Attn: Philip Chan 711 S. 1st Ave Arcadia, CA 91006 SUBJECT: Healthy Protected Tree Removal No. TRH 19-06 and Protected Tree Encroachment Permit No. TRE 19-26 PROJECT ADDRESS: 811 Monte Verde Drive Dear Chan: The public comment period for the Notice of Pending Decision for the above mentioned application ended on December 23, 2019. Staff did not receive any comments during the public comment period. After consideration, the Development Services Department has conditionally approved the request to a remove four (4) protected trees; two (2) Hollywood Juniper trees and two (2) Carolina Cherry trees located along the Westerly property line and the request to encroach upon the canopy of a protected , Norfolk Island Pine tree located in the front yard to accommodate the development of a new single-family home. The Hollywood Juniper trees and the Carolina Cherry trees are in declined and are hedge species that have overgrown with significant structural defects. The applicant and property owner shall be required to abide by the protected measures listed in the Arborist Report to preserve the long-term health of the Norfolk Island Pine tree. The design of the new house was approved by the Rancho Santa Anita Residents’ Association. The application is subject to the following conditions: 1. Prior to the issuance of a Certificate of Occupancy, a total of six (6) new trees shall be planted on the site with the locations to be determined by the Certified Arborist or the Landscape Architect and shall be shown on the final landscape plan submitted for Building Services plan check. The required trees shall be as followed: Five (5) 36”-box trees (Bottle Tree, Caribbean Copper Plant, Crape Myrtle, and two (2) Mexican Palo Verde) and one (1) 48” box California Sycamore. 2. The project shall be developed and maintained by the property owner/applicant in compliance with all of the recommended tree protection measure listed in the Arborist Report, dated December 2, 2019. 3. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia City of Arcadia Development Services Department Jason Kruckeberg Assistant City Manager/ Development Services Director 240 West Huntington Drive Post Office Box 60021 Arcadia, CA 91066-6021 (626) 574-5415 (626) 447-3309 Fax www.ArcadiaCA.gov concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or C ity Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 4. Approval of TRH 19-06 and TRE 19-26 shall not be of effect unless on or before 30 calendar days after approval of this project, the applicant/property owner has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. There is a ten (10) day appeal period for this application. To file an appeal, a completed Appeal Application form must be submitted to the Development Service Department along with a $600.00 appeal fee by 5:30 p.m. on Tuesday, January 7, 2019. You will be notified if an appeal is filed. City Hall will close at 12:30 PM on Tuesday, December 31, 2019 in observance of New Year’s Eve and will be closed on Wednesday, January 1, 2020 in observance of New Year’s Day. Approval of TRH 19-06 and TRE 19-26 shall not be of effect unless the property owner and applicant have executed and filed the enclosed Acceptance Fo rm to indicate awareness and acceptance of these conditions of approval. The Acceptance form is due now and if it is not received by January 26, 2020, this approval will become null and void.
