TUP 19-19, WITH A CATEGORICAL EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT ("CEQA"), TO ALLOW THE PASADENA SHOWCASE FOR THE ARTS TO HOST THE 2020 PASADENA SHOWCASE HOUSE OF DESIGN EVENT FROM APRIL 26, 2020, TO MAY 17, 2020, AT 1220 RANCHO ROAD Recommendation: Approve SUMMARY Temporary Use Permit No. TUP 19-19 was filed by Ms. Jill Fosselman, the Benefit Chair for the 2020 Pasadena Showcase House of Design (“Event”), on behalf of the Pasadena Showcase for the Arts (“PSHA”). This is the third time PSHA will showcase a house in Arcadia, and the selected house for next year will be at 1220 Rancho Road. The event will take place from April 26, 2020, through May 17, 2020. The renovations to the house and grounds will occur from January through April 2020. It is recommended that the City Council approve TUP 19-19, subject to the Conditions of Approval listed in this staff report. BACKGROUND The Pasadena Showcase House of Design is one of the oldest, largest, and most successful home and garden tours in the nation. Each year, PSHA leases an estate of architectural significance in Pasadena or an adjacent community for its annual fundraiser, known as the Pasadena Showcase of Design. Since 1948, the PSHA has donated over $23 million dollars to provide music programs in the region, and proceeds from the Event will directly benefit music and art programs throughout Southern California. The Committee has selected an Arcadia home for their Showcase House in 2020. This will be the third time a house in Arcadia will be showcased, and the first house on Rancho Road. The last house in Arcadia to be showcased was a home on Hampton Road in 2013, which has been showcased twice. The selected home is a 6,700 square foot, two-story, Federal Country style home that was built in 1937 and is located on a 1.75 acre lot within Pasadena Showcase House of Design Event Temporary Use Permit No. TUP 19-19 October 15, 2019 Page 2 of 11 the Santa Anita Oaks Homeowners Association area. The property has a pool, a pool house, a sports court, and a playhouse at the very back of the property. The home is set back approximately 230 feet from the street, and is set behind an expansive front lawn with mature trees and a motor court, as shown in the image below. The site has approximately 14 mature oak trees, as well as other mature trees throughout the property. DISCUSSION The 2020 Pasadena Showcase will draw approximately 20,000-22,000 attendees (800- 1,200 per day) over the course of the event, which will take place from April 26, 2020, through May 17, 2020. Prior to the opening of the event, there is a designer walk-through planned on October 24, 2019, and two pre-tour events planned for November 5, 2019, and January 17, 2020. Because the proposed event is expected to draw approximately 800-1,200 attendees per day and will be held consecutively for 19 days, the application is subject to City Council review and approval. The Event will operate six days a week during the following hours: • Sunday, Tuesday, and Wednesdays: 12:00 p.m. – 8:00 p.m. • Thursday, Friday, and Saturdays: 11:00 a.m. – 10:00 p.m. • Monday: Closed to the public Pasadena Showcase House of Design Event Temporary Use Permit No. TUP 19-19 October 15, 2019 Page 3 of 11 Although the event is closed to the public on Mondays, the vendors will be there to restock and conduct maintenance work. The service hours for the caterers and trash service are from 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., Tuesday through Sunday. The 2020 event will have an “Eco-friendly/Sustainability” theme throughout the design process, including the use of environmentally friendly materials, the conversion of a garden bed into a sustainable edible garden utilizing greywater, use of a “cold kitchen” that results in food preparation off-site (less waste generated on-site), and the shuttle service will employ CNG-fueled vehicles. The shuttle service will be provided from Gate 5 of the Santa Anita Park parking lot, as no event parking is allowed in the neighborhood. This will be further discussed later in the staff report under the Parking section. The Showcase House, as shown below, also involves a complete renovation of the home and grounds by interior and exterior designers, and the work is carefully supervised by the Pasadena Showcase House of the Arts Benefit Committee. The renovations will occur from January 20, 2020, to April 25, 2020. A total of 18-25 designers will be selected. In November 2019, tickets will go on sale to the public. The tickets are sold in limited quantities at 15 minute intervals, 40 tickets every 15 minutes, and a maximum of 160 tickets per hour. The daily ticket sales usually range from 800 to 1,200. The average length that a guest may stay onsite is approximately three to four hours. There will be temporary portable toilets placed in two locations: the first will be set back on the motor court near the garage, and the second will be near the eastern edge of the property. They will be screened by existing trees and vegetation. The motor court location will house five (5) portable toilets (one toilet will be ADA accessible). In addition to the activities and food/beverage sales provided, there will be music performances either by soloists, trios, or quartets in the afternoons in the pub area (most likely acoustic), and larger performances that may or may not be amplified in the backyard on the stage in the afternoons. The afternoon performances would likely occur between 2:30-5:30 p.m. Then up to three Saturday evening concerts (by special tickets) will be held. Those concerts will be amplified and they will take place from 6:30-9:00 p.m. The stage sound system will be facing southeast, toward the flood control channel area at the rear of the property. Two security guards will be on-duty from 7:00 a.m. to 5:00 p.m., Monday through Saturday during the designer’s move-in phase. During the Event, there will be a minimum of 3 security guards from April 13, 2020, to May 17, 2020, working 24 hours a day, seven days a week. The site will be returned to its original condition by June 30, 2020. Pasadena Showcase House of Design Event Temporary Use Permit No. TUP 19-19 October 15, 2019 Page 4 of 11 The Shops, Restaurant, & Pub at the Showcase The Event will also include a marketplace with approximately 30 vendors that will be dispersed throughout the non-landscaped area at the eastern side of the property and along the grass that abuts the non-landscaped area – refer to the site plan provided as Attachment No. 1. Also, the existing groundcovers in the back wooded area will be cleared to accommodate tents for the vendors, drink carts, and bistro seating. There will also be a restaurant and dining areas on the sport court in the rear yard, and on the nearby grass area, as well as a platform built for the adjacent kitchen area. Additionally, a low platform-tent housing a small pub and dining area will be set up near the motor court and under the trees. The pub will offer beverages and pre-made snacks, as well as periodic non-amplified musical performances in the afternoons. Both the pub and restaurant will offer alcoholic beverages. Parking Parking will be provided in the north parking lot of the Racetrack, accessed from Colorado Place via Gate 5, as shown in the image to the right. The designers, workers, guests, visitors, and attendees will be shuttled to and from the property from Gate 5 of the Santa Anita Park parking lot since there is no event parking near the home – refer to Attachment No. 2. The parking and shuttle service will be complimentary and the guests will be transported in a mini shuttle bus that holds 20-24 passengers. There will be six shuttles in circulation. The parking attendants will greet the shuttle bus passengers both at the parking site at the racetrack and at the Showcase house. Included in the loop to the Showcase house will be a stop at the Metro Gold Line Station. The drop-off and pick-up at the Showcase house will be on Rancho Road at the driveway and the staging area for the shuttles will be in front of the property. No drop-offs (such as by Uber or Lyft) will be allowed, and the security guards will help enforce this. Furthermore, the applicant has coordinated with the Santa Anita Oaks Homeowners’ Association and the residents that attended the Community Meeting on September 5, 2019, and the PSHA agreed to place “No Parking” signs throughout the immediate area. Signs will be placed along Rancho Road (between Foothill Blvd. to Orange Grove Ave.), along Hacienda Drive (between Santa Anita Ave. to Baldwin Avenue), along Arbolada Drive (between Rancho Rd. to San Carlos Rd.), along Rodeo Road (Foothill Blvd. to Orange Grove Ave.), and along San Carlos Road (Arbolada Dr. to Orange Grove Ave.), as shown below and in Attachment No. 2. Residents in these areas will be given parking passes for their guests during the event, and the parking will be enforced by the Arcadia Police Department. The proposed Event has been reviewed by all the relevant City departments, and the following Conditions of Approval are recommended: 1. All construction, renovation, improvements, disassembly, and move-out shall be limited to the City’s standard construction hours, which are from 7:00 a.m. to 6:00 p.m., Monday through Friday, from 8:00 a.m. to 5:00 p.m. on Saturdays, with no construction allowed on Sundays and Holidays. The proposed schedule for the home tours shall be limited to the following hours: • Sunday, Tuesday, and Wednesdays: 12:00 p.m. – 8:00 p.m. • Thursday, Friday, and Saturdays: 11:00 a.m. – 10:00 p.m. • Monday: Closed to the public One hour of clean-up is permitted at the end of each day. 3. A permit and inspection is required by the Arcadia Fire Marshal or designee prior to the event, and the applicant shall provide the following at least one week prior to the event: A. The specifications of tents and any other assemblies that are to be provided for the event are to be available to inspection prior to the event. Generators, vehicles, tents, and other facilities used for cooking shall be situated as prescribed by the Fire Marshal or designee. B. Way-finding signage and adequate lighting for all exit paths shall be provided for the public as specified by the Arcadia Fire Marshal or designee. C. Emergency lighting shall be provided for all egress paths. D. A tent permit and inspection is required. E. An approved method of emergency lighting shall be provided for all common areas to a public way. 4. The Applicant shall provide notification to residents at least two weeks in advance before the “No Parking” signs are placed in the City’s right-of-way. The “No Parking” signs shall be maintained in the City’s right-of-way during the entirety of the Event. The signs shall not block fire hydrants or any driveway visibility areas per AMC Sec. 9283.8.9. Per the California Vehicle Code regulations, all posting must occur at least 24 hours prior to the start of the no parking period. The signs must indicate the dates and time the temporary “No Parking” is in effect. Additional streets may be added to the list below, subject to review and approval by the Planning & Community Development Administrator, or designee. The signs shall be placed on the following streets: • Rancho Road (Foothill Boulevard to Orange Grove Avenue) • Hacienda Drive (Santa Anita Avenue to Baldwin Avenue) • Arbolada Drive (Rancho Road to San Carlos Road) • Rodeo Road (Foothill Boulevard to Orange Grove Avenue) • San Carlos Road (Arbolada Dr. to Orange Grove Avenue) 5. All designers, workers, guests, visitors, and attendees shall be shuttled to and from the property from Gate 5 of the Santa Anita Park parking lot. The Applicant shall obtain a temporary alcoholic beverage license from the Department of Alcoholic Beverage Control and submit a copy of the license to the Planning Division by April 2, 2020. 7. The Applicant shall patrol the area outside of the property and the adjacent properties for litter at least twice per day. 8. A building permit is required for any improvements to the house and/or to any permanent structure(s). Any improvements to the grounds shall be subject to review and approval by the Planning & Community Development Administrator, or designee. Any permanent exterior improvement to the house is subject to approval by the Santa Anita Oaks Homeowners Association. 9. Any permanent work that is proposed under the dripline of an oak tree(s), or any removal of a protected tree, including a major limb, shall comply with the process listed in the City’s tree ordinance. Other maintenance work such as trimming and lacing does not require City’s approval, as long as the work meets the intent of the City’s tree ordinance. 10. All electrical installations, including generators, lighting, and audio equipment, shall obtain proper permits and are subject to approval by the City’s Building Official or designee. 11. Any signs or banners to be posted on the subject property that will be visible from the public right-of-way shall be subject to review and approval by the Development Services Director or designee. 12. Exterior lighting shall be reviewed and approved by the Development Services Director or designee prior to the beginning of the event. 13. The vendors and any related independent contractors shall obtain City business licenses as applicable from the City’s Business License Office prior to the events, and sales shall be reported to the State Board of Equalization as having occurred in the City of Arcadia. 14. The portable toilets and water sinks shall not be placed near any catch basins or any other drain inlets. The locations of the portable toilets and water sinks shall be subject to review and approval by the Public Works Services Director or designee. 15. Noncompliance with the plans, provisions, or Conditions of Approval for TUP 19-19 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing and/or cancellation of the event. 16. All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, emergency equipment, environmental regulation compliance, and parking and site design shall be complied with by the Pasadena Showcase House of Design Event Temporary Use Permit No. TUP 19-19 October 15, 2019 Page 8 of 11 Property Owner/Applicant to the satisfaction of the Building Official, City Engineer, Planning & Community Development Administrator, Fire Marshal, and Public Works Services Director, or their respective designees. The changes to the existing facility may be subject to building permits after having fully detailed plans submitted for plan check review and approval by the aforementioned City officials. 17. The Applicant/Property Owner shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the Applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 18. Approval of TUP 19-19 shall not take effect until the Applicant/Property Owner has executed and filed with the City on or before November 18, 2019, an Acceptance Form available from the Development Services Department to indicate acceptance of the conditions required by this approval. FINDINGS Pursuant to Development Code Section 9107.23.080, the Temporary Use Permit may be approved if all the following findings can be made. 1. The operation of the requested temporary use at the location proposed, within the time period specified, and subject to appropriate conditions will not jeopardize, endanger, or otherwise constitute a menace to the public convenience, health, safety, or general welfare. Facts in Support of the Finding: The Event will comply with all applicable health codes, and set-up is subject to approval by the City’s Fire Department, Police Department, and Development Services Department. The site will also be secured with on-duty security guards during the move-in phase, and then during the event until it is over. Conditions of Approval have been proposed in order to protect the public health, safety, and welfare. 2. The proposed site is adequate in size and shape to accommodate the temporary use without material detriment to the use and enjoyment of other properties located adjacent to and in the vicinity of the site. Pasadena Showcase House of Design Event Temporary Use Permit No. TUP 19-19 October 15, 2019 Page 9 of 11 Facts in Support of the Finding: The 1.75 acre property is large enough to host an event of this size, and all the guests will be shuttled to and from the Santa Anita Park parking lot. Most of the performances will be acoustic. The performances that will be amplified will end by 9:00 p.m. and the stage and sound system will be facing southeast, toward the flood control channel and the southern neighbor’s tennis court, which is in their rear yard area. The property is surrounded by mature landscaping (25-28’ wide to the north) to help buffer the noise. Therefore, the site is adequate in size and shape without being detrimental to the neighboring properties. 3. The proposed site is adequately served by streets or highways having sufficient width and improvements to accommodate the kind and quantity of traffic that the temporary use will or could reasonably be expected to generate. Facts in Support of the Finding: The subject property is a developed site on Rancho Road that is connected to Foothill Boulevard. To minimize traffic to the site, shuttle buses will be utilized. The street is adequate in width to accommodate the shuttles and traffic in the other direction, as well as any emergency services that may need to access the site. 4. Adequate temporary parking to accommodate vehicular traffic to be generated by the temporary use will be available either on-site or at alternate locations acceptable to the Director. Facts in Support of the Finding: Parking for the proposed Showcase event will be provided offsite in the parking area north of the Santa Anita racetrack, with guests shuttled to/from the project site via complimentary shuttles. The parking is accessed from Gate 5 from Colorado Place. The parking lot area provides approximately 6,000 parking spaces for all the event visitors. The parking provided will be more than adequate to accommodate the visitors to the event. 5. The location for the proposed temporary use would not adversely interfere with existing uses on the subject property, and would not impede or adversely impact pedestrian access ways and/or vehicular circulation patterns. Facts in Support of the Finding: The Event would not adversely interfere with the existing uses; in fact, the proposed improvements to accommodate the event will provide substantial enhancements to the property. The property also has a paved driveway along the side of the property to allow the catering trucks to access onto the property without creating any potential impacts to the circulation patterns. The applicant agrees in writing to comply with any and all of the conditions imposed by the Review Authority in the approval of the Temporary Use Permit. Facts in Support of the Finding: As required with all approvals and per Condition of Approval No. 17, the Applicant will be required to execute an Acceptance Form indicating acceptance of the Conditions of Approval required by this approval. ENVIRONMENTAL ANALYSIS This project is Categorically Exempt from the California Environmental Quality Act (“CEQA”) under Section 15304(e) of the CEQA Guidelines as a temporary use of land having negligible or no permanent effects on the environment. A Preliminary Exemption Assessment is attached (refer to Attachment No. 4). PUBLIC COMMENTS/NOTICE Notices were sent on September 26, 2019, to all the property owners within the Santa Anita Oaks Homeowner’s Association, and the notice was published in the Arcadia Weekly newspaper. During the notification period, staff received 14 letters supporting the event – refer to Attachment No. 3. FISCAL IMPACT The proposed event will not have a significant fiscal impact, but vendors participating in the event will be subject to business licensing, and the retail sales will be subject to sales tax, both positive benefits to the City. RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit No. TUP 19-19, with a categorical exemption from the California Environmental Quality Act (“CEQA”), per Section 15304(e), and approve the Pasadena Showcase for the Arts to host the 2020 Pasadena Showcase House of Design Event from April 26, 2020, to May 17, 2020, at 1220 Rancho Road, subject to the Conditions of Approval.
