Curian, Human Resources Administrator SUBJECT: RESOLUTIONS EXTENDING EXISTING MEMORANDA OF UNDERSTANDING WITH NO CHANGES TO EXISTING COMPENSATION AND RELATED BENEFITS FOR THE REPRESENTED EMPLOYEE GROUPS Recommendation: Adopt SUMMARY Resolution Nos. 7320, 7321, 7322, 7323, and 7328 extend the current terms of employment and compensation for City employees represented by the Arcadia Fire Fighters Association (“AFFA”), Arcadia City Employees Association (“ACEA”), Arcadia Public Works Employees Association (“APWEA”), Arcadia Police Officers Association (“APOA”), and the Arcadia Police Civilian Employees Association (“APCEA”). Understanding that there are ongoing economic uncertainties from COVID-19 with resulting budgetary constraints and future liabilities, the City received a formal request from the associations to extend the current terms and conditions of the existing Memoranda of Understanding for one-year with no increases to salary and benefits. It is recommended that the City Council adopt Resolution Nos. 7320, 7321, 7322, 7323, and 7328 extending existing compensation and benefits as outlined in the current Memoranda of Understanding (“MOU”) effective July 1, 2020, through June 30, 2021. DISCUSSION The labor agreements with the AFFA, ACEA, APWEA, APOA, and APCEA expired on June 30, 2020. Understanding the challenge in assessing the economic impact caused by the COVID-19 pandemic, on June 1 representatives of the AFFA association reached out to the City with a proposal to extend the existing terms and conditions of their current MOU. With the request from the AFFA, the City approached the ACEA, APCEA, APWEA, Adoption of Resolutions Extending Existing Memoranda for AFFA/ACEA/APWEA/APOA/APCEA July 21, 2020 Page 2 of 3 and APOA to determine if there was a similar interest among all the groups to extend the current contracts for one year. Recognizing the current climate of economic uncertainty, and that the City continues to assess and manage the possibility of further structural budget shortfalls due to COVID- 19, the respective negotiation members worked quickly with the City to reach a tentative agreement. By June 30, the City received formal notification from all the associations to accept the one-year extension for their respective groups. The attached resolutions presented for adoption reflect a continuation of the existing working terms and conditions. The proposed term of the agreement will be extended through June 30, 2021. Additionally, Executive Management, Management, City Council, and Unrepresented Confidential employees receive compensation and benefit adjustments through a City Council adopted resolution. Historically, these compensation and benefit adjustments are in concert with the other employee association agreements. Similar to the one-year extension for the employee association groups, current Fringe Benefits Resolution No. 7210 will remain in effect with no changes or amendments. ENVIRONMENTAL ANALYSIS The proposed action does not constitute a project under the California Environmental Quality Act (“CEQA”), and it can be seen with certainty that it will have no impact on the environment. Thus, this matter is exempt under CEQA. FISCAL IMPACT There are no additional fiscal impacts to extending the current agreements with the AFFA, ACEA, APWEA, APOA, and APCEA through June 30, 2021. RECOMMENDATION It is recommended that the City Council determine that this action does not constitute a project and is, therefore exempt, under the California Environmental Quality Act (“CEQA”); and adopt the following resolutions approving Memoranda of Understanding extending existing compensation and related benefits for the represented employee groups. 1) Resolution 7320, extending existing Memorandum of Understanding with no changes to existing compensation and related benefits for the Arcadia Fire Fighter’s Association (“AFFA”). Adoption of Resolutions Extending Existing Memoranda for AFFA/ACEA/APWEA/APOA/APCEA July 21, 2020 Page 3 of 3 2) Resolution No. 7321, extending existing Memorandum of Understanding with no changes to existing compensation and related benefits for the Arcadia City Employees Association (“ACEA”). 3) Resolution No. 7322, extending existing Memorandum of Understanding with no changes to existing compensation and related benefits for the Arcadia Public Works Employees Association (“APWEA”). 4) Resolution No. 7323, extending existing Memorandum of Understanding with no changes to existing compensation and related benefits for the Arcadia Police Civilian Employees Association (“APCEA”). 5) Resolution No. 7328, extending existing Memorandum of Understanding with no changes to existing compensation and related benefits for the Arcadia Police Officers Association (“APOA”).
