ARCADIA PLANNING COMMISSION
REGULAR MEETING MINUTES
TUESDAY, AUGUST 11, 2020
Any writings or documents provided to a majority of the Planning Commission regarding any item on this agenda will be made
available for public inspection in the City’s Planning Services Office located at 240 W. Huntington Drive, Arcadia, California,
during normal business hours.
CALL TO ORDER Chair Lewis called the meeting to order at 7:00 p.m. in the Council Chamber.
She also informed the public of a call-in number that was established for public
comments.

Planning & Community Development Administrator Lisa Flores had no supplemental information.
PUBLIC COMMENTS (5 minute time limit per person)
There were none.
PUBLIC HEARING
1. Resolution No. 2062 – Approving Multiple Family Architectural Design Review No. MFADR 20-
01, Tentative Tract Map No. TTM 20-01 (82953), and Protected Healthy Tree Removal Permit
No. TRH 20-03, with a Categorical Exemption under the California Environmental Quality Act
(CEQA) for an eight-unit multi-family residential condominium development at 416-428 Genoa
Street
Recommendation: Adopt Resolution No. 2062
Applicant: Chao Yin Tang, on behalf of the Property Owner, 416 – 428 Genoa Investment,
LLC.
Chair Lewis introduced the item and turned it over to Associate Planner Christine Song to present
the staff report.
Chair Lewis opened the public hearing and asked if the Applicant would like to speak on the item.
Rick Yeh responded.
Commissioner Chan asked if the replacement trees do not survive, who is responsible for their
replacement, and are their mechanisms in place for accountability should the LLC dissolve? He
suggested adding a condition of approval to the Resolution to ensure that the trees are replaced,
including holding other parties accountable such as a landscape architect, architect, or developer.

Ms. Flores stated that if the replacement trees do not survive construction, the
Owner/Applicant/Homeowners’ Association would be subject to the City’s Tree Preservation
regulations and permitting process which typically requires two (2), 24-inch box replacement trees
for every tree that is removed.
Assistant City Attorney Maurer expanded on the comments made by Ms. Flores and noted the
challenges with holding those without a nexus to the application accountable, such as a landscape
architect or architect, which may be considered unreasonable. Should the property owner fail to
adhere to the City’s Tree Preservation Ordinance and permitting process, then that would be
grounds for a code violation. There may be other options available, such as a bond, but that is
not a typical occurrence in cases such as this.
Vice Chair Wilander asked the Applicant if they would be open to 36-inch box replacement trees
as opposed to the currently proposed 24-inch trees.
Mr. Yeh agreed to the change.
Chair Lewis asked if there was anyone who would like to speak in favor of the item.
There were no callers in support of the item.
Chair Lewis asked if there was anyone who would like to speak in opposition of the item.
There were no calls received in opposition to the item.
MOTION- PUBLIC HEARING
It was moved by Vice Chair Wilander, seconded by Commissioner Chan to close the public
hearing. Without objection, the motion was approved.
DISCUSSION
Several favorable design features were noted by Commissioner Chan such as the enclosed toilet area
in the master bathroom, and the garages which exceed the Code minimum. He was in support of the
project.
Commissioner Lin was also in favor of the proposal, with the amendment to Condition No. 4 to require
36-inch box replacement trees as opposed to 24-inch box trees.
Commissioner Thompson stated that he was in favor of the amendment to increase the box of the
replacement trees and added that the facts to support the findings as listed in the staff report are well
written. Larger garages will help to increase marketability and functionality of the units.
Vice Chair Wilander was in favor; however, she suggested adding two (2) additional bicycle parking
spaces to the site plan (Amending Condition No. 5).
Chair Lewis moved to reopen the public hearing to enable the Applicant to respond to Vice
Chair Wilander’s request.
Mr. Yeh agreed to the addition of two (2) additional bicycle parking spaces.

MOTION- PUBLIC HEARING
It was moved by Vice Chair Wilander, seconded by Chair Lewis to close the public hearing.
Without objection, the motion was approved.
Following the discussion, Ms. Flores read the amended conditions of approval based upon the consensus
of the Commission:
Condition No. 4: Four (4) 36-inch box trees (comparable species as the trees being removed) shall
be planted as replacement trees. At least two 36-inch box trees shall be planted in the front yard
area. The remaining trees shall be at least 36-inch box trees and they shall be located where there
is adequate room for growth. The trees shall be shown on the final landscape plan that is submitted
to Building Services for plan check, subject to review by the Planning & Community Development
Administrator, or designee, to ensure compliance with this condition.
Condition No. 5: Four (4) bicycle parking spaces shall be provided.

It was moved by Commissioner Thompson, seconded by Commissioner Lin to adopt Resolution
No. 2062, as amended, approving Multiple Family Architectural Design Review No. MFADR 20-

4:30 p.m. on Friday, August 21, 2020.
2. Resolution No. 2063 – Approving Conditional Use Permit No. CUP 20-09 with a Categorical
Exemption under the California Environmental Quality Act (CEQA) to allow the sale of beer, wine,
and distilled spirits for off-site consumption and extended hours of operation for a new grocery
store (dba: Grocery Outlet) at 165 E. Foothill Blvd.
Recommendation: Adopt Resolution No. 2063
Applicant: Grocery Outlet
Chair Lewis introduced the item and turned it over to Ms. Song to present the staff report.
Commissioner Chan asked Ms. Song if Rite Aid (the current occupant) sells beer and wine?
Ms. Song responded and indicated that the City’s records do not show that a Conditional Use
Permit was issued to allow for the sell beer and wine at this location.

Commissioner Thompson noted the poor condition of the parking lot and asked Ms. Song if
parking lot asphalt improvements have been proposed. Additionally, it was observed that the
current occupant has beer, wine, and distilled spirits available for purchase at this location.
Ms. Song stated that parking lot asphalt improvements have not been proposed at this time;
however, a separate Architectural Design Review application was submitted for this location and
that request can be reviewed by Staff as a part of that proposal.
Chair Lewis opened the public hearing and asked if the Applicant would like to speak on the item.
Steve Rawlings and Pat Barber responded on behalf of Grocery Outlet. Mr. Rawlings also noted
that Rite Aid possesses an Alcoholic Beverage Control Type-21 alcohol license; the existing
license will be purchased by Grocery Outlet.
Commissioner Lin asked if the landlord is responsible for parking lot maintenance, and if so, has
the landlord been notified of the need for improvements.
Mr. Barber stated that certain improvements including reslurrying the parking lot, restriping the
parking spaces, and lighting upgrades are required of the landlord as a part of the Grocery Outlet
lease agreement prior to the store opening.
Commissioner Thomson inquired about truck delivery hours to which Mr. Barber stated that
delivery hours have yet to be determined and hours can vary; however, vendors typically service
shelves in the morning to prepare the stores for customers.
Commissioner Wilnder suggested that the Applicant consider adding language to the lease to
allow for parking lot maintenance. Mr. Barber noted that the lease requires maintenance to a
standard comparable to other shopping centers.
Chair Lewis asked if there was anyone who would like to speak in favor of the proposal.
There were no calls received in support of the proposal.

There were no calls received in opposition to the item.
Seeing that there are no other speakers, Chair Lewis closed the public hearing.

The Commission was unanimously in favor of the proposal.

3. Minutes of the July 14, 2020 Regular Meeting of the Planning Commission
Recommendation: Approve
It was moved by Vice Chair Wilander, seconded by Commissioner Thompson to approve the minutes of
the July 14, 2020 Planning Commission Regular Meeting.

MATTERS FROM CITY COUNCIL LIAISON
Council Liaison Cheng provided an update on Homeowners’ Association Appeal No. 20-01 which was
recently brought before the City Council. He discussed the results of the recent homeless count and
noted the increased number of homeless in Arcadia. He added that Methodist Hospital is in need of
Personal Protective Equipment (PPE) to address COVID-19 and donations would be appreciated.
MATTERS FROM THE PLANNING COMMISSONERS
Commissioner Chan requested that Staff review development projects to ensure that there are
mechanisms in place to ensure that replacement trees are planted and survive after construction.
MATTERS FROM ASSISTANT CITY ATTORNEY
Mr. Maurer provided an update on Senate Bill 902 related to residential housing development.
MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS
Ms. Flores announced that the Artis Senior Living project and the Huntington Plaza mixed use project
will be heard at the August 18, 2020 City Council meeting.
She also informed the Commission that an appeal was filed for the Conditional Use Permit for Grocery
Outlets on Live Oak Avenue, and this appeal is tentatively scheduled for the September 15, 2020 City
Council meeting. Currently, there are no items scheduled for the August 25, 2020 meeting, therefore it
will most likely be cancelled.

The Planning Commission adjourned the meeting at 7:55 p.m. to Tuesday, August 25, 2020 at 7:00 p.m.
in the City Council Chamber for the next virtual meeting.
