TUESDAY, APRIL 6, 2021
CALL TO ORDER— Mayor Chandler called the Closed Session to order at 6:03 p.m.
ROLL CALL OF CITY COUNCIL MEMBERS
PRESENT: Beck, Cheng, Verlato, Tay, and Chandler
ABSENT: None
PUBLIC COMMENTS — No public comments were received.
CLOSED SESSION
a. Pursuant to Government Code Section 54956.9 (d)(1) to confer with legal counsel
regarding the matter of Gouji Huamei Tuanti, A California Nonprofit Mutual Benefit
Corporation v. City of Arcadia, Los Angeles County Superior Court (Case No.
21 STCP00690).
b. Pursuant to Government Code Section 54956.9 (d)(1) to confer with legal counsel
regarding the matter of the City of Arcadia vs. The Dow Chemical Company; Dow
Agrosciences LLC; Shell Oil Company, et al., United States District Court, Central
District (Case No. 2:18-cv-10139).
The City Council recessed the Closed Session to conduct the Regular Meeting at 7:00 p.m. The
City Council reconvened the Closed Session at 9:42 p.m.
c. Pursuant to Government Code Section 54956.9 (d)(1) to confer with legal counsel
regarding the matter of Arcadians for Environmental Preservation v. City of Arcadia,
Los Angeles County Superior Court (Case No. 20STCP02902).
No reportable action was taken on the Closed Session Items.
The Closed Session ended at 10:12 p.m.
Regular Meeting
City Council Chamber, 7:00 p.m.
1. CALL TO ORDER— Mayor Chandler called the regular meeting to order at 7:03 p.m.

5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS
City Attorney Deitsch announced that prior to the regular meeting the City Council met in a Closed
Session to consider the items listed on the posted agenda; he indicated that no reportable action
was taken on Closed Session Item a; he stated that the City Council recessed to the Regular
Meeting and will reconvene to Closed Session after the Regular Meeting; that the City Council
also recessed the Special Meeting and will reconvene it as well following the completion of the
Closed Session listed under the Regular Meeting agenda; and that no reportable action is
expected.
6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA
ITEMS
City Manager Lazzaretto had no supplemental information.
7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND
WAIVE THE READING IN FULL
A motion was made by Council Member Beck to read all ordinances and resolutions by title only
and waive the reading in full to which the City Council concurred.
8. PRESENTATIONS
a. Presentation of Donate Life Month Proclamation to One Legacy.
9. PUBLIC COMMENTS
Mark McGrail called in support of the Arcadia Par 3 Gold Course.
Susan Guo called and asked the City Council to address hate crimes against Asians and
requested that law enforcement host a workshop explaining to residents how to address any
crimes that may occur in their neighborhoods.
City Manager Lazzaretto read into the record an email submitted for Public Comment by Kirk
Olsen expressing his concerns regarding Text Amendment No. TA-20-01 relating to the size of
signs advertising properties for sale or lease.
10. STATE OF THE CITY ADDRESS
Mayor Chandler and City Manager Lazzaretto presented the State of the City Address.
11. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from
the City Council related to meetings attended at City expense(AB 1234]).
City Clerk Glasco congratulated newly-appointed Chief of Police Nakamura and wished him the
best of luck.
Council Member Verlato stated that she does not condone the current anti-Asian hate crimes
occurring throughout the United States; she thanked the Arcadia Police Officer's Association and
Recreation and Community Services Director Somogyi for their hard work relocating the City's
unhoused community; she announced that on April 2, she took a tour of the "Tiny Homes" in
Redondo Beach; that on April 7, she is participating in the San Gabriel Valley Council of

Governments' Homeless Committee meeting, and that on Thursday, April 8, is the Downtown
Arcadia Improvement Association Board meeting. She thanked Mayor Chandler for the State of
the City Address; and commended the Mayor for virtually navigating the City Council meetings.
Council Member Beck thanked the Arcadia Police Foundation for their donation to the Arcadia
Police Department for the Police K9 Program; he thanked Assistant City Manager/Development
Services Director Kruckeberg and City Manager Lazzaretto for their work on the Le Meridian Hotel
project; he stated that he is opposed to any hate action against Asians; he commented on the
newly-renovated Eisenhower Park; he noted that he agrees with Mr. Olsen's comment regarding
the size of real estate signs; and he addressed Mr. McGrail's comments regarding the Arcadia
Par 3 Golf Course.
Council Member Cheng shared a story about an emotional moment during an Arcadia Unified
School Board event; he shared a story about an encounter he had with an individual while visiting
his father's grave; he encouraged everyone to continue working together; and asked those
interested in giving back to their community to contact him.
Mayor Pro Tern Tay stated that this has been a challenging year; he commended Mayor Chandler
for an amazing job conducting virtual City Council meetings; he commented on the "Tiny Homes"
and on the hate crimes against Asians; and he indicated that the City Council works together
towards helping the community.
Mayor Chandler thanked City Manager Lazzaretto for all his hard work and for delivering the State
of the City Address; he provided some history about the former"Dive Bar" at the current location
of Le Meridien Hotel; and he expressed his appreciation for Mr. McGrail's comments regarding
the Arcadia Par 3 Golf Course.
12. CONSENT CALENDAR
a. Special and Regular Meeting Minutes of March 16, 2021, and Special Meeting Minutes
of March 22, 2021.
Recommended Action: Approve
b. Ordinance No. 2375 adopting Text Amendment No. TA 20-01 amending various
sections of the City's Development Code and the Tree Preservation Ordinance with a
categorical exemption under the California Environmental Quality Act ("CEQA").
Recommended Action: Adopt
c. Ordinance No. 2378 establishing a temporary limit on the Commission Fees charged
by third-party food delivery applications on businesses in Arcadia.
Recommended Action: Adopt
d. Donation in the amount of$22,800 from the Arcadia Police Foundation for the Arcadia
Police Department's Police Service Dog (K-9) Program.
Recommendation: Accept
e. Extension to the Professional Services Agreement with Phoenix Group Information
Systems for Parking Citation, Parking Permit, and Administrative Citation Processing
in an amount not to exceed $53,300.
Recommended Action: Approve
Mayor Chandler pulled Consent Calendar Item 12.b. for separate discussion.

It was moved by Council Member Verlato, seconded by Council Member Cheng, and carried on
a roll call vote to approve Consent Calendar Items 12.a., and 12.c. through 12.e.

At the request of Mayor Chandler, City Manager Lazzaretto explained that Ordinance No. 7325
is not increasing the size of real estate signs from 4 square feet to 6 square feet, he stated that
there is an error in the City's Development Code; and that the Ordinance will correct that error
listing the correct size as the City Council originally intended it, which is 6 square feet.
A motion was made by Mayor Chandler, seconded by Council Member Cheng, and carried on a
roll call vote to adopt Ordinance No. 2375 adopting Text Amendment No. TA 20-01 amending
various sections of the City's Development Code and the Tree Preservation Ordinance with a
categorical exemption under the California Environmental Quality Act ("CEQA").

13. CITY MANAGER
a. Ordinance No. 2376 amending Section 1902 of Article I, Chapter 9, of the Arcadia
Municipal Code increasing settlement authority of City Manager ($25,000).
Recommended Action: Introduce
City Manager Lazzaretto presented the Staff Report.
A motion was made by Council Member Beck, seconded by Council Member Cheng, and carried
on a roll call vote to introduce Ordinance No. 2376 amending Section 1902 of Article I, Chapter
9, of the Arcadia Municipal Code increasing settlement authority of City Manager ($25,000).

b. Second Amendment to the Residential Refuse and Recycling Agreement with Waste
Management ("WM") and proposed Refuse Rates Schedule for Fiscal Year 2021-22
through 2025-26.
Recommended Action: Approve the Agreement and direct staff to follow Proposition
218 Balloting procedures and set a Public Hearing for June 15, 2021.
Public Works Services Director Tait presented the Staff Report.
After City Council discussion, a motion was made by Council Member Cheng, seconded by Mayor
Chandler, and carried on a roll call vote to approve the Second Amendment to the Residential
Refuse and Recycling Agreement with Waste Management and proposed Refuse Rates
Schedule for Fiscal Year 2021-22 through 2025-26; direct staff to follow Proposition 218 Balloting
procedures and set a Public Hearing for June 15, 2021; establishing a 3% franchise fee and

confirming with Waste Management that the City will remain in the bottom 1/3 of fees exclusive
of the 3% franchise fee.

c. Report, discussion, and direction regarding COVID-19.
City Manager Lazzaretto provided an update on COVID-19. No action was requested or taken.
The City Council recessed to Closed Session at 9:42 p.m. to complete the items on that part of
the agenda.

The City Council meeting adjourned at 10:12 p.m. to Tuesday, April 20, 2021, 6:00 p.m.
