CLOSED SESSION a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: City Manager Dominic Lazzaretto, Assistant City Manager/Development Services Director Jason Kruckeberg, and Administrative Services Director Hue Quach. Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers’ Association, Arcadia Firefighters’ Association, and unrepresented employees: Department Heads, Division Managers, Supervisors, and part-time employees. b. Pursuant to Government Code Section 54956.9(d)(4) to confer with legal counsel regarding potential litigation – one (1) case No reportable action was taken on the Closed Session Items. The Closed Session ended at 6:53 p.m. Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the Regular Meeting to order at 7:01 p.m. 2. INVOCATION – Pastor Eva Thai-Erwin, Church of the Good Shepherd United Methodist Church 3. PLEDGE OF ALLEGIANCE – City Clerk Glasco 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Cheng and Tay ABSENT: None 2 06-15-2021 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that prior to the Regular Meeting the City Council met in a Closed Session to consider the two items listed on the posted agenda and stated that no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that regarding Public Hearing Item 10.a, there was in error on page 150 of Exhibit “B”; that a revised page was distributed to the City Council; and provided an explanation of the error. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. The City Council concurred. Mayor Tay announced that tonight’s meeting will adjourn in memory of former Mayor Gail Marshall’s husband Burton Marshall. Council Member Chandler provided his eulogy. 8. PRESENTATIONS a. Presentation of the Spring Home Awards by the Arcadia Beautiful Commission. b. Presentation of Mayor’s Certificates to the Arcadia High School Co-Ed Badminton Team in recognition of their outstanding season. c. Presentation by the Friends of the Gilb Museum of Arcadia Heritage of a monetary gift to the City of Arcadia for the Gilb Museum of Arcadia Heritage. 9. APPOINTMENTS a. Appointments to City Boards and Commissions. Recommended Action: Make Appointments City Manager Lazzaretto presented the staff report and conducted the nomination process. Arcadia Beautiful Commission (3 positions) It was the consensus of the City Council that the following be reappointed: Burton Brink for reappointment to the Arcadia Beautiful Commission for a second four (4) year term ending June 30, 2025. Robert Miller for reappointment to the Arcadia Beautiful Commission for a second four (4) year term ending June 30, 2025. Sheryl Hunter for reappointment to the Arcadia Beautiful Commission for a second four (4) year term ending June 30, 2025. 3 06-15-2021 Human Resources Commission (1 position) Regarding the Human Resources Commission, the City Council nominated the following: Council Member Beck nominated Tina Rodriguez. Council Member Verlato nominated Huong McMahon. Council Member Chandler nominated Robert Bolster. Mayor Pro Tem Cheng nominated Jeffrey Brockmeier and Michael Cao. Mayor Tay nominated Robert Bolster. Seeing no other nominations, the City Council cast their votes as follows: Council Member Beck – first choice Tina Rodriguez, and second choice Huong McMahon Council Member Verlato – first choice Huong McMahon, and second choice Tina Rodriguez Council Member Chandler – first choice Robert Bolster, and second choice Tina Rodriguez Council Member Cheng – first choice Jeffrey Brockmeier, and second Tina Rodriguez Mayor Pro Tem Tay – Tina Rodriguez As a result, Tina Rodriguez was appointed to the Human Resources Commission for a four (4) year term ending June 30, 2025. Library Board (1 position) Regarding the Library Board of Trustees, Council Member Beck nominated R. Carlton Seaver for appointment. Seeing no other nominations, it was the consensus of the City Council that R. Carlton Seaver be appointed to the Library Board for a four (4) year term ending June 30, 2025. Senior Citizens’ Commission (1 At-Large position) Regarding the Senior Citizens’ Commission, Council Member Beck nominated Michael Cao for appointment. Seeing no other nominations, it was the consensus of the City Council that Michael Cao be appointed to the Senior Citizens’ Commission for a two (2) year term ending June 30, 2023. Traveler’s Club Appointment (1 position) Based on the Traveler’s Club letter of recommendation, it was the consensus of the City Council that Marilyn Mazone be reappointed to the Senior Citizens’ Commission, Traveler’s Club, for a two (2) year term ending June 30, 2023. Arcadia Senior Friendship Club Appointment (1 position) Based on the Arcadia Senior Friendship Club letter of recommendation, it was the consensus of the City Council that Margaret Swope be appointed to the Senior Citizens’ Commission, Arcadia Senior Friendship Club, for a two (2) year term ending June 30, 2023. 4 06-15-2021 10. PUBLIC HEARING a. Resolutions relating to the adoption of the Fiscal Year 2021-22 Operating Budget and the Fiscal Years 2021-22 through 2025-26 Capital Improvement and Equipment Plan. City Manager Lazzaretto presented the staff report. Mayor Tay opened the public hearing. No comments were received for Public Hearing Item 10.a. A motion to close the public hearing was made by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and seeing no objection, Mayor Tay declared the public hearing closed. Resolution No. 7372 adopting a Budget for Fiscal Year 2021-22 and appropriating the amounts specified therein as expenditures from various funds. Recommended Action: Adopt It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to adopt Resolution No. 7372 adopting a Budget for Fiscal Year 2021-22, and appropriating the amounts specified therein as expenditures from various funds. AYES: Beck, Verlato, Chandler, Cheng, and Tay NOES: None ABSENT: None Resolution No. 7373 adopting a Capital Improvement and Equipment plan for Fiscal Years 2021-22 through 2025-26 Recommended Action: Adopt It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to adopt Resolution No. 7373 adopting a Capital Improvement and Equipment plan for Fiscal Years 2021-22 through 2025-26. AYES: Beck, Verlato, Chandler, Cheng, and Tay NOES: None ABSENT: None b. Resolution No. 7363 confirming the Engineer’s Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the associated Assessment Diagram; and ordering the levy and collection of assessments for Fiscal Year 2021-22. Recommended Action: Adopt Senior Management Analyst Masud presented the staff report. Mayor Tay opened the public hearing. No comments were received for Public Hearing Item 10.b. A motion to close the public hearing was made by Council Member Verlato, seconded by Council Member Beck, and seeing no objection, Mayor Tay declared the public hearing closed. 5 06-15-2021 It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to adopt Resolution No. 7363 confirming the Engineer’s Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the associated Assessment Diagram; and ordering the levy and collection of assessments for Fiscal Year 2021-22. AYES: Beck, Verlato, Cheng, Tay, and Chandler NOES: None ABSENT: None c. Resolution No. 7364 Setting Service Rates for the collection of Residential and Multi- Family Solid Waste and Recyclables pursuant to Section 5120.7 of the Arcadia Municipal Code for Fiscal Years 2021-22 through 2025-26. Recommended Action: Adopt Environmental Services Officer Hevener presented the staff report. City Manager Lazzaretto read into the record a written protest letter that was received by Ada Kwok pertaining to the Water and Sewer Rates. Mayor Tay opened the public hearing. No comments were received for Public Hearing Item 10.c. A motion to close the public hearing was made by Council Member Verlato, seconded by Council Member Beck, and seeing no objection, Mayor Tay declared the public hearing closed. It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to adopt Resolution No. 7364 Setting Service Rates for the collection of Residential and Multi-Family Solid Waste and Recyclables pursuant to Section 5120.7 of the Arcadia Municipal Code for Fiscal Years 2021-22 through 2025-26, excluding the 3% franchise fee. AYES: Beck, Verlato, and Tay NOES: Chandler and Cheng ABSENT: None d. Temporary Use Permit No. TUP 21-12 with a categorical exemption under the California Environmental Quality Act (“CEQA”) to allow a State Fair at Santa Anta Park from July 29 through August 22, 2021. Recommended Action: Approve Associate Planner Song presented the staff report. Mayor Tay opened the public hearing. In response to Council Member Beck’s inquiries, Applicant Ron Severance of State Fair Entertainment stated that regarding the carnival rides, OSHA has strict regulations in place; he explained the inspection process and provided a breakdown of the insurance coverage of the event. A motion to close the public hearing was made by Council Member Verlato, seconded by Council Member Beck, and seeing no objection, Mayor Tay declared the public hearing closed. 6 06-15-2021 It was moved by Council Member Verlato, seconded by Council Member Beck, and carried on roll call vote to approve Temporary Use Permit No. TUP 21-12, with a categorical exemption under the California Environmental Quality Act (“CEQA”), including Findings 1 through 6 to allow a State Fair at Santa Anta Park from July 29 through August 22, 2021. AYES: Verlato, Beck, Chandler, Cheng, and Tay NOES: None ABSENT: None 11. PUBLIC COMMENTS The following individuals appeared and expressed their opposition to the Tiny Homes Project and requested that City Council take consideration of public opinions before committing to this project: Susan Guo Elizabeth The following individuals appeared and were neither for or against the Tiny Homes Project and requested that City Council take consideration of public opinions before committing to this project: Lyn Fam Christina Angie Gren Steve Dai appeared and expressed his concerns regarding Sunrise Arcadia, a youth group that is associated with the Sunrise Movement; and urged the City Council to investigate the group’s activities. Steve Stafford appeared and expressed his frustration regarding the Health Department’s mask and countertop protective shield requirements. Jireh Den, a reporter from LA Times, appeared and stated that she is researching the Tiny Shelter Project; she indicated that she is reaching out to various communities to gain different perspectives on the Project; and provided her contact information. The following individuals called in opposition to the Tiny Homes Project and requested that City Council take consideration of public opinions before committing to this project: Diat Tran Michelle Wu Lucy Chris Catherine Angela Chris The following individuals called in support of the Tiny Homes Project and requested that City Council take consideration of public opinions before committing to this project: Mike Durman Sonya The following individuals called and were neither for or against the Tiny Homes Project and requested that City Council take consideration of public opinions before committing to this project: Anonymous Caller Sammy 7 06-15-2021 Elizabeth Lashani called and commented on the Service Rates; she indicated that she did not understand how the increase in rates affects her; and commented on homelessness. City Manager Lazzaretto read into the record the following emails submitted for Public Comment: The following individuals submitted emails expressing their opposition to the Homeless Resource Hub located at the Arcadia Par 3 Golf Course: Susan Bottger David Gren Mark McGrail The following individuals submitted emails expressing their opposition to the Tiny Homes Project in the City of Arcadia: Y. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck commented on the homelessness problem in the City; he congratulated the winners of the Spring Home Awards and the Arcadia High School Co-Ed Badminton Team; he commented on the quality of the Board and Commission applicants; he thanked the applicants for their interest; he thanked the Friends of the Museum for their donation; and stated that it felt good to be back in person at Council meetings. Council Member Verlato stated that there has been confusion regarding police enforcement and homelessness, and asked Police Chief Nakamura for clarification. In response to Council Member Verlato’s request, Police Chief Nakamura stated that homelessness is not a crime; he explained that whether it is a homeless individual or not, if a crime is committed the police should be contacted; and responded to various homelessness scenarios presented by City Manager Lazzaretto. Council Member Verlato announced that on July 3 is the Patriotic Reverse Parade and Food Drive hosted by the Downtown Arcadia Improvement Association; she encouraged everyone to donate to the Foothill Unity Center; she further announced that summer concerts and movies at the park will be held on August 5 and August 14; and encouraged everyone to attend. Council Member Chandler had no comments. Mayor Pro Tem Cheng shared a kind story about former City Clerk Jim Barrows; he indicated that he would like to have a “Jim Barrows Day” each year in November to honor Mr. Barrows, and requested City Council support to place this on a future agenda. Mayor Tay and Council Member 8 06-15-2021 Verlato concurred. He thanked Chick-Fil-A and Krispy Kreme for delivering food to City staff; he thanked all the residents for coming together during COVID-19; and reminded everyone that we need to come together as one community. City Clerk Glasco had no comments. Mayor Tay stated that the City Council is working together to find a solution to the homelessness issue in the City; he indicated that City staff began the City’s Housing Element Update; he encouraged residents to take the Housing Element Update Community Survey; and asked Assistant City Manager/Development Services Director Kruckeberg to speak about the matter. Assistant City Manager/Development Services Director Kruckeberg explained that the City has developed a community survey to find out which housing issues are important to the community; he indicated that postcards will be mailed to all residents to inform them of the survey; and encouraged residents to take the survey. 13. CONSENT CALENDAR a. Special and Regular Meeting Minutes of June 1, 2021. Recommended Action: Approve b. Resolution No. 7367 amending Resolution No. 7272 related to the Arcadia Highlands Homeowners’ Association (“Highlands”) boundary map and description under Exhibit “A”. Recommended Action: Adopt c. Resolution No. 7369 adopting a list of projects for Fiscal Year 2021-22 funded by SB 1: The Road Repair and Accountability Act of 2017. Recommended Action: Adopt d. Resolution No. 7371 establishing an appropriation limit for Fiscal Year 2021-22 Pursuant to Article XIII-B of the California Constitution. Recommended Action: Adopt e. Resolution No. 7374 approving participation in the Los Angeles Urban County Permanent Local Housing Allocation (“PLHA”) Program for Fiscal Year 2021-22; identifying proposed activities for use of $466,175 in PLHA funding; and authorizing the Mayor, or designee, to sign a Reimbursable Contract with the Los Angeles County Development Authority (“LACDA”). Recommended Action: Adopt f. Resolution No. 7375 amending the Fiscal Year 2020-21 Capital Improvement Program Budget Appropriation for the Community Center Partition Wall Recovering Project in the amount of $106,450, offset by a reduction in the Capital Outlay Fund, and approving a contract with Advanced Equipment Corporation. Recommended Action: Adopt and Approve g. Accept gift of $11,750 from the Friends of the Museum for the purchase of supplies, services, and programming at the Gilb Museum of Arcadia Heritage. Recommended Action: Approve h. Statement of Investment Policy for Fiscal Year 2021-22. Recommended Action: Approve 9 06-15-2021 i. Professional Services Agreement with File Keepers, LLC, for Laserfiche Software Maintenance and Support in an amount not to Exceed $21,557. Recommended Action: Approve j. Amendment to the Professional Services Agreement with All City Management Services for Crossing Guard Services in the amount of $261,003. Recommended Action: Approve k. Amendment to the Professional Services Agreement with Executive Information Services, inc. for PS.Net Public Safety Software System Support Services in the amount of $35,444. Recommended Action: Approve l. Amendment to the Professional Services Agreement with Robert J. Guerrero for Background Investigation Services in the amount of $25,000. Recommended Action: Approve m. Contract with National Demographics Corporation for Professional Demographer Services related to State mandated review of voter district boundaries in the amount of $40,000. Purchase of portable handheld and all-band mobile radios from Day Wireless Systems for the Police Department from the Equipment Replacement Fund in an amount not to exceed $117,000.
