SUBJECT: RESOLUTION NO. 7318 APPROVING PARCEL MAP NO. 71182, AND
ACCEPTING THE DEDICATION OF CERTAIN PROPERTY AT 2111-2125
CANYON ROAD FOR STREET RIGHT-OF-WAY, AND EASEMENTS FOR
DRAINAGE PURPOSES AS PART OF THE FINAL PARCEL MAP 71182
Recommendation: Adopt
SUMMARY
On February 23, 2010, the Arcadia Planning Commission approved Tentative Parcel Map
71182, located at 2111-2125 Canyon Road, subject to Conditions of Approval. The
proposed Parcel Map is to subdivide 94.46 acres of land into two buildable parcels
fronting on Canyon Road, with one of the parcels retaining most of the land.
Approximately 80 acres is designated and rezoned for open space.
The tentative map included a condition for the property owner to grant any easements
deemed necessary for utility and/or public maintenance activities, including updating the
easement for Santa Anita Canyon Road to accurately reflect the actual roadway
alignment.
Subsequent to the approval of TPM 09-08, the applicant informed the City that there was
no market for the lot configuration associated with the map. After two unsuccessful
alternative tentative parcel map applications, the applicant filed a lawsuit. The lawsuit
was resolved with a Settlement and Tolling Agreement that allowed the applicant to
pursue TPM 71182 with a revised lot development plan.
Parcel Map 71182 is now ready for approval and recordation. The property owner has
offered to dedicate additional road right-of-way for Santa Anita Canyon Road and
easements for drainage. In consideration of the landowners offer, it is recommended that
the City Council adopt Resolution No. 7318 with an Adopted Mitigated Negative
Declaration under the California Environmental Quality Act (“CEQA”) approving Parcel
Map No. 71182, and accept the dedication of street right-of-way and easements for
drainage purposes on the map.

BACKGROUND
On August 28, 2008, the Planning Commission approved Tentative Parcel Map No. TPM
07-05 (69775), requested by Nevis Homes, for a three-lot subdivision. Two of the parcels
were planned to be developed with new, single-family residences along Canyon Road,
and a third parcel (80.33 acres) was to remain undeveloped and be dedicated as open
space.
Following approval, the developer determined that this project was not financially feasible,
and subsequently submitted TPM 09-08 (71182) for a two-lot subdivision. This proposal
is for the same two buildable lots fronting Canyon Road, but it eliminates the open space
parcel and adds the land to the two parcels, mostly to one parcel. The property owners
would have the responsibility for the maintenance of the undeveloped hillside areas,
which is to be designated and rezoned for open space. On February 23, 2010, the
Planning Commission approved this revised proposal.
Subsequent to the approval of TPM 09-08 (71182), the applicant asserted that there was
no market for the lot configuration and development as approved in the TPM, which had
the building pads fronting on Canyon Road and back walls of the house built into the
hillside. Nevis Homes proceeded to file two different tentative maps for the property, in
2013 and 2016, each with different lot and development configurations. Both tentative
maps were denied by the City Council based on the determination that the proposals
would likely cause substantial environmental damage, or substantially and avoidably
injure fish or wildlife or their habitat. Further, the findings reasoned that the proposals
would injuriously affect the neighborhood because they would result in permanent
landform modifications that would be highly visible offsite and contribute to an
unavoidable adverse environmental impact.
Following the denial of the 2016 project, a lawsuit was filed by the applicant, Nevis Capital,
LLC. A subsequent Settlement and Tolling Agreement was reached between the two
parties in which Nevis Capital agreed to pursue the approved two-lot subdivision, but
modify the approved site design with a new crib wall system to allow the two homes to
have side and backyard areas rather than have the homes built directly into the hillside.
On July 18, 2019, the Development Services Department approved a time extension for
the map, extending the tentative approval period until September 20, 2020.
DISCUSSION
During the tentative map review, it was discovered that the portion of Santa Anita Canyon
Road that traverses the property does not follow the original 60-foot wide right-of-way
granted to the City. It was also discovered that portions of land outside the road right-of-
way are critical drainage paths, and access to those areas are necessary to protect the
roadway and manage drainage flow upstream and downstream of the roadway. The

tentative map approval included a condition to address the need for additional road right-
of-way and easements, as follows:
The applicant shall grant any easements deemed necessary by the City Engineer
and/or Public Works Services Director for utility and/or public maintenance activities,
including updating the easement for Santa Anita Canyon Road to accurately reflect
the actual roadway alignment.
Final Parcel Map No. 71182 includes a 120-foot wide public road dedication over the
original alignment, thus expanding the road right-of-way width by 60-feet for the entire
alignment. The map also includes dedication of two separate drainage easements for
road maintenance purposes. These revisions meet the condition of approval and satisfy
the requirements of the City Engineer. The Parcel Map is now ready for approval and
recordation.
ENVIRONMENTAL ANALYSIS
A Mitigated Negative Declaration under the California Environmental Quality Act
(“CEQA”) was previously adopted by the Planning Commission with the approval of
Tentative Parcel Map 71182, which included the proposed dedications, therefore, no
further environmental review is required for this approval.
FISCAL IMPACT
There will be no fiscal impact incurred by the City as a direct result of this action.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 7318 with a mitigated
negative Declaration under the California Environmental Quality Act (“CEQA”) approving
Parcel Map No. 71182, and accept the dedication of street right-of-way and easements
for drainage purposes on the map.
