CALL TO ORDER – Mayor Verlato called the regular meeting to order at 7:05 p.m. 2. INVOCATION – Reverend Darwin Ng, Arcadia Police Department Chaplain 3. PLEDGE OF ALLEGIANCE – Arcadia Boy Scout Troop #125 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, and Verlato ABSENT: Tay and Chandler Council Member Beck made a motion, seconded by Council Member Amundson, to excuse Mayor Pro Tem Chandler and Council Member Tay from this meeting. 5. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto requested the City Council table Consent Calendar Item 11.e, to a future meeting because there were some documents that Caltrans had not yet approved, the City Council concurred. He noted that 5 emails were received after the agenda was posted from affected individuals relating to City Manager Item 12.a (the no-fault evictions Ordinance); and regarding Public Hearing Item 8.c (the Ordinances regarding the Accessory Dwelling Units) he noted a typographical error on Page 9, Section G, subsection 8 of the exhibits to the proposed Ordinance which were corrected and distributed to the City Council. 6. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Beck and seconded by Council Member Amundson to read all ordinances and resolutions by title only and waive the reading in full. 7. PRESENTATIONS a. Mayor’s Certificate of Commendation to Lisa Mussenden on her retirement from the City of Arcadia after 35½ years of service. 8. PUBLIC HEARING a. Ordinance No. 2366 amending Article VIII of the Arcadia Municipal Code relating to Building Regulations and adopting by reference the 2019 Edition of the California Building Code, Volumes 1 and 2, and Appendix J, the 2019 California Residential Code, the 2019 California Green Building Standards Code, the 2019 California Plumbing Code, the 2019 California Electrical Code, the 2019 California Mechanical Code, the 2019 California Existing Buildings Code, the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, and the Los Angeles County Grading Code with additions, amendments and deletions. 2 12-17-2019 Recommended Action: Adopt Building Official Fields provided the staff report. No member of the public appeared to speak on this item. A motion to close the public hearing was made by Council Member Beck, seconded by Council Member Amundson, and, seeing no objection, Mayor Verlato declared the public hearing closed. Ordinance No. 2367 amending Article III of the Arcadia Municipal Code relating to Fire Regulations and adopting by reference the 2019 Edition of the California Fire Code in its entirety, including Chapter 4, and Appendices B, C, D, K, and O based on the 2018 Edition of the International Fire Code published by the International Code Council together with certain additions insertions, deletions and changes thereto. Recommended Action: Adopt Fire Marshal Krikorian provided the staff report. No member of the public appeared to speak on this item. A motion to close the public hearing was made by Council Member Beck, seconded by Council Member Amundson, and, seeing no objection, Mayor Verlato declared the public hearing closed. It was moved by Council Member Beck, seconded by Council Member Amundson, and carried on a roll call vote to adopt Ordinance No. 2367 amending Article III of the Arcadia Municipal Code relating to Fire Regulations and adopting by reference the 2019 Edition of the California Fire Code in its entirety, including Chapter 4, and Appendices B, C, D, K, and O based on the 2018 Edition of the International Fire Code published by the International Code Council together with certain additions insertions, deletions and changes thereto. AYES: Beck, Amundson, and Verlato NOES: None ABSENT: Tay and Chandler c. Amendment to the Arcadia Development Code regarding Accessory Dwelling Units and Junior Accessory Dwelling Units. Urgency Ordinance No. 2369 amending various sections of the Arcadia Development Code related to Accessory Dwelling Units and Junior Accessory Dwelling Units and 3 12-17-2019 determining the Ordinance is categorically exempt under the California Environmental Quality Act (“CEQA”). Recommended Action: Adopt Planning and Community Development Administrator Flores presented the staff report. Derick Turpin, an Arcadia resident, appeared and indicated that he feels that once the word gets out that there will be more applications for ADU’s in the future. A motion to close the public hearing was made by Council Member Beck, seconded by Council Member Amundson, and, seeing no objection, Mayor Verlato declared the public hearing closed. It was moved by Council Member Beck, seconded by Council Member Amundson, and carried on a roll call vote to adopt all findings set forth in the staff report on Pages 4 and 5, and adopt Urgency Ordinance No. 2369 amending various sections of the Arcadia Development Code related to Accessory Dwelling Units and Junior Accessory Dwelling Units and determining the Ordinance is categorically exempt under the California Environmental Quality Act (“CEQA”). AYES: Beck, Amundson, and Verlato NOES: None ABSENT: Tay and Chandler Ordinance No. 2370 amending various sections of the Arcadia Development Code related to Accessory Dwelling Units and Junior Accessory Dwelling Units and determining the Ordinance is categorically exempt under the California Environmental Quality Act (“CEQA”). Recommended Action: Introduce It was moved by Council Member Beck, seconded by Council Member Amundson, and carried on a roll call vote to adopt all findings set forth in the staff report on Pages 4 and 5, and introduce Ordinance No. 2370 amending various sections of the Arcadia Development Code related to Accessory Dwelling Units and Junior Accessory Dwelling Units and determining the Ordinance is categorically exempt under the California Environmental Quality Act (“CEQA”). PUBLIC COMMENTS Rabbi Shalom Stiefel appeared and invited the City Council and staff to their Chanukah Gelt Drop on Thursday, December 26 at 5:30 p.m. at the Arcadia Transit Plaza, and the Chanukah at Westfield on Monday, December 23 from 5:30 p.m. – 7:00 p.m. at the Westfield Santa Anita Macy’s Lower Court. 10. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck wished Lisa Mussenden a happy retirement and wished everyone a Merry Christmas, Happy Holidays, and a Happy New Year; and indicated that a long time resident Tony Rossi passed away on December 8. 4 12-17-2019 Council Member Amundson also thanked Lisa Mussenden for her years of service and wished her well in her retirement; he commented on the new voting system presented at the last City Council meeting by the County and feels that there are new opportunities for voter fraud and that things are going to get worse; he noted some police activity in his neighborhood recently due to a stolen vehicle that the license plate reader picked up and commended the Police Chief and Police Department for all they do to keep Arcadia safe; and asked if there were funds or studies being done to place public restrooms for use by the homeless. In response to questions raised by Council Member Amundson, City Manager Lazzaretto indicated that he is not aware of any studies, but that staff is meeting with County Homeless Services and will be asking if providing those types of services will draw more people to the area than there already are. In response to City Manager Lazzaretto’s request, Assistant City Manager/Development Services Director responded that funds are already prescribed by the funding source, that there are matching funds from the City, but feels that adding restrooms may be a problem, since it is not a permanent structure. Council Member Amundson noted that he appreciates the City purchasing 10 natural gas powered transit buses; he spoke on the long term affect Sacramento has on local government; and he reminded everyone to cherish the time with family and friends, and wished everyone a Merry Christmas and looks forward to making 2020 even a greater year for the City of Arcadia. City Clerk Glasco also wished Lisa Mussenden well in her retirement; he announced the All Mail Ballot Election on April 14, 2020; and also wished everyone Happy Holidays and a prosperous New Year. Mayor Verlato announced the Santa Squad judging last week and awards presented for holiday decorated homes, and thanked Mary Buttice and Laena Shakarian of the City Manager’s Office for all their help in organizing this event; she announced the Holiday Fair in Downtown Arcadia last Saturday which attracted about 6,000-7,000 people; she also announced that last Friday was “Mahjong with the Mayor”, and the next “Mahjong with the Mayor” is January 18, 2020; that the next “Coffee with the Mayor” is January 8, 2020; and she wished everyone a Merry Christmas, Happy Holidays, and a Happy New Year. 11. CONSENT CALENDAR a. Regular Meeting Minutes of December 3, 2019. Recommended Action: Approve b. Resolution No. 7288 approving wage adjustments for unrepresented, non-benefited part-time employees in accordance with California’s minimum wage increase effective January 1, 2020. Recommended Action: Approve c. Supplemental budget appropriation in the amount of $34,685 from the General Fund Reserve; and a Professional Services Agreement with Wildan Financial Services for a Comprehensive User Fee Study and Full Cost Allocation Plan. Recommended Action: Approve 5 12-17-2019 d. Grant award from the U.S. Department of Homeland Security – State Homeland Security Assistance Program (“SHSP”) for reimbursement of portable handheld radio costs in the amount of $93,124. Recommended Action: Accept e. Contract with Three Peaks Corp. for the Arcadia Gold Line Station Pedestrian Linkage Improvements in the amount of $2,126,037.79, and an additional appropriation of $120,000 from Proposition A and C Reserve Funds. [item tabled indefinitely] Recommended Action: Approve f. Extension to the Professional Services Agreement with Mariposa Landscape, Inc. for Landscape Maintenance Services in the amount of $535,305.48. Recommended Action: Approve g. Purchase Order with Creative Bus Sales, Inc. for the purchase of 10 transit replacement vehicles under the Cal ACT Contract for Arcadia Transit in an amount not to exceed $1,280,116, and an additional appropriation of $340,116 from Federal Section 5307 and Proposition A Local Return Funds. Recommended Action: Approve h. Annual Development Impact Fee Report for Fiscal Year 2018-19 pursuant to Government Code Section 66006. Recommended Action: Approve Council Member Beck thanked the Chief of Police on receiving reimbursement from the State for the purchase of portable handheld radios in the amount of $93,000. It was moved by Council Member Beck, seconded by Council Member Amundson, and carried on a roll call vote to approve Consent Calendar Items 11.a through 11.d and 11.f through 11.h. AYES: Beck, Amundson, and Verlato NOES: None ABSENT: Tay and Chandler 12. CITY MANAGER a. Urgency Ordinance No. 2371 adding Chapter 9 to Article VI of the Arcadia Municipal Code to temporarily prohibit no-fault evictions through December 31, 2019, for residential real property built prior to January 1, 2005. Recommended Action: Adopt City Attorney Deitsch provided the staff report. Mayor Verlato called for public comments regarding this item. Carla Boggs, representing Senator Susan Rubio, appeared and read a statement from Senator Rubio regarding AB 1482, the Tenant Protection Act of 2019. The following Arcadia residents appeared and provided comments regarding this item, and urged the City Council to consider adopting Urgency Ordinance No. 2371 regarding the State’s new rent control regulations (AB 1482) which goes into effect on January 1, 2020: 6 12-17-2019 Tracy Li Langendoen Gary Langendoen Dong Bo Li, appeared through an interpreter Xiulian Liu (Sue Lin) At the request of City Manager Lazzaretto, Assistant City Manager/Development Services Director provided a status report on the Fano Street condominium project. Rosemary Skillman, property owner of apartment rentals in Arcadia, appeared and explained the reasons why she is opposed to Urgency Ordinance No. 2371, and feels the City Council should not adopt the Ordinance; and responded to questions raised by the City Council. Brian Abernathy, representing a local property management company, appeared and explained the reasons why he is opposed to the adoption of Urgency Ordinance No. 2371, and urged the City Council not to adopt Urgency Ordinance No. 2371; and responded to questions raised by the City Council. Michael A. Brennan, a landlord/tenant attorney in Arcadia, appeared and offered his services to the City regarding AB 1482; he spoke at length about AB 1482; and indicated that he represents the property owner of the Fano Street property; and responded to questions raised by the City Council. After discussion by the City Council, no motion or action was taken on Urgency Ordinance No. 2371. b. City Manager’s Office Reorganization, and new Classification Specifications for Deputy City Manager, Assistant City Clerk, Deputy City Clerk, and City Clerk Technician; Administrative Services Director Salary adjustment; creation of a new Management Aide position in the Administrative Services Department; and a supplemental budget appropriation in the amount of $36,160 for one-time construction and furniture costs. Recommended Action: Approve City Manager Lazzaretto provided the staff report. Successor Agency Resolution No. SA-17 approving and adopting the Recognized Obligation Payment Schedule (“ROPS”) for the period of July 1, 2020, through June 30, 2021, pursuant to Health and Safety Code Section 34177(m). 7 12-17-2019 Recommended Action: Adopt Senior Management Analyst Schwehr provided the staff report. It was moved by Council Member Amundson, seconded by Council Member Beck, and carried on a roll call vote to adopt Successor Agency Resolution No. SA-17 approving and adopting the Recognized Obligation Payment Schedule (“ROPS”) for the period of July 1, 2020, through June 30, 2021, pursuant to Health and Safety Code Section 34177(m).
