THOMAS CONSTRUCTION, INC. FOR THE LIVE OAK PLANT IMPROVEMENT PROJECT IN THE AMOUNT OF $309,160 Recommendation: Approve SUMMARY As part of the City’s Capital Improvement Program (“CIP”), the Public Works Services Department (“PWSD”) is preparing to complete improvements at the Live Oak Well Treatment Plant, including the construction of a perimeter wrought iron fence and gate, paving a section of road, and installation of a filter apparatus for the treatment facility onsite. To ensure the City is receiving the most competitive price and quality services for this work, the PWSD conducted a formal bid. Perry C. Thomas Construction, Inc. submitted the lowest responsive bid. It is recommended that the City Council approve, authorize, and direct the City Manager to execute a contract with Perry C. Thomas Construction, Inc. for the Live Oak Plant Improvement Project in the amount of $309,160, including a 10% contingency. BACKGROUND The City operates and maintains 11 groundwater wells, which produce an average of 16,500 acre-feet, or 5.4 billion gallons, of water to Arcadia customers each year. Regular maintenance of the City’s wells and water facilities is crucial to ensuring that all wells are operating efficiently, and water facilities are secure. As part of the City’s CIP, the PWSD is preparing to complete improvements to the Live Oak Well Treatment Plant to improve functionality and security of the water facility. The project includes the construction of a perimeter wrought iron fence and gate. The Live Oak Well Treatment Plant Improvement Project also includes paving the existing dirt surface to accommodate servicing of the water treatment vessels and the production well. Award Live Oak Plant Improvement Project July 21, 2020 Page 2 of 3 The project also entails installing a cartridge filter to extend the useful life of the granular activate carbon media inside the treatment vessels. This is comparable to installing a cartridge filter under a sink to help prevent sand or other unwanted particles from clogging up your faucet screens. To keep costs to a minimum and to reduce an anticipated long lead-time, the PWSD purchased a cartridge filter separately. The cost of the filter was $50,709.02 and will be installed under a separate contract. DISCUSSION A Notice Inviting Bids was published in the City’s adjudicated newspaper and bid packages were provided to contractors that perform this type of work. On June 2, 2020, the City Clerk received eight bids with the following results: Bidder Location Bid Amount___ Perry C. Thomas Construction, Inc. Monrovia, CA $ 309,160 Sea West Enterprises, Inc. Anaheim, CA $ 456,000 The bid documents were reviewed for content, and the contractor’s background was also investigated. Based on this review, it has been determined that Perry C. Thomas Construction, Inc. is the lowest responsive bidder and is qualified to complete the project as defined in the bid documents. Perry C. Thomas Construction, Inc. has successfully completed similar projects on time and within budget for the Cities of Pasadena and Vernon. The City has contracted with Perry C. Thomas Construction, Inc. for other projects in the past and has been satisfied with their service and work. ENVIRONMENTAL ANALYSIS This project is considered a Class 1 exemption as defined in Section 15301(b) & (d) of the California Environmental Quality Act (“CEQA”) since the project consists of the maintenance of existing public streets and restoration or rehabilitation of deteriorated or damaged facilities to meet current standards of public health and safety. This project is categorically exempt per the California Environmental Quality Act as an existing facility, Section 15301 of the CEQA guidelines. Award Live Oak Plant Improvement Project July 21, 2020 Page 3 of 3 FISCAL IMPACT Funds in the amount of $500,000 have been budgeted in the Fiscal Year 2019-20 Capital Improvement Program for the Live Oak Improvement Project. The total cost for the Live Oak Improvement Project is $309,160. With the request of 10% construction contingency, the project cost would be $340,076. Sufficient funds will remain in the budget for installation of the cartridge filter. RECOMMENDATION It is recommended that the City Council determine that this project qualifies as a Class 1 categorical exemption per Section 15301(b) & (d) of the California Environmental Quality Act (“CEQA”); and approve, authorize, and direct the City Manager to execute a contract with Perry C. Thomas Construction, Inc. for the Live Oak Plant Improvement Project in the amount of $309,160, including a 10% contingency. Attachments: Proposed Contract Exhibit “A” - Project Location Map Contract - 1 CONTRACT FOR THE CITY OF ARCADIA This CONTRACT, No. ________ is made and entered into this ____ day of _______, 2020, by and between City of Arcadia, sometimes hereinafter called “City,” and Perry C. Thomas Construction, Inc., sometimes hereinafter called “Contractor.” WITNESSETH: That the parties hereto have mutually covenanted and agreed, and by these presents do covenant and agree with each other as follows: A. SCOPE OF WORK. The Contractor shall perform all Work within the time stipulated in the Contract, and shall provide all labor, materials, equipment, tools, utility services, and transportation to complete all of the Work required in strict compliance with the Contract Documents as specified in Article 5, below, for the following Project: Live Oak Plant Improvement Project No. 72862720 The Contractor and its surety shall be liable to the City for any damages arising as a result of the Contractor’s failure to comply with this obligation. B. TIME FOR COMPLETION. Time is of the essence in the performance of the Work. The Work shall be commenced on the date stated in the City’s Notice to Proceed. The Contractor shall complete all Work required by the Contract Documents within 60 calendar days from the commencement date stated in the Notice to Proceed. By its signature hereunder, Contractor agrees the time for completion set forth above is adequate and reasonable to complete the Work. C. CONTRACT PRICE. The City shall pay to the Contractor as full compensation for the performance of the Contract, subject to any additions or deductions as provided in the Contract Documents, and including all applicable taxes and costs, the sum of Three Hundred Nine Thousand, One Hundred Sixty Dollars and No Cents, ($309,160.00). Payment shall be made as set forth in the General Conditions. D. LIQUIDATED DAMAGES. In accordance with Government Code section 53069.85, it is agreed that the Contractor will pay the City the sum set forth in Section 00 73 13, Article 1.11 for each and every calendar day of delay beyond the time prescribed in the Contract Documents for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. In the event this is not paid, the Contractor agrees the City may deduct that amount from any money due or that may become due the Contractor under the Contract. This Article does not exclude recovery of other damages specified in the Contract Documents. E. COMPONENT PARTS OF THE CONTRACT. All of the Contract Documents are intended to be complementary. Work required by one of the Contract Documents and not by others shall be done as if required by all. This Contract shall supersede any prior agreement of the parties. F. PROVISIONS REQUIRED BY LAW AND CONTRACTOR COMPLIANCE. Each and every provision of law required to be included in these Contract Documents shall be deemed to be included in these Contract Documents. The Contractor shall comply with all requirements of applicable federal, state and local laws, rules and regulations, including, but not limited to, the provisions of the California Labor Code and California Public Contract Code which are applicable to this Work. G. INDEMNIFICATION. Contractor shall provide indemnification and defense as set forth in the General Conditions. H. PREVAILING WAGES. Contractor shall be required to pay the prevailing rate of wages in accordance with the Labor Code which such rates shall be made available at the City’s Administrative Office or may be obtained online at dir.ca.gov and which must be posted at the job site.
