PC AM 20-01 WITH A CATEGORICAL EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FOR AN UPDATED PARKING PLAN AT THE ARCADIA HUB SHOPPING CENTER LOCATED AT 1201 TO 1325 S. BALDWIN AVENUE, and 733, 745 and 815 W. NAOMI AVENUE WHEREAS, on June 29, 2020, an application for Planning Commission Administrative Modification No. PC AM 20-01 was filed by the property owner, Baldwin Arcadia Center, LP ("Applicant') to approve an Updated Parking Plan at the Arcadia Hub Shopping Center ("Project') that will continue to allow uses to change over time at this Center through an administrative process based on the existing parking supply for a period of five years or until the 147 parking spaces have been used, whichever comes first; and WHEREAS, on November 16, 2020, Planning Services completed an environmental assessment for the Updated Parking Plan in accordance with the California Environmental Quality Act ("CEQA") and determined that the Project is exempt under CEQA Section 15061(b)(3) of the CEQA Guidelines (Review for Exemption) because the Project has no potential to cause a significant effect on the environment, and qualifies as a Class 3 Categorical Exemption under Section 15301 of the CEQA Guidelines pertaining to the use of an existing facility; and WHEREAS, on December 8, 2020, a duly noticed public hearing was held before the Planning Commission on said application, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY RESOLVES AS FOLLOWS: SECTION 1. The factual data submitted by the Community Development Division in the staff report dated December 8, 2020 are true and correct. SECTION 2. This Commission finds that based upon the entire record, pursuant to Section 9107.05.050 of the Development Code: 1. That the purpose of the Modification procedures is for the following: a. Secure an appropriate improvement of a lot; b. Prevent an unreasonable hardship; or c. Promote uniformity of development FACT: Approval of the Updated Parking Plan would continue to prevent an unreasonable hardship and it would secure an improvement to the Center by allowing the uses to change over time at the Center through the Updated Parking Plan that was originally approved by the Planning Commission in 2015. This process would allow the Applicant/Owner to use the Updated Parking Plan for another period of five years or until the 147 parking space supply has been used, whichever comes first. This would replace reviewing each use as a standalone use with its own parking rate as was the situation prior to the 2015 Parking Plan. The new applicable parking demand rate will be 2.12 spaces per 1,000 square feet of gross floor area as applied to all existing uses based on the demand, and the standard of having a reduced parking rate has not been detrimental to the planning and operation of the Center or with respect to the traffic flow at nearby intersections. It should be noted that the parking study for the Updated Parking Plan has shown the demand that is evaluated for future use changes is conservative and realistic. z Therefore, approval of the parking modification would secure an improvement to the Center by allowing the uses to continue changing over time in an efficient manner, and help continue to revitalize the Center with active and desirable uses. 2. This Project is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines pertaining to the use of an existing facility. SECTION 3. For the foregoing reasons the Planning Commission determines that the Project is Categorically Exempt per Class 3, Section 15301 of the California Environmental Quality Act (CEQA) Guidelines, and approves Planning Commission Administrative Modification No. PC AM 20-01 for the Updated Parking Plan located at 1201 to 1325 S. Baldwin Avenue, and 733, 745 and 815 W. Naomi Avenue, subject to the conditions of approval attached hereto. SECTION 4. The Secretary shall certify to the adoption of this Resolution.
