HomeMy WebLinkAbout12/03/2019 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, DECEMBER 3, 2019 1. CALL TO ORDER— Mayor Verlato called the regular meeting to order at 7:01 p.m. 2. INVOCATION — Reverend Jolene Cadenbach, Arcadia Congregational Church 3. PLEDGE OF ALLEGIANCE — Boy Scout Troop #111 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Beck, Tay, Chandler, and Verlato ABSENT: None 5. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto noted that the City Council was distributed a Code of Fair Campaign Practices Form regarding basic principles of campaign conduct in reference to City Manager Item 10(a). 6. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tern Chandler, and seconded by Council Member Tay to read all ordinances and resolutions by title only and waive the reading in full. 7. PUBLIC COMMENTS The following Arcadia residents appeared and urged the City Council to consider adopting an emergency moratorium to protect renters from eviction prior to the State's new rent control regulations going into effect on January 1, 2020. Dong Bo Li Tracy Li Langendoen Gary Langendoen In response to Mayor Verlato's inquiry, City Attorney Deitsch spoke about an ordinance with retroactivity, and whether it could apply to pending evictions; he noted that other cities have adopted such an ordinance, and that the City Council may call a Special Meeting in order to consider a moratorium or urgency ordinance. City Manager Lazzaretto explained the issues that may arise if the City Council adopts an urgency ordinance. In response to Council Member Beck's inquiry, City Manager Lazzaretto indicated that some cities have made it retroactive and some have not. City Attorney Deitsch stated that he is not aware of any lawsuits pending regarding retroactivity. 1 12-03-2019 City Manager Lazzaretto noted that residents who appeared before the City Council reside at 145 Fano Street; he indicated that the building has approvals going back to 2017 to convert into condominiums, and that tenants at this location will face this issue regardless of the new law going into effect. Mayor Verlato indicated she will consider helping, but stated that tenants should look to the state legislature that passed the law. Council Member Beck indicated that he is willing to place this matter on the December 17 agenda in order for City Attorney Deitsch to provide clarity regarding possible retroactivity. City Attorney Deitsch indicated that he would prepare a draft ordinance for consideration and provide advice regarding retroactivity. Mayor Verlato requested support from two other Council Members to add this item on the next agenda. Council Member Beck and Council Member Tay concurred. 8. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense(AB 1234]). Council Member Beck announced that December 5, is the Annual Christmas Tree Lighting event at the Arcadia Transit Plaza, that December 7, is the Holiday Snowiest and Breakfast with Santa at the Arcadia Community Center, and on December 12, the Chief's Holiday Breakfast will be held at the Arcadia Police Department. Council Member Amundson expressed his concerns regarding Assembly Bill 1482; he stated that there are petitions affecting Proposition 13, and warned everyone to be careful about what you sign; he announced that he is looking for a Friendship City in Taiwan, and welcomed the public to contact him with recommendations. Council Member Tay announced that several new business are opening in the City and provided the names of the businesses. At the request of Mayor Pro Tern Chandler, Acting Recreation and Community Services Director Cheung provided information about the new Beginning English Class offered through the Recreation and Community Services Department. Mayor Pro Tern Chandler spoke about the"Bagster Bag"Service provided by Waste Management to dispose hazardous waste such as paint and batteries; he thanked Mayor Verlato, on behalf of Tiger Cub Scout Pack 122, for having them lead the Pledge of Allegiance and presented her with a "Thank you" card from the pack. City Clerk Glasco read an article on "Keeping Your Horne Safe While on Vacation" from the Arcadia Hot Sheet, and reminded everyone about the VIP's program offered by the Arcadia Police Department, who will do vacation checks. Mayor Verlato announced that she hosted "Coffee with the Mayor," and the next"Coffee with the Mayor" is January 8, 2020; that December 5, is the Annual Christmas Tree Lighting event at the Arcadia Transit Plaza; on December 7, is the Holiday Snowiest and Breakfast with Santa at the Arcadia Community Center; and the Swazzle's Holiday Extravaganza at the Floretta K. Lauber Museum Education Center; she noted that Los Angeles County is placing another property tax on 2 12-03-2019 the November 2020 Ballot; she further announced that December 12, is the Holiday Decorations Awards, that December 13, is"Mahjong with the Mayor", and December 14, is the Annual Holiday Fair in Downtown Arcadia; and she requested support from two Council Members to add on a future agenda to consider contributing to the cost of an Anita Baldwin statue. Council Member Beck and Council Member Amundson concurred. 9. CONSENT CALENDAR a. Regular Meeting Minutes of November 19, 2019. Recommended Action: Approve b. Ordinance No. 2368 amending Article VII, Chapter 5 of the Arcadia Municipal Code concerning the Discontinuation of Residential Water Service for Nonpayment. Recommended Action: Adopt c. Resolutions relating to the General Municipal Election to be held on Tuesday, April 14, 2020. Resolution No. 7278 calling for the holding of an All-Mail Ballot General Municipal Election on Tuesday, April 14, 2020, for the election of Members of the City Council in Electoral Districts 1, and 4, and a City Clerk as required by the City Charter and Ordinance No. 2350. Recommended Action: Adopt Resolution No. 7279 requesting the Board of Supervisors of the County of Los Angeles to render full services to the City relating to the conduct of an All-Mail Ballot General Municipal Election to be held on Tuesday, April 14, 2020. Recommended Action: Approve Resolution No. 7280 adopting regulations for candidates for elective office pertaining to candidates statements submitted to the voters at an All-Mail Ballot General Municipal Election to be held on Tuesday, April 14, 2020. Recommended Action: Adopt d. Contract with BC Rentals LLC DBA Traffic Specialist for Street Striping and Pavement Marking Services in the amount of$119,802. Recommended Action: Approve e. Purchase of Computer Workstations and Laptops from Dell Computer Corporation in the amount of$76,000. Recommended Action: Approve f. Purchase of portable handheld and all-band mobile radios from Day Wireless Systems for the Police Department from the Equipment Replacement Fund in an amount not to exceed $117,000. Recommended Action: Waive the Formal Bid Process and Approve g. Grant award from the U.S. Department of Justice for reimbursement of costs related to Police Records Management System upgrades in an amount not to exceed $100,000. Workshop and presentation by the County of Los Angeles Registrar Recorder/County Clerk Office regarding L.A. County's Voting Solutions for All People ("VSAP") and the New Voter Experience, and integrity of voter processes. City Manager Lazzaretto provided the staff report. Phillip Verbera, Manager of Community Voter Outreach from the Los Angeles County Registrar Recorder/County Clerk's office provided a PowerPoint presentation regarding L.A. County's Voting Solutions for All People ("VSAP") and the New Voter Experience. A discussion ensued regarding elections integrity and ethics and no action was requested or taken. b. Setting City Water and Sewer Rates for Calendar Year 2020. Management Analyst Carmen Masud provided the staff report. Resolution No. 7286 setting City water rates and finding the rates will not exceed the estimated amount necessary to fund the operation of the City Water System for Calendar Year 2020. Recommended Action: Adopt It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on a roll call vote to adopt Resolution No. 7286 setting City water rates and finding the rates will not exceed the estimated amount necessary to fund the operation of the City Water System for Calendar Year 2020. Recommended Action: Adopt It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on a roll call vote to adopt Resolution No. 7287 setting City sewer rates and finding the rates will not exceed the estimated amount necessary to fund the operation of the City Sewer System for Calendar Year 2020. It was moved by Mayor Pro Tem Candler, seconded by Council Member Tay, and carried on a roll call vote to approve the hiring of a retired PERS Annuitant for Police Dispatcher Supervisor 960 Program.
