIN: Beck b. Report, discussion and direction regarding the proposed Dr. Robert O. Wilson Memorial. Recommended Action: Provide Direction This item was pulled from the agenda. c. Report, discussion and direction regarding modifying the City Council meeting schedule during the summer months. Recommended Action: Provide Direction The City Council discussed modifying the City Council meeting schedule during the summer months. It was the consensus of the City Council that a modified summer schedule was not needed; however, they reinforced their expectation that the City Manager should call for the 6 03-19-2019 cancellation of a meeting when there are no important or time sensitive items to be considered. The City Council does not wish to meet just for the sake of meeting. 13. ADJOURNMENT The City Council meeting adjourned at 9:57 p.m. to Tuesday, April 2, 2019, 6:00 p.m. in the City Council Conference Room.
