HomeMy WebLinkAboutDecision Letter June 5, 2019 Jerry & Staci Schilz 1751 Rodeo Road Arcadia, CA 91006 Subject: Healthy Protected Tree Removal No. TRH 19-03 Project Address: 1751 Rodeo Road Dear Mr. & Mrs. Schilz: The public comment period for the Notice of Pending Decision for the above mentioned application ended on June 4, 2019. Staff received one comment from a neighbor, which stated concern with the unpermitted pruning and objected to the permit to prevent further pruning from occurring. After consideration, the Development Services Department has approved the request to permit the unpermitted pruning of three Coast Live Oak trees. This approval is not for additional pruning at this time or removal of the existing Oak trees, but provides conditions of approval meant to encourage a healthy recovery of the trees. Therefore, the permit is warranted and subject to the following conditions: 1. The three Coast Live Oak trees shall be monitored until July 2019. At that point, a report from a certified arborist shall be submitted to provide an analysis of the trees’ conditions. The certified arborist shall complete a root crown excavation and inspection and provide further recommendations based on the findings for the preservation of the trees. 2. At the end of the monitoring period (July 2019), the Oak trees shall be evaluated by a certified arborist for restorative pruning. 3. The applicant shall install a three-inch layer of coarse, and diseased-free mulch to root zone of all Oak trees. 4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. Approval of TRH 19-03 shall not be of effect unless on or before 30 calendar days after approval of this project, the applicant/property owner has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. There is a 10 working-day appeal period from the date of the approval. Appeals must be submitted in writing to the Community Development Division with a $600.00 appeal fee by 5:30 p.m. on June 17, 2019. You will be notified if an appeal is filed. Approval of TRH 19-03 shall not be of effect unless the property owner and applicant have executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of these conditions of approval. The Acceptance form is due now and if it is not received by 5:30 pm, July 8, 2019, this approval will become null and void.
