HomeMy WebLinkAboutItem 10h - 80 Unit Multi-Family Residential Unit Subdivision at 17 Las Tunas Drive DATE: November 19, 2019 TO: Honorable Mayor and City Council FROM: Jason Kruckeberg, Assistant City Manager/Development Services Director Lisa Flores, Planning & Community Development Administrator Prepared By: Vanessa Quiroz, Associate Planner SUBJECT: FINAL MAP NO. 77121 WITH AN ADOPTED MITIGATED NEGATIVE DECLARATION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (“CEQA”) FOR AN 80 UNIT MULTI-FAMILY RESIDENTIAL UNIT SUBDIVISION WITHIN AN APPROVED MIXED-USE DEVELOPMENT AND TERMINATION OF A COVENANT THAT PROHIBITS VEHICULAR ACCESS AND PARKING OVER CERTAIN AREAS OF THE PROPERTY AT 17 LAS TUNAS DRIVE Recommendation: Approve SUMMARY Tentative tract maps and final maps are required for all subdivisions that result in five or more parcels or condominium units. In accordance with Arcadia Development Code Section 9105.03.100, the City Council shall approve a final map if it conforms to all the requirements of the subdivision regulations of the Municipal Code and the State Subdivision Map Act. Final Map No. 77121 (Attachment No.1) meets these criteria. It is recommended that the City Council terminate the “Declaration of Covenant” (Attachment No. 2) that prohibits vehicular access and parking over certain areas of the property, and approve Final Map No. 77121 for an 80-unit multi-family residential condominium subdivision that was approved as part of the mixed-use development at 17 Las Tunas Drive. DISCUSSION Final Map No. 77121 is for the subdivision of 80 units for condominium purposes, including 77 multi-family residential units (two and three story buildings), three (3) live/work units with 2,487 square feet of commercial space, and two one-story commercial buildings totaling 8,500 square feet. The tentative map was conditionally approved by the Planning Commission on March 27, 2018, as part of the project. Per Final Map No. 77121 (17 Las Tunas Drive) November 19, 2019 Page 2 of 3 Development Code Section 9105.03.110, tentative maps are valid for 24 months after the effective date. The tentative map for this project will expire on April 7, 2020. The Final Map has been reviewed by the Los Angeles County Department of Public Works, and the appropriate City Departments – refer to Attachment No. 3 for the Letter of Compliance from Los Angeles County, dated August 21, 2019. The map has been found to be in substantial compliance with the Tentative Map as conditionally approved by the Planning Commission and is in compliance with the subdivision regulations of the City’s Development Code and the State Subdivision Map Act. The developer has also entered into an off-site improvement agreement and posted a performance bond for all required public improvements. Back when this site was developed in 1966, the Planning Commission required a covenant at the northwest corner of the site to prevent the property owner from creating a new driveway that would lead into the adjacent residential tracts. This is no longer needed since those residential tracts have since been developed with no access onto this site. Therefore, this covenant is no longer applicable and should be terminated in order to allow this land to be developed into the new mixed-use development approved by the Planning Commission last year. Typically, the termination of a covenant is handled administratively by City Staff and the property owner; however, since this covenant was initiated by the Planning Commission when the center was developed, the covenant has to be terminated by the City Council before the tract map can be approved. ENVIRONMENTAL ANALYSIS A Mitigated Negative Declaration (“MND”) was adopted by the Planning Commission on March 27, 2018, for the mixed-use development, which included a Planned Development and Tentative Parcel Map. No 77121, therefore, no further environmental review is required for this approval. FISCAL IMPACT There will be no fiscal impact incurred by the City as a result of this action. RECOMMENDATION It is recommended that the City Council terminate the “Declaration of Covenant” that prohibits vehicular access and parking over certain areas of the property and approve Final Map No. 77121 for an 80-unit multi-family residential unit subdivision within an approved mixed-use development at 17 Las Tunas Drive.
