CALL TO ORDER – Mayor Chandler called the regular meeting to order at 7:00 p.m. 2. INVOCATION – Secretary Riaz Khan, Mosque of San Gabriel 3. PLEDGE OF ALLEGIANCE – City Clerk Glasco 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Cheng, Verlato, Tay, and Chandler ABSENT: None 5. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that citizens who wish to submit public comments may do so by calling the conference line. 6. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Tay, and seconded by Council Member Cheng, to read all ordinances and resolutions by title only and waive the reading in full. 7. PUBLIC HEARING a. Resolutions relating to the adoption of the Fiscal Year 2020-21 Operating Budget and the Fiscal Years 2020-21 through 2024-25 Capital Improvement and Equipment Plan. City Manager Lazzaretto provided the staff report. Mayor Chandler opened the public hearing. City Manager Lazzaretto read into the record an email submitted for Public Hearing Item 7.a. Daniel Bump: Commented on the increase to the Arcadia Police Department budget; and the City’s commitment to the Homelessness Plan. A motion to close the public hearing was made by Council Member Verlato, seconded by Council Member Cheng, and seeing no objection, Mayor Chandler declared the public hearing closed. The City Council discussed the budget and concerns over the extent of impacts due to COVID- 19. It was the consensus of the City Council that quarterly financial reviews would be important. Resolution No. 7315 adopting a Budget for Fiscal Year 2020-21 and appropriating the amounts specified therein as expenditures from the funds. Recommended Action: Adopt 2 06-16-2020 It was moved by Council Member Verlato, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7315 adopting a Budget for Fiscal Year 2020-21, and appropriating the amounts specified therein as expenditures from the funds. AYES: Verlato, Tay, Beck, Cheng, and Chandler NOES: None ABSENT: None Resolution No. 7316 adopting a Capital Improvement and Equipment plan for Fiscal Years 2020-21 through 2024-25 Recommended Action: Adopt It was moved by Council Member Verlato, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7316 adopting a Capital Improvement and Equipment Plan for Fiscal Years 2020-21 through 2024-25. AYES: Verlato, Tay, Beck, Cheng, and Chandler NOES: None ABSENT: None b. Resolution No. 7310 confirming the Engineer’s Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the associated Assessment Diagram; and ordering the levy and collection of assessments for Fiscal Year 2020-21. Recommended Action: Adopt Senior Management Analyst Masud provided the staff report. Mayor Chandler opened the public hearing. No comments were received for Public Hearing Item 7.b. A motion to close the public hearing was made by Council Member Verlato, the City Council concurred, and seeing no objection, Mayor Chandler declared the public hearing closed. It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to adopt Resolution No. 7310 confirming the Engineer’s Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the associated Assessment Diagram; and ordering the levy and collection of assessments for Fiscal Year 2020-21; and find that this project is exempt under the California Environmental Quality Act (“CEQA”). AYES: Beck, Verlato, Cheng, Tay, and Chandler NOES: None ABSENT: None c. Resolution No. 7312 adopting “Vehicle Miles Traveled” thresholds of significance for purposes of analyzing transportation impacts under the California Environmental Quality Act (“CEQA”). Recommended Action: Adopt Deputy Director of Development Services/City Engineer Wray provided the staff report. 3 06-16-2020 Spencer Reeves, Associate at Fehr & Peers, presented the PowerPoint Presentation. Mayor Chandler opened the public hearing. Adam Wood, Administrator of the Building Industry Legal Defense Foundation, called and expressed his concerns regarding the impact the “Vehicle Miles Traveled” Policy will have on economic development; he commented on the preliminary injunction filed by social activists known as “The Two Hundred”; and urged the City Council to communicate with this group before deliberating on this matter. In response to Council Member Verlato’s request, City Manager Lazzaretto summarized Mr. Wood’s statements. Diana Coronado, Director of Government Affairs of the Building Industry Association of Southern California, called and requested that the City Council send a letter to Governor Newsom requesting an extension to the July 1 implementation deadline; she expressed her concerns regarding the impact COVID-19 is having on the transportation system; and commented on the litigation matter filed by the Two Hundred group. City Manager Lazzaretto read into the record an email submitted for Public Hearing Item 7.c. Jeff Montejano, CEO of the Building Industry Association of Southern California: asked that the City Council request that Governor Newsom extend the implementation date of Senate Bill 743. A motion to close the public hearing was made by Council Member Verlato, seconded by Council Member Cheng, and seeing no objection, Mayor Chandler declared the public hearing closed. In response to Mayor Chandler’s inquiry, City Manager Lazzaretto explained why a letter should not be sent to Governor Newson; and indicated that staff will write a letter if the City Council desires. It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to adopt Resolution No. 7312 adopting “Vehicle Miles Traveled” thresholds of significance for purposes of analyzing transportation impacts under the California Environmental Quality Act (“CEQA”); and find that the adoption of Resolution No. 7312 is exempt under the California Environmental Quality Act (“CEQA”). PUBLIC COMMENTS City Manager Lazzaretto announced that in accordance with Executive Order N-25-20, the Arcadia City Council will meet virtually; and that under the Brown Act, the City Council is prohibited from discussing or taking action on any item not listed on the posted agenda. Chris Hurley, an educator, called and expressed his disappointment with the City’s response to the murder of George Floyd; he spoke about the Black Lives Matter movement and rioting; he commented on the high presence of police officers during the protest that took place at Arcadia 4 06-16-2020 County park; and asked the City Council to address his questions related to the Black Lives Matter movement. City Manager Lazzaretto noted for the record that 11 emails were submitted for Public Comment from the following: John Perillo: Provided a list of questions from Cub Scouts pertaining to Homelessness, COVID- 19, and the Black Lives Matter protests. Edward Holguin: Urged the City Council to never consider defunding the Arcadia Police Department. Rebecca Rivera: Concerns regarding the effects of tobacco use, and the severe effects to smokers and vapers that encounter COVID-19. Irene (no last name provided): Requested that the City Council revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. Caroline Kino-Noji: Requested that the City Council revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. Clarence Dureg: Demands change in police officer training, defunding the police department, and more training to ensure there is no racism. Rosalind Bump: Urged the City Council to revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. Phoebe Shen: Urged the City Council to revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. Rhiannon Yee: Urged the City Council to revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. Debbie Bump: Urged the City Council to revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. Sara Noji: Requested that the City Council revise the Arcadia Police Department’s “Protect Arcadia 2020 Manual”. 9. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Cheng shared a story about his encounter with David Lu, a volunteer at the Arcadia Police Department; he commended the Police Department and the volunteers for their work; he thanked Council Member Verlato, Peter Amundson, and Donna Choi for focusing on Downtown Arcadia; he reminded everyone about the Arcadia Strong Campaign; he noted that the campaign supports the Chamber of Commerce; he announced that there is a meeting on Thursday, June 19, at 8:00 p.m., to contact the Chamber of Commerce for more information; and encouraged everyone to attend. Council Member Beck responded to comments made by the public; he indicated that the Arcadia Police Department policies are located on the City’s website; he noted that effective June 7, the 5 06-16-2020 use of the carotid control hold by the Arcadia Police Department was decertified and is no longer allowed; he responded to a comment made by a Boy Scout regarding the homeless problem in the City; he noted that the City does not have any authority over the Arcadia School District; that any inquiries regarding the school year should be directed to the School District; he commented on a medical study he read regarding COVID-19; he indicated that 35 to 40 percent of people with the virus are asymptomatic; he urged everyone to continue to be careful; and thanked safety and essential workers of the City for protecting and serving the citizens. Council Member Verlato announced that on Friday, June 12, the Los Angeles County released its numbers for the point-in-time homeless count; she reported on the homelessness problem in the San Gabriel Valley and Los Angeles County; she thanked all the speakers that commented on excessive force, the Black Lives Matter movement, and finding justice and equity; she indicated that she stands with those seeking justice and equality; however, she does not see a need to defund the Police Department; she reminded everyone that Eisenhower Park is scheduled to open July 6; she spoke about the Downtown Arcadia Improvement Association programs and events; she reminded everyone that the City of Arcadia does not allow fireworks; she wished everyone a Happy Father’s Day; and reminded everyone to stay safe and continue best practices. Mayor Pro Tem Tay commented on emails the City Council received regarding the Black Lives Matter movement; he noted that he responded to those emails; he shared an email he received regarding the Arcadia Police Manual; he indicated that it is difficult to work in Police and public safety fields; commented on the discussions that took place in his WeChat groups regarding defunding the Police Department; he expressed his appreciation to the Arcadia Police Department, the Fire Department, and first responders for their service. City Clerk Glasco wished everyone a Happy 4th of July. Mayor Chandler stated that he was pleased to hear the feedback from the entire City Council regarding the professionalism of the Arcadia Police Department; he indicated that the City demonstrates very strong leadership; and thanked the Police, Fire, and Public Works Services Departments for protecting and serving the residents. 10. APPOINTMENTS a. Appointments to City Boards and Commissions. Recommended Action: Make Appointments City Manager Lazzaretto presented the staff report and conducted the nomination process. It was the consensus of the City Council that the following be reappointed: Arcadia Beautiful Commission (2 positions) Barbara Lyle for reappointment to the Arcadia Beautiful Commission for a second four (4) year term ending June 30, 2024. Ethel Laczko for reappointment to the Arcadia Beautiful Commission for a second four (4) year term ending June 30, 2024. 6 06-16-2020 Arcadia Museum Commission (1 position open) Carlos Meza Jr. for reappointment to the Arcadia Museum Commission for a second four (4) year term ending June 30, 2024. Human Resources Commission (2 positions) Michael Rock for reappointment to the Human Resources Commission for a second four (4) year term ending June 30, 2024. Library Board of Trustees (1 position) Elizabeth Renfrew for reappointment to the Library Board of Trustees for a second four (4) year term ending June 30, 2020. Planning Commission (1 position) Deborah Lewis for reappointment to the Planning Commission for a second four (4) year term ending June 30, 2024. Recreation and Parks Commission (2 positions) - (1 position to fill an unexpired term ending June 30, 2023) Stephen Swinney for reappointment to the Recreation and Parks Commission for a second four (4) year term ending June 30, 2024. Senior Citizens’ Commission (2 At-Large positions and 2 Service Club Appointments) Senior Citizens’ Commission – At Large Position (2 positions) Donna Salter (filled unexpired term eligible for new term) for appointment to the Senior Citizens’ Commission At-Large Appointment for a two (2) year term ending June 30, 2022. Golden Age Club Appointment Based on the Golden Age Club letter of recommendation, the City Council appointed Nilo Salazar for a two (2) year term ending June 30, 2022. Assistance League Appointment Based on the Assistance League letter of recommendation, the City Council appointed Charlene Martinez for a two (2) year term ending June 30, 2022. Human Resource Commission (1 position) Regarding the Human Resources Commission, Council Member Tay nominated Lula Eskander for appointment. Seeing no other nominations, it was the consensus of the City Council that Lula Eskander be appointed to the Human Resources Commission for a four (4) year term ending June 30, 2024. 7 06-16-2020 Recreation and Parks Commission (1 full term position, 1 partial term position) Regarding the Recreation and Parks Commission, the City Council nominated the following: Council Member Verlato nominated Valerie Cheung and Yang Hsuan Lai for appointment, Council Member Beck concurred. Council Member Cheng nominated Valerie Cheung and Karen Yu for appointment, Mayor Pro Tem Tay and Mayor Chandler concurred. Seeing no other nominations, the City Council cast their votes as follows: Council Member Verlato – Valerie Cheung and Yang Hsuan Lai Council Member Beck – Valerie Cheung and Yang Hsuan Lai Council Member Cheng – Valerie Cheung and Karen Yu Mayor Pro Tem Tay – Valerie Cheung and Karen Yu Mayor Chandler – Valerie Cheung and Karen Yu As a result, Valerie Cheung was unanimously appointed to the Recreation and Parks Commission for a four (4) year term ending June 30, 2024; and by a majority vote Karen Yu was appointed to the Recreation and Parks Commission to fill an unexpired term ending June 30, 2023. Senior Citizens’ Commission – At-Large Position Regarding the Senior Citizens’ Commission – At-Large Position, Council Member Beck nominated Kathrynn Penny for appointment. Seeing no other nominations, it was the consensus of the City Council that Kathrynn Penny be appointed to the Senior Citizens’ Commission – At-Large Position for a two (2) year term ending June 30, 2022. 11. CONSENT CALENDAR a. Special and Regular Meeting Minutes of June 2, 2020. Recommended Action: Approve b. Resolution No. 7313 authorizing application for, and receipt of, California Department of Housing and Community Development (“HCD”) Local Early Action Planning (“LEAP”) Grant Program Funds. Recommended Action: Adopt c. Resolution No. 7314 establishing an Appropriation Limit for Fiscal Year 2020-21 pursuant to Article XIII-B of the California Constitution. Recommended Action: Adopt d. Resolution No. 7317 adopting a list of projects for Fiscal Year 2020-21 Funded by SB 1: The Road Repair and Accountability Act of 2017. Recommended Action: Adopt e. Resolution No. 7318 approving Parcel Map No. 71182, and accepting the dedication of certain property at 2111-2125 Canyon Road for street right-of-way, and easements for drainage purposes as part of the Final Parcel Map 71182. 8 06-16-2020 Recommended Action: Adopt f. A motion was made by Council Member Verlato, and seconded by Council Member Beck, and carried on a roll call vote to adopt Resolution No. 7306 setting service rates for the collection of residential refuse and recyclables pursuant to Section 5120.7 of the Arcadia Municipal Code; and find that the adoption of Resolution No. 7306 is exempt under the California Environmental Quality Act (“CEQA”). OPEN SESSION TO THE PUBLIC a. Proclamation of the City Manager of the City of Arcadia in his capacity as Emergency Services Director suspending certain land use requirements related to outdoor seating to provide flexibility for businesses during the local emergency and beyond. Recommended Action: Ratify Proclamation City Manager Lazzaretto presented the staff report. It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on a roll call vote to ratify proclamation of the City Manager of the City of Arcadia in his capacity as Emergency Services Director suspending certain land use requirements related to outdoor seating to provide flexibility for businesses during the local emergency and beyond. .
