Wray, Deputy Director of Development Services/City Engineer By: Kevin Merrill, Principal Civil Engineer SUBJECT: CONTRACT WITH GRIGOLLA & SONS CONSTRUCTION COMPANY FOR THE HUNTINGTON DRIVE SIDEWALK AND CURB RAMP IMPROVEMENTS ALONG EASTBOUND HUNTINGTON DRIVE AND AROUND THE CITY HALL CAMPUS IN THE AMOUNT OF $163,346 INCLUDING A 10% CONTINGENCY, APPROPRIATE $100,000 FROM MEASURE M FUNDS TO REPLACE CAPITAL OUTLAY FUNDS ORIGINALLY BUDGETED, AND FIND THE PROJECT IS CATEGORICALLY EXEMPT FROM THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (“CEQA”) Recommendation: Approve SUMMARY As part of the Le Meridian hotel development on the previous Santa Anita Inn site, the developer is required to construct a sidewalk along the entire project frontage of Eastbound Huntington Drive. To complement that segment, the City proposed the Eastbound Huntington Drive Sidewalk Project in the 2018-19 Fiscal Year Capital Improvement Program for the west side of Eastbound Huntington Drive to connect the proposed sidewalk from the new development to Centennial Way. In 2020, improvement plans were prepared for the City’s project, and the project was combined with the City’s ADA Curb Ramp Improvement Project for ease of administration. The La Meridian Hotel project (Phase 1) is nearing completion and that portion of the sidewalk will be installed very soon. The City’s project was advertised for bids in February 2021. On March 2, 2021, 13 bids were received, with the low bid being from Grigolla & Sons Construction Company in the amount of $153,346 for the base bid and $10,000 for four additional curb ramps. This project was originally budgeted to come from Capital Outlay Reserve funds; however, staff has identified Measure M and other grant funds that can be utilized instead. Therefore, this item includes revising the funding source for the project. Contract with Grigolla & Sons Construction Company for Huntington Drive Sidewalk and Curb Ramp Improvements March 2, 2021 Page 2 of 5 It is recommended that the City Council award a contract for the Huntington Drive Sidewalk and Curb Ramp project to Grigolla & Sons Construction Company in the amount of $163,346 using Measure M funds and approve a 10% contingency. BACKGROUND The Le Meridian Hotel is the first phase of the “One Gallop Way” mixed-use project, and it is nearing completion. As a condition of approval for that project, the developer is required to install sidewalk on the west side of Eastbound Huntington Drive for the entire project frontage. The contractor has begun installing the on-site and public improvements and will be installing the sidewalk soon. The City Hall campus extends from the southwesterly property line of the Le Meridian site to Centennial Way (see Project Map included as Attachment A). Concurrent with the development project, the City initiated plans to install sidewalk along the west side of Eastbound Huntington Drive from Centennial Way to the north end of the soccer field, ultimately connecting with the Hotel’s segment. The Eastbound Huntington Drive Sidewalk project was proposed in the 2018-19 Fiscal Year Capital Improvement Program at a cost of $100,000. In January 2020, the City contracted with Kreuzer Consulting Group (“KCG”) to design the sidewalk plans and investigate the feasibility of relocating the bus stop on eastbound Huntington Drive from next to the Police Station to in front of City Hall. KCG prepared conceptual plans for alternative bus stop locations, and those plans were shared with representatives from both LA Metro and Foothill Transit. Upon their review, both agencies responded that the alternative locations were problematic for them and they were not in favor of changes. At that point, the relocation efforts were terminated and KCG focused on the sidewalk improvements only. Concurrently with the sidewalk design, plans were developed for the latest sidewalk and ADA ramp project. The scope of this project is to replace non-ADA compliant ramps on Huntington Drive and Centennial Way around the City Hall campus. These two projects have been combined into one project for bidding and administration purposes. The scope of the project is as follows: • Installation of approximately 1,100 lineal feet of new sidewalk on the west side of Eastbound Huntington Drive from Centennial Way to the northeast corner of the soccer field • Removal and replacement of curbs and gutters, as necessary • Installation of ADA accessible ramps at all driveways and street corners around the City Hall Campus • Relocation of conflicting utilities • Installation of 4 additional ADA accessible ramps at the driveway and street corners on the south side of Centennial Way Contract with Grigolla & Sons Construction Company for Huntington Drive Sidewalk and Curb Ramp Improvements March 2, 2021 Page 3 of 5 The plans and specifications were completed in January with an engineer’s estimate for the project of $150,000. DISCUSSION The Huntington Drive Sidewalk and Curb Ramp Improvement Project was advertised for bids in February 2021. INC. 267,775.00 MINAKO AMERICA CORPORATION 275,525.00 Grigolla & Sons Construction Company is a qualified, licensed contractor, and has satisfactorily completed several projects for the City in the past. The most recent project completed in the City was the Arcadia Veterans War Memorial with connecting sidewalk located in the Arcadia Park along the south side of Huntington Drive. Through Grigolla & Sons Construction Company’s successful bidding experience with the City, they have proven that their costs are competitive and reasonable in this bidding environment. The bids included alternate bid items for consideration in the event the base bids were below the budget. Since the bid results were favorable, 4 additional curb ramps are recommended for inclusion into the contract. In addition, a 10% contingency is requested for additional funding authority when evaluating potential additions or changes. ENVIRONMENTAL ANALYSIS This project is categorically exempt per section 15301(c) of the California Environmental Quality Act, which pertains to existing facilities such as streets, sidewalks, ramps, and gutters. Contract with Grigolla & Sons Construction Company for Huntington Drive Sidewalk and Curb Ramp Improvements March 2, 2021 Page 4 of 5 FISCAL IMPACT The Eastbound Huntington Drive Sidewalk project was budgeted in the 2018-19 Fiscal Year Capital Improvement Program at $100,000 in Capital Outlay funds. These improvements are also eligible for Measure M funding, but the funding was not available when the project was initially budgeted. Sufficient Measure M funding is now available to use in place of the Capital Outlay funds, allowing those funds to be used on other important projects. The recommendation for this project includes replacing the Capital Outlay funds with Measure M funds. Also included in this project are the ADA Curb Ramp improvements budgeted in the 2019-20 and 2020-21 Fiscal Years with State Transportation Development Act (TDA) Article 3 funds. Some funds have previously been spent, but the remaining funding for the overall project are summarized below. No General Fund dollars are proposed to be used for this project. RECOMMENDATION It is recommended that the City Council find that the project is categorically exempt pursuant to Section 15301 Class 1(c) from the requirements of the California Environmental Quality Act (“CEQA”), and approve, authorize, and direct the City Manager to execute a Contract with Grigolla & Sons Construction Company for the Huntington Drive Sidewalk and Curb Ramp improvements along the west side of eastbound Huntington Drive and around the City Hall campus in the amount of $163,346, including a 10% contingency, using Measure M and TDA3 funds. The City shall pay to the Contractor as full compensation for the performance of the Contract, subject to any additions or deductions as provided in the Contract Documents, and including all applicable taxes and costs, the sum of ____________________________________________________________________ Dollars ($_________________________________). Payment shall be made as set forth in the General Conditions. c. LIQUIDATED DAMAGES. In accordance with Government Code section 53069.85, it is agreed that the Contractor will pay the City the sum set forth in Section 00 73 13, Article 1.11 for each and every calendar day of delay beyond the time prescribed in the Contract Documents for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. All of the Contract Documents are intended to be complementary. Work required by one of the Contract Documents and not by others shall be done as if required by all. This Contract shall supersede any prior agreement of the parties. e. PROVISIONS REQUIRED BY LAW AND CONTRACTOR COMPLIANCE. Each and every provision of law required to be included in these Contract Documents shall be deemed to be included in these Contract Documents. The Contractor shall comply with all requirements of applicable federal, state and local laws, rules and regulations, including, but not limited to, the provisions of the California Labor Code and California Public Contract Code which are applicable to this Work. f. INDEMNIFICATION. Contractor shall provide indemnification and defense as set forth in the General Conditions. g. PREVAILING WAGES. Contractor shall be required to pay the prevailing rate of wages in accordance with the Labor Code which such rates shall be made available at the City’s Administrative Office or may be obtained online at http://www.dir.ca.gov and which must be posted at the job site.
