TUP 19-07 TO ALLOW A FARMERS’ MARKET AT THE ARCADIA PUBLIC LIBRARY PARKING LOT AS A RECURRING EVENT BEGINNING ON JULY 28, 2019 Recommendation: Approve SUMMARY The attached application was filed by Raw Inspiration (“Applicant”), a registered 501(c)(3) non-profit entity, of Calabasas, CA, for a Temporary Use Permit to produce a Certified Farmers’ Market (“Market”) at the Arcadia Public Library (“Library”) parking lot (see the attached application materials, Attachment “A”) for a period of one year from July 28, 2019, through July 25, 2020. It is recommended that the City Council approve Temporary Use Permit No. TUP 19-07, subject to the conditions of approval listed in this staff report, and to allow future Farmers’ Market events at the Arcadia Public Library to be reviewed administratively. BACKGROUND Raw Inspiration approached the City of Arcadia at the request of the Downtown Arcadia Improvement Association (“DAIA”) to conduct a Farmers’ Market in Arcadia (Attachment “B”). Raw Inspiration was originally interested in hosting their Market in Downtown Arcadia; however, due to costly logistical issues and impacts to existing businesses, an alternative site was recommended. It should also be noted that other operators have tried to conduct Farmers’ Markets in the Downtown with varying degrees of success. The Applicant requested that the City review several other additional locations including the Arcadia Community Center parking lots and the City Hall lawn. Both locations have existing uses on the weekends, with the former open 7 days a week for community activities and events, and the latter conflicting with uses at the City soccer field. The Library front parking lot was recommended as an ideal alternative location due to its ample parking and easy access, especially when the Library is closed on Sundays. The Temporary Use Permit No. TUP 19-07 – Farmers’ Market June 4, 2019 Page 2 of 7 Market will be held in the front parking area of the Library, which is highly visible to vehicle traffic going both east and west through the City. DISCUSSION Raw Inspiration operates over 20 Certified Farmers’ Markets in southern California, including locally at the Monrovia Street Fair, and the La Cañada Flintridge Farmers’ Market. The Applicant is requesting to produce a Certified Farmers’ Market every Sunday morning from 9:00 a.m. to 2:00 p.m. beginning July 28, 2019, through July 25, 2020, at the Arcadia Public Library parking lot. Set-up is to begin at 7:00 a.m., with final clean-up to be completed by 4:00 p.m. The Library is closed on Sundays. The Market will be similar to other Raw Inspiration markets and will include 20-30 vendors, featuring flowers, prepackaged and prepared foods, fresh produce, artisanal breads, cheeses, meats, oils, and other craft vendors. Raw Inspiration will also provide a fully-trained manager to oversee the operation of the Market. The attached site plan provides an overview of the expected layout of the Market. The manager will run the Market during operating hours according to prescribed rules, regulations, and conditions. The Applicant will provide accessible restrooms during the event and will coordinate the removal of the restrooms by the time the Library resumes operations on Monday morning. The Applicant will also be responsible for ensuring that the Library parking lot is clean and all trash and trash bins have been removed by the time the Library resumes operations. This includes taking pictures of the parking lot before and after the event. Should the area not be cleaned, Public Works Services staff will clean the affected areas at a cost to the Applicant as described in the Conditions of Approval. The Applicant will also be responsible for closing the entrances to the tented areas of the Library parking lot to ensure a safe environment. The Ar cadia Police Department has recommended that a vehicle be parked at the entrance to the Library parking lot off of Santa Anita Avenue and another vehicle barrier at the west end of the Library’s front parking area. The Applicant is also required to post pa rade barricades in front of the vehicle closures. Further, the Applicant requires all their vendors to provide a certified white fire retardant tent canopy to not only ensure public safety but also a nice aesthetic for their events. Parking will be available in the west Library parking lot and sufficient parking is available for vendors and an estimated 100-500 attending patrons during the course of the Market. The City has contacted the Arcadia Masonic Lodge regarding the event and they do not anticipate any conflicts with their programming. The City will provide directional street signage at a cost to the Applicant for the first several months of the Market to help inform drivers on how to access event parking. No additional parking control methods are suggested at this time. Should there be issues or concerns that Temporary Use Permit No. TUP 19-07 – Farmers’ Market June 4, 2019 Page 3 of 7 arise, the City does reserve the right to add additional terms and conditions to help manage the flow of parking at a cost to the Applicant. The Applicant is not permitted to place any signs in the public rights-of-way, on any street lights, or utility posts without prior approval from the City. Raw Inspiration will be responsible for marketing and advertising the Market to the broader Arcadia community. A sample of their marketing materials is attached (Attachment “C"). The City will help promote the event through its traditional public outreach channels, including the City Newsletter, Hot Sheet, website, and social media. The City will provide noticing to adjacent property owners regarding the event. Raw Inspiration has run numerous successful and safe events for several years and there have been no concerns or issues with their past events. This permit is for a term of 12 months so that the City and Ra w Inspiration can determine whether this is a successful venture and partnership. Should it prove fruitful, to expedite future applications, it is recommended that future Farmers’ Markets at the Arcadia Public Library be authorized for administrative approval by the Development Services Director, unless significant operational changes are proposed. The following Conditions of Approval are recommended: 1. The special event is approved for operating hours of 9:00 a.m. to 2:00 p.m . on Sundays at the Arcadia Public Library parking lot. Event set-up shall begin by 7:00 a.m. and post-event clean up shall be completed by 4:00 p.m. 2. This permit shall be valid for fifty-two (52) days from July 28, 2019, through July 25, 2020, for a period of 12 months. 3. No signs are permitted in public rights-of-way, on any street lights, or utility posts without prior approval from the Development Services Director or their designee. If a sign has been installed without approval or is otherwise prohibited, the sign ma y be immediately removed by City personnel. 4. All event vendors shall be required to submit a copy of their seller’s permit directly to Raw Inspiration. Raw Inspiration shall then submit a final list of all event vendors and a copy each seller’s permit to the Business License Division no later than one week prior to each Market. 5. All trash and debris that results from this event shall be removed by the Applicant immediately following the end of the event. Should trash and debris remain after the event, at the discretion of the Public Works Services Director, street sweeping may occur at the Arcadia Public Library at a cost of $147/hr ., and assessed to the Applicant. The City will provide directional signage by digital message board during hours of operation for a period to be determined by the Police Chief, Development Services Director, Public Works Services Director, or their designees at a cost of $9.76/hr., and assessed to the Applicant. 7. The Applicant shall provide accessible restrooms during the event. The restrooms shall be placed no earlier than 6:00PM on Saturday and shall be removed no later than 8:00AM on Monday. 8. The Applicant shall provide hard closures by use of vehicle at the entrance to the Library parking lot off of Santa Anita Blvd. and another vehicle barrier at the west end of the Library’s front parking area. The Applicant shall also post parade barricades in front of the vehicle closures. 9. The Arcadia Police Department will assign Volunte ers in Policing (“VIP”s) to the event as needed for parking and traffic control. Additional Police Department personnel shall be added at the discretion of the Arcadia Chief of Police, or designee. 10. The Applicant shall obtain all required permits and comply with all Los Angeles County Department of Public Health requirements for community events, including but not limited to, a Community Event Organizer Permit and a Temporary Food Facility Permit. Additional outdoor cooking regulations include: a. Cooking must take place at least 18 inches away from tents and other combustible materials. b. No combustible materials are allowed underneath cooking equipment such as cardboard of plastic mats. c. A Class K of 40BC fire extinguisher is required for tents with cooking operations. d. Tents with cooking operations shall be spaced at a minimum of 10 feet from other tents. e. All other tents (10’ x 10’) can be grouped up to 700 sq. ft., or 7 maximum. A 12 foot fire break is then required between the groupings 11. All future Raw Inspiration events proposed at the Arcadia Public Library shall be subject to administrative approval of a Temporary Use Permit by the Development Services Director, or their designee. A City Council hearing shall not be required for these events, unless significant operational changes are proposed, or if required by the Development Services Director; in which case, the application may be referred to the City Council. 12. Noncompliance by the Applicant with any Arcadia Municipal Code provisions or the provisions and Conditions of Approval for TUP 19-07 shall be grounds for Temporary Use Permit No. TUP 19-07 – Farmers’ Market June 4, 2019 Page 5 of 7 immediate suspension or revocation of any approvals, which could result in the closing and/or cancellation of the event. Any problems identified by the Development Services Director may be bro ught forward to the City Council for consideration of possible permit revocation or additions/modification s of the Conditions of Approval. Prior to the submittal of such possible permit revocation or additions/modifications of the Conditions of Approval to the City Council, the Development Services Director may modify or add Conditions of Approval, subject to appeal to the City Council. 13. The Applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the Applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. T he City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 14. All approved insurance certificates are to be submitted no later than June 28, 2019. The Applicant shall provide and maintain appropriate insurance coverages as required by the City of Arcadia. The City of Arcadia, its officials, officers, and employees shall be covered as Additional Insureds. 15. The City reserves the right to make any and all necessary changes to the event scope, time, facilities, and other requirements and uses at its sole discretion. Should this result in additional City service requirements and costs, the City will notify and assess the Applicant. 16. The City reserves the right to revoke this permit at any time with or without cause. 17. All fees assessed to the Applicant are due and payable by the Applicant to the City within 30 days. 18. Approval of TUP 19-07 shall not take effect unless the Applicant has executed and filed with the City before June 28, 2019, an Acceptance Form available from the City Manager’s Office to indicate acceptance of the Conditions of Approval. Temporary Use Permit No. TUP 19-07 – Farmers’ Market June 4, 2019 Page 6 of 7 Findings Section 9273.1.20.2 of the Arcadia Municipal Code states that a Temporary Use Permit application is subject to the following four criteria: 1. That the site is adequate in size and shape to accommodate the proposed Temporary Use Event. Findings of Fact: The Arcadia Public Library parking lot is large enough to host an event of this size, provides reasonable access to public parking, and all parking is a short walk to the event. The ingress and egress points for vehicles and other traffic are not in conflict with the proposed layout of the use and sufficient barriers have been proposed to ensure the safety of all. 2. That the proposed Temporary Use or Event will not adversely interfere with existing uses on the subject property; and will not impede or adversely impact pedestrian access ways and/or vehicular circulation patterns. Findings of Fact: The Arcadia Public Library is closed on Sundays, and no additional uses are programmed at this location. Pedestrian access and vehicle patterns on the adjacent streets will not be impacted by the event. 3. That the Temporary Use or Event will not result in a significant adverse impact on any adjacent property. Findings of Fact: The only property potentially impacted by the event is the Arcadia Masonic Lodge. The Lodge has their own parking lot in the rear of their building. The Lodge is used as an event space from time to time , but sufficient parking is available in the surrounding parking lots to accommodate a dual use scenario. 4. That by requiring certain safeguards as conditions of approval, the proposed Temporary Use or Event will not be detrimental to the public health, safety and welfare. Findings of Fact: The Market will comply with all applicable health codes, and the set-up is subject to approval by the Fire Department, Police Department, and Development Services Department. Conditions of Approval have been proposed in order to protect the public health, safety, an d welfare and are incorporated herein by reference. Temporary Use Permit No. TUP 19-07 – Farmers’ Market June 4, 2019 Page 7 of 7 ENVIRONMENTAL IMPACT This project is Categorically Exempt from the California Environmental Qualit y Act (“CEQA”) under Section 15304(e) of the CEQA Guidelines as a temporary use of land having negligible or no permanent effects on the environment. A Preliminary Exemption Assessment is attached (Attachment “D”). FISCAL IMPACT The proposed Temporary Use Permit will have no significant fiscal impact on the City’s General Fund. Should additional services be required for production of the event, the Applicant will be charged for services determined by the City per the City’s adopted Fee Schedule. Vendors will be required to pay applicable business license fees and to collect and remit sales and use taxes. These revenues are expected to be nominal. RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit No. TUP 19 -07 to allow a Farmers’ Market at the Arcadia Public Library parking lot as a recurring event beginning on July 28, 2019.
