Wray, Deputy Director of Development Services/City Engineer By: Johnathan Doojphibulpol, Assistant Engineer SUBJECT: RESOLUTION NO. 7284 ACCEPTING A DEDICATION OF CERTAIN PROPERTY AT 601 SUNSET BOULEVARD ALONG THE MICHILLINDA AVENUE PROPERTY FRONTAGE AS PART OF PARCEL MAP 71885 FOR PUBLIC USE Recommendation: Adopt SUMMARY On February 12, 2019, the Arcadia Planning Commission tentatively approved Parcel Map 71885 subject to Conditions of Approval. The property included in the Parcel Map is an existing assisted living facility and a vacant commercial building with associated parking at 601 Sunset Boulevard and 618 Michillinda Avenue, respectively. The map shows a dedication of a variable width strip of land at the northwest corner along Michillinda Avenue adjacent to 601 Sunset Boulevard, proposed as Parcel 1 of Parcel Map 71885, which will be used for street and sidewalk purposes. Parcel Map 71885 is now ready for approval, and the dedication is offered on the map. In consideration of the developer’s offer of dedication, it is recommended that the City Council adopt Resolution No. 7284 accepting a dedication of certain property at 601 Sunset Boulevard along the Michillinda Avenue property frontage as part of Parcel Map 71885 for public use. BACKGROUND The Arcadia Planning Commission approved Tentative Parcel Map 71885 to subdivide one large lot bounded by Sunset Boulevard, Huntington Drive, and Michillinda Avenue, into two (2) parcels in compliance with the Commercial Land Use Designation of the General Plan. “Parcel 1”, known as 601 Sunset Boulevard, will continue as an assisted living residential use parcel, and “Parcel 2”, known as 618 Michillinda Avenue, will Resolution No.7284 re 601 Sunset Boulevard November 5, 2019 Page 2 of 2 continue for the time being as a vacant commercial development parcel. It should be noted, however, that the property at 618 Michillinda Avenue has been the subject of conceptual redevelopment proposals, which propose demolition of the existing commercial building, and replacement with residential units. This project has not been officially submitted, however. As a Condition of Approval of the map, a variable portion of Parcel 1, adjacent to Michillinda Avenue, is being dedicated to the City to properly align the right-of-way with the existing sidewalk. DISCUSSION The developer has submitted the final parcel map to the City for approval, offering the dedication, and has met all Conditions of Approval for the tentative map. Parcel maps do not require City Council approval in accordance with Section 9105.01.060 Table 5-1 of the Development Code. However, since this Parcel Map includes an offer of dedication, the City Council must either accept or reject the offer before the map can be approved. ENVIRONMENTAL ANALYSIS The proposed right-of-way dedication is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to Section 15301(c), because this action consists of a legal transfer of ownership, which will result in negligible or no expansion of use beyond the project analyzed in that certain Arcadia Planning Commission action of February 12, 2019. This action approved Planning Commission Resolution No. 2025, and Tentative Parcel Map Application No. 18-04 (71885), through a Categorical Exemption under CEQA for the subdivision of a 7.65 acre parcel into two lots located at 618 Michillinda Avenue and 601 Sunset Boulevard. FISCAL IMPACT There will be no measurable fiscal impact incurred by the City as a result of this dedication. The land has some minor value and will require ministerial maintenance to ensure it is useable by the public and not hazardous. RECOMMENDATION It is recommended that the City Council determines that this project is exempt under the California Environmental Quality Act, and adopt Resolution No. 7284, accepting a dedication of certain property at 601 Sunset Boulevard along the Michillinda Avenue property frontage as part of Parcel Map 71885 for public use.
