Subject: Healthy Protected Tree Removal No. TRH 20-02

Dear Mr. Wu:
The public comment period for the Notice of Pending Decision for the above
mentioned application ended on May 7, 2020. Staff did not receive any comments
during the comment period. After consideration, the Development Services
Department has approved the request to permit the unpermitted pruning of one
Engelmann Oak tree. This approval is not for additional pruning at this time or
removal of the existing Oak tree , but provides conditions of approval meant to
encourage a healthy recovery of the tree . Therefore, the permit is warranted and
subject to the following conditions:
1. The Engelmann Oak tree shall be monitored until May 2023. At that point,
a report from a certified arborist shall be submitted to provide an analysis
of the tree’s condition. The certified arborist shall complete a root to crown
excavation and inspection and provide further recommendations based on
the findings for the preservation of the tree.
2. At the end of the monitoring period (May 2023), the Oak tree shall be
evaluated by a certified arborist for restorative pruning.
3. The applicant shall follow all directions and recommendations provided in
the Tree Restoration Plan in the Arborist Report dated March 22, 2020.
4. The applicant shall provide an annual Arborist Report with photographs to
demonstrate the Oak tree’s restoration progress.
5. The applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officials, officers, employees, and agents from and against
any claim, action, or proceeding against the City of Arcadia, its officials,
officers, employees or agents to attack, set aside, void, or annul any
approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, in cluding but not limited to any approval
or conditional approval of the City Council, Planning Commission, or City
Staff, which action is brought within the time period provided for in
Government Code Section 66499.37 or other provision of law applicable to
this project or decision. The City shall promptly notify the applicant of any
claim, action, or proceeding concerning the project and/or land use
decision and the City shall cooperate fully in the defense of the matter. The
City reserves the right, at its own option, to choose its own attorney to
represent the City, its officials, officers, employees, and agents in the
defense of the matter.

6. Approval of TRH 20-02 shall not be of effect unless on or before 30 calendar days after
approval of this project, the applicant/property owner has executed and filed with the
Community Development Administrator or designee an Acceptance Form available from
the Development Services Department to indicate awareness and acceptance of these
conditions of approval.
There is a 10 working-day appeal period from the date of the approval. Appeals must be submitted
in writing to the Community Development Division with a $600.00 appeal fee by 5:30 p.m. on May
25, 2020. You will be notified if an appeal is filed.
Approval of TRH 20-02 shall not be of effect unless the property owner and applicant have
executed and filed the enclosed Acceptance Form to indicate awareness and acceptance of these
conditions of approval. The Acceptance form is due now and if it is not receiv ed by 5:30 pm, June
11, 2020, this approval will become null and void.
