C/O Pete Siberell 285 W. Huntington Drive Arcadia, CA 91007 SUBJECT: Temporary Use Permit No. TUP 18-21 PROJECT ADDRESS: 285 W. Huntington Drive Dear Mr. Siberell: At its June 18, 2019 meeting, the City Council voted (5-0) to conditionally approve Temporary Use Permit No. TUP 19-10 to allow a fireworks show at 285 W. Huntington Drive, subject to the following conditions of approval: 1. A fireworks inspection permit is required to be submitted by the applicant prior to the event. One additional standby engine from the Fire Department is required to be on site for four hours during the event, at the expense of the applicant. 2. The fireworks show shall not last for more than 10 minutes starting from 12:00AM on January 1, 2020. All fireworks activity shall cease by 12:20 AM. 3. Detailed information about the fireworks show will be provided to the City and mailed to residents within 1,000 feet of the site at least forty-five (45) days prior to the event to inform all parties of the timing and duration of the event. Based on comments received, the City reserves the right to hold another public hearing on this matter. 4. Noncompliance by the Applicant with any Arcadia Municipal Code provisions or conditions of approval for TUP 19-10 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing and/or cancellation of the event. 5. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period 285 W. Huntington Drive Temporary Use Permit No. TUP 19-10 Page 2 provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 6. Approval of TUP 19-10 shall not take effect until the applicant/property owner has executed and filed with the City on or before July 22, 2019, an Acceptance Form available from the Development Services Department to indicate acceptance of the conditions required by this approval. There is a ten (10) day appeal period for this application. To file an appeal, a completed Appeal Application form must be submitted to the Community Development Division along with a $600.00 appeal fee by 4:30 p.m. on June 28, 2018. You will be notified if an appeal is filed. Approval of Temporary Use Permit No. TUP 19-10 shall not go into effect unless the property owner and applicant have executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of these conditions of approval. The Acceptance form is due now and if it is not received by July 22, 2019, or if the project is appealed, this approval will become null and void.
