HomeMy WebLinkAboutItem 11a - Special Meeting Minutes of May 17, 2021, and Regular Meeting Minutes of May 18, 2021 ARCADIA CITY COUNCIL SPECIAL MEETING MINUTES MONDAY, MAY 17, 2021 CALL TO ORDER – Mayor Tay called the Special Meeting to order at 3:02 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Cheng, and Tay ABSENT: None PUBLIC COMMENTS – No public comments were received. STUDY SESSION (OPEN TO THE PUBLIC) a. Report, discussion, and direction regarding the proposed Operating Budget for Fiscal Years 2021-23, and Proposed Capital Improvement and Equipment Plan for Fiscal Years 2021-26. City Manager Lazzaretto presented an overview of the proposed Operating Budget for Fiscal Years 2021-23, and proposed Capital Improvement and Equipment Plan for Fiscal Years 2021- 26. Discussion ensued and staff responded to various questions, comments, and suggestions on the Proposed Budget. After City Council discussion, it was moved by Council Member Chandler, seconded by Mayor Pro Tem Cheng, and carried on roll call vote directing staff to prepare the necessary resolutions for City Council consideration at the June 15 meeting relating to the adoption of the Operating Budget for Fiscal Years 2021-23, and Capital Improvement and Equipment Plan for Fiscal Years 2021-26. AYES: Chandler, Cheng, Verlato, Cheng, and Tay NOES: None ABSENT: None At 4:29 p.m., the Mayor recessed the Special Meeting to the Council Conference Room for Closed Session. The City Council reconvened at 4:30 p.m. CLOSED SESSION a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: City Manager Dominic Lazzaretto, Assistant City Manager/Development Services Director Jason Kruckeberg, and Administrative Services Director Hue Quach. Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers’ Association, Arcadia Firefighters’ Association, and unrepresented employees: Department Heads, Division Managers, Supervisors, and part-time employees. No reportable action was taken on the Closed Session Item. The Special Meeting ended at 6:32 p.m. Linda Rodriguez Assistant City Clerk 1 05-18-2021 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, MAY 18, 2021 CALL TO ORDER – Mayor Tay called the Study Session to order at 6:02 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Cheng, and Tay ABSENT: None PUBLIC COMMENTS – No public comments were received. STUDY SESSION a. Newcastle Park Renovation Preliminary Design. Recommended Action: Approve Public Works Services Director Tait provided the staff report and PowerPoint presentation. After City Council discussion, a motion was made by Mayor Pro Tem Cheng, seconded by Council Member Verlato, and carried on a roll call vote to approve Option 1: Go out to bid for a design/build proposal with a guaranteed maximum price of $3.7 Million and negotiate with the low bidder prior to award of contract beginning 90 days from May 18, with the option of staff electing to place a Request for Proposal at a later date. AYES: Cheng, Verlato, Beck, Chandler, and Tay NOES: None ABSENT: None CLOSED SESSION a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Manager Lazzaretto stated that no discussion is necessary regarding Closed Session Item a.; therefore, the City Council removed the item from the agenda. The City Council recessed at 6:40 p.m. to the Regular City Council Meeting at 7:00 p.m. 2 05-18-2021 Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the Regular Meeting to order at 7:00 p.m. 2. INVOCATION – Pastor Terrence Shay, First Chinese Baptist Church of Walnut/Arcadia Resident 3. PLEDGE OF ALLEGIANCE – City Clerk Glasco 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Cheng and Tay ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that prior to the Regular Meeting the City Council convened in a Study Session to consider the Newcastle Park Renovation Preliminary Design; he stated that on motion by Mayor Pro Tem Cheng, seconded by Council Member Verlato, the City Council unanimously voted to approve the preliminary design, and authorized and directed Staff to proceed with a design/build bid with a budget of $3.7 million subject to certain options; he indicated that Closed Session Item a. was removed from the posted agenda. Mayor Tay commented on the Tiny Shelter Project and requested City Council support to place an item on the June 1 City Council Meeting Agenda in order to halt the study for the Tiny Shelters Project at this time. Council Member Beck also requested an agenda item to consider establishing a citizens committee to address homelessness in the City and that the committee should provide a report within 60 days. After some clarification discussion, City Manager Lazzaretto confirmed that he would place an item on the June 1 City Council Meeting Agenda that would allow for consideration of both proposals. The City Council concurred. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that citizens who wished to submit public comments may do so by calling the conference line. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler and seconded by Mayor Pro Tem Cheng to read all ordinances and resolutions by title only and waive the reading in full. 8. PUBLIC COMMENTS Mayor Tay announced that, due to the high-volume of calls and emails, public comments will be limited to 90 minutes. Angie Gren called and stated that in order to receive funding for the Tiny Shelter Project there must be collaboration between San Gabriel Valley cities. Sharee Johnson, Community Coordinator of the Arcadia Breathe Free Coalition, called and expressed her concerns regarding the health risks of secondhand smoke, and requested that the City Council adopt a smoke-free outdoor policy. Antonia Anfiteatro submitted an email that provided questions related to the Tiny Shelter Project. Boyd Zumwalt submitted an email that inquired if the City Council is attempting to build houses for the homeless in Arcadia. Robert Foley submitted an email that urged Council Member Beck to apologize for his behavior during the protest at his home. Sharee Johnson, member of the Arcadia Breathe Free Coalition, submitted an email that expressed her concerns regarding the health risks associated with exposure to second-hand smoke, and requested City Council support in enforcing smoke-free outdoor dining Rebecca Rivera, member of the Arcadia Breathe Free Coalition, submitted an email that expressed her concerns regarding the health risks associated with second-hand smoke, and requested that the City Council adopt a smoke-free outdoor policy. King Shum submitted an email stating that he was oopposed to raising the rates for Solid Waste services. 6 05-18-2021 9. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Mayor Pro Tem Cheng thanked everyone for their patience during Public Comments; he shared the story about King Solomon and reminded everyone that no matter what side we are on we share a common goal to end homelessness; he commented on the Homelessness Community Forum and commended staff for their hard work with the homelessness issue; and stated that he hopes everyone can come together as a community to make Arcadia better. Council Member Beck responded to comments made regarding the Tiny Shelter Project; he clarified that the Tiny Shelter Project will be funded by grant money, and that no decision has been made on the matter; he noted that the George Gascón matter is on the Agenda and that he will comment on that matter during that section of the Agenda; he stated that he is heartened by the number of people involved in the City’s current issues; and encouraged the community to continue staying involved. Council Member Chandler commended Mayor Pro Tem Cheng for his comments; he noted that he would comment on the George Gascón matter during that portion of the Agenda; he commented on the criminal justice system; and he requested that City Manager Lazzaretto address the Boise, Idaho homeless camping case. In response to Council Member Chandler’s request, City Manager Lazzaretto provided a brief explanation regarding the Court of Appeals’ ruling on Martin v. Boise. Council Member Chandler expressed the importance of civil rights; he stated that it is imperative for this community to abide by the court’s decision; and commended the Arcadia Police Department for the arrest of two catalytic converter thieves. Council Member Verlato expressed her views regarding the Tiny Shelter Project; she indicated that she remains transparent on the matter through social media; she shared photos of a homeless encampment at Second Avenue and Colorado; she spoke about her experience over the weekend with protesters at her home and at the City Council Chambers; she indicated that her goal is to make the community safer; she stated that the shortage of available shelters and low-income housing also needs to be addressed; and hopes that everyone can come together to find a solution to address homelessness. City Clerk Glasco announced that Memorial Day is on Monday, May 31; he also announced that Saturday, May 29 the Vietnam Veterans’ Memorial Monument at Arcadia County Park will be decorated with U.S. flags; and encouraged everyone to participate. Mayor Tay stated that the City Council listens to the community; he reminded everyone that that the Tiny Shelter matter will be added to the June 1 City Council Meeting Agenda; and encouraged everyone to visit the City’s website for current City information. City Manager Lazzaretto provided the email address for those interested in the Tiny Homes Project and encouraged everyone to visit the City’s website for more information. 7 05-18-2021 10. CONSENT CALENDAR a. Regular Meeting Minutes of May 4, 2021, and Special Meeting Minutes of May 6, 2021. Recommended Action: Approve b. Professional Services Agreement with Pasadena Humane Society & SPCA for Animal Control Services in an amount not to exceed $1,689,664. Recommended Action: Approve c. Purchase Order with Haaker Equipment Company for the purchase of one 2022 CNG Vactor Sewer Jet Rodder Truck in the amount of $533,458.95. Recommended Action: Approve It was moved by Council Member Chandler, seconded by Council Member Verlato, and carried on a roll call vote to approve Consent Calendar Items 10.a. through 10.c. Resolutions authorizing the City to become a member of the California Community Housing Agency and the California Statewide Communities Development Authority Community Improvement Authority; and authorizing the City Manager to enter into Public Benefit Agreements in support of their issuance of tax-exempt bonds to create or preserve middle-income rental housing in Arcadia. Resolution No. 7358 authorizing the City to become a member of the California Community Housing Agency (“CALCHA”) and authorizing the City Manager to enter into Public Benefit Agreements with CALCHA in support of their issuance of tax- exempt bonds to create or preserve middle-income rental housing in Arcadia. Recommended Action: Adopt Resolution No. 7359 authorizing the City to become a member of the California Statewide Communities Development Authority Community Improvement Authority (“CSCDA-CIA”) and authorizing the City Manager to adopt enter into Public Benefit Agreements with CSCDA-CIA in support of their issuance of tax-exempt bonds to create or preserve middle-income rental housing in Arcadia. Recommended Action: Adopt Management Analyst Schwehr presented the Staff Report. A substitute motion was made by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and carried on roll call vote to adopt Resolution No. 7365 declaring and affirming a Vote of No Confidence in Los Angeles District Attorney George Gascón.
