Staff Report Janet Sporleder, Library and Museum Services Director, presented [he staff report; she noted that the
Librery charges fines and fees for certain services; the recently conducted cost allocation study
recommended certaln changes to existing Library fees; the fines and fees will enable the City to
recover a portion of the cost of providing Library Services to the public.

Staff Report Don Penman, Assistant City Manager/Development Services Director and Donna Butler,
Community Development Administrator, presented [he staff report; the Text Amendment
was initla[ed by the Development Services Department to propose changes to the Oak
Tree Preservation portion of the Arcadia Municipal Code; the proposed TeM Amendment
was inidated to enable Oak Tree Encroachment Permits to be processed administratively;
the applicant's requirementr will continue to consist of an arborists report and plan review;
the Planning Commission at its April 26, 2005 meeting voted to support this item.
In response to questions from the Council Members, staff provided information regarding
other trees wvered in the existing Ordinance.

County Park and encouraged all members of the public to attend.
SEGAL Thanked the city staff who have helped with the recent City eventr; he noted the success of the
Arcadia Firefighters Pancake Breakfast and Arcadia Law Day; encouraged members of the public to
attend the upcoming Arcadia Fourth of July event.
CHANDLER Thanks all of those who sent best wishes to his wife regarding her recent knee surgery.
KOVACIC Thanks to everyone who participa[ed in the annual Arcadia Law Day event.
WUO Thanked the city staff for all of their hard work during the recent Arcadla Firefighters Pancake
Breakfast, community bike ride, and Arcadia Law Day; noted that Eileen Hubbard had recently been
selected as Arcadia Senior Citlzen of the Year; thanked the Arcadia RoWry Club for hosting Arcadia
Senior Citizen Day; thanked all teachers who were recently honored as 'Teachers af the Year";

3. REDEVELOPMENT AGENCY EXECUTIVE DIRECTOR

Recommendation: Approve
Staff Report Mr. Penman and Brian Saeki, Economic Development Manager, provided the staff report;
the Design Review propsed by the applicant is to construc[a new two-story4,500 square
foot warehouse and office building at 133 E. St. ]oseph Street; a vacant dilapidated home
and accessory structure are located on the lot but will be demolished as part of this
proposal; the purpose of the Redevelopment Agencys Design Review process is to ensure
that proposed projects meet adopted City and Agency standards and design guildelines;
the applicant has submitted building plans, a materials sample board, and a rendering of
the elevation; staff is recommending approval of the design~review at 133 E. St. Joseph
Stree[ subject to the conditions of approval.

effective June 1, 2005
Recommendation: Adopt
Summarv
The Library charges fines and fees for certain services. The Library Boazd of Trustees has adopted new
fines and fees which aze presented herein for ratification by the City Council. The new chazges would
• become effective June 1, 2005.
BackQround
In previous years, Library fines and fees were set by the Library Board of Tmstees which is an
Admirristrative Boazd as established by the City Charter, Section 809. Legislation currently requires that
the City Council approve all City fines and fees. The City conducted a Cost Allocation Study (CAS) in
July 2002 to determine the actual cost of service for City programs and activities. The Study, wY~ich is
regulazly updated, recommends changes to several Library fees.
The City is also committed to consistency regazding fees in different City Depaziments. The charges for
photocopying, for exanple, should be the same in each Department.
The fees for cultural and leisure services are set with a consideration for the social benefit provided to
the community. As a consequence, they may not represent full cost recovery for the service provided.
The Library Board has adopted new fines and fees subject to the ratification of the City Council.

When a item is lost or damaged, the Library charges the cost to replace the item plus a processing fee
that covers staff time to catalog and prepare the item for circulation, including labels, covers, etc. The
Cost Allocation Study recommends raising these charges.

When a particular title or item that a Library patron wants to borrow is checked out, placing it on
reserve will guarantee the item will be set aside when it is returned and will go first to those who have
reserves on it before it goes out onto the shelves for circulation. Few children place holds on materials
as the charge is perceived as a deterrent. Reducing the fee for children's materials may encourage them
to use this service more often.

When someone asks for a book or other item that is not in the Library's collections, we are usually able •
to borrow it from another library. We determine who owns the item, we ask them to send it ta us and we
then check it out to the Library patron through our own circulation system. The Cost Allocation Study
recommends raising the charge for interli6rary loans.

The charges for having materials photocopied by staff in response to reference questions or interlibrary
laan requests should be reduced to bring them into agreement with Lhe City's copying policy. Charges
for self-service copying on the paper and microfche and microfilm copiers in the public area are set by
contract with the company that supplies and services the equipment. Currently those charges are set at
$.1 S a page.

The Cost Allocation Study recommends raising both of these charges, however, the new, automated •
system makes it relatively easy to check for a registratian when a customer forgets to bring a card.
Raising the charge might be considered an impediment to good customer service. We charge for
subsequent lookups as we do want to encourage people to use their cards for reasons of efficiency and
security.

The Library Board has adopted a policy establishing this new fee. The Library Board, wanting to
encourage residents to enjoy and utilize the collection, have adopted the above fees which will not result

SECTION 1. The City Council fmds that based on a certain cosC
allocarion study performed by the Administrative Services Department of the City
of Arcadia, the fees set forth in this Resolution are necessary for the purposes set
forth in this Resolution. Said fees do not exceed the esrimated costs for providing
the applicable service, and the fees bear a reasonable relationship to the cost of the
applicable service or program involved. Furthermore, the fees bear a fair and
reasonable relationship to the benefit the payer obtains from paying the fees, or the
burden caused, and the fees are not imposed for general revenue purposes, but
instead for partially recovering the cost of providing applicable services. The
proposed fees are intended to cover the costs of Library services set forth in the
Schedule of Library Fines and Fees, attached hereto as Exhibit "A".
SECTION 2. The City Council hereby adopts the proposed fees set
forth in Exhibit "A" attached hereto, effecrive June 1, 2U05.

to propose changes to Article IX, Chapter 7(Oak Tree Preservation) adding

Planning Commission at its April 26, 2005 meeting recommended approval of this

hearing. However, an application for encroachment and/or removal of a healthy oak
tree must be reviewed by the Modification Committee or Planning Commission at a

Chapter 7 of Article IX sets forth provisions for Oak Tree preservation. Currently,
there are two types of applications regarding oak trees, one for the removal of
diseased and/or hazardous trees, and another application to remove or encroach

The proposed text amendment will create an administrative review process for •
encroachment into the protected zone of oak trees. Development Services
Department staff will review the Oak Tree Encroachment permit. After the
Devetopment Services Department makes a decision regarding the Oak Tree
encroachment request, the applicant shall be notified of the status of the application.
Application requests to remove healthy Oak Trees shall continue to be reviewed by
the Modification Committee.
The proposal is to amend portions of Chapter 7 of Article IX, Sections 9701, 9704,
and 9705. The major change will occur in Section 9704 (Application and Fees),
adding section C entitled "Oak Tree Permi4 for Encroachment Into a Protected Zone."
This section shall include the application and administrative review procedures (See
attached exhibit)
Another component of the proposed text amendment includes minor changes to
several sections of Chapter 7. Throughout the entire Chapter, the words "Planning
Department" have been replaced with "Community Development Division." Also, the
phrase "or his/her designee" shall follow the words "Community Development
Administrator" in several paragraphs. In several paragraphs, the words "and/or
encroachment into a protected zone," have been added or omitted as appropriate.
The proposed text amendment has been initiated to enable Oak Tree Encroachment
Permits to be processed administratively. The proposed process shall be less •
onerous to prospective applicants and should also take less staff time and resources
for review. The applicant will still be required to provide an arborist report and plans
for consideration of the encroachment.
Attached is the draft Ordinance highlighting the changes.
ENVIRONMENTAL ANALYSIS
The proposed text amendment is exempt from the requirements of the California
Environmental Quality Act (CEQA). There is no possibility that the text amendment,
by itself, will have a significant effect on the environment under Section 15061(b)(3)
of the CEQA Guidelines, and this text amendment does not constitute a"projecY'
under Section 15378(b)(2) of the CEQA Guidelines.

AN ORDINANCE OF THE CITY COUNCIL OF 'THE CITY OF
ARCADIA, CALIFORNIA, AMENDING CHAPTER 7 OF
ARTICLE IX OF THE ARCADIA MUNICIPAL CODE
REGARDING THE PRESERVATION OF OAK TREES
THE CITY COLTNCIL OF THE CITY OF ARCADIA, CALIFORI~IA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Secrions 9701, 9704 and 9705 of Chapter 7 of Article IX of
the Arcadia Municipal Code are amended to read as follows:
9701. SCOPE.
No oak tree shall be removed, damaged or have its protected zone
~
encroached upon except in conformance with the provisions of this Chapter. The •
provisions of this Chapter shall apply to all oak trees on all public and private
property whether vacant, undeveloped, in the process of development or
developed.
Exceprions. The following are exempt from the provisions of this Chapter:
A. Combined Permit. An Oak Tree Removal Pemrit is not required where
tree removal and/or encroachment has been specifically approved as part of a
development pernut.
B. Emergency Situation. Cases of emergency where the Director of Public
Works, or any member of a law enforcement agency or the City of Arcadia Fire
Deparixnent, in the performance of his or her duties, deternunes that an oak tree
poses an imxninent threat to the public safety, or general welfare.

C. Visual Barriers. Removal or relocation of oak trees necessary to obtain
adequate line-of-sight distances as required by the Director of Public Works.
D. Public Urility Damage. Acrions taken for the protecrion of existing
electrical power or communicarion lines or other property of a public utility.
E. City Property. Removal of oak trees on City owned property, which in
the opinion of the Director of Public Works, will cause damage to existing public
improvements, or which are in a location that does not permit the development of
the site for public purposes.
F. Arcadia Redevelopment Agency Property. Removal of oak trees on
Arcadia Redevelopment Agency owned property that, in the opinion of the
Executive Director of the Arcadia Redevelopment Agency, are in a location which
does not permit the development of the site.
~ 9704. APPI,ICATION AND FEES.
A. Oak Tree Pernut for the removal of diseased and/or hazardous oak trees.
l. . An applicarion for an Oak Tree Permit for the removal of a diseased or
hazardous oak tree shall be made to the Community Development Division, and
shall include an evaluation from a Certified Arborist as to the condition of the tree.
2. There is no fee for an Oak Tree Pernut for the removal of a diseased or
hazardous oak ri~ee.
B. Oak Tree Pernut for the removal of healthy oak trees.
1. An applicarion for an Oak Tree Permit for the removal of a healthy oak
tree shall be made to the Community Development Division. T'he content, form,
instrucrions, procedures, and requirements of the application package deemed
necessary and appropriate for the proper enforcement of this Chapter shall be

established by the Community Development Division. The application shall
include: •
(a) an explanation as to the why the tree's removal is necessary,
(b) an explanarion as to why tree removal is more desirable than alternative
project designs,
(c) an explanation of any mitigarion measures,
(d) a fee in the same amount as required for a Modificarion application.
C. Oak Tree Pemut for Encroachment Into a Protected Zone.
1. An applicarion for an Oak Tree Permit for Encroachment Into a
Protected Zone shall be made to the Community Development Division, and shall
include an evaluation from a Certified Arborist as to the condition of the tree and
the effect of the encroachment upon the tree accompanied by the appropriate
photographs showing the area(s) of encroachment. ~
2. A fee in the same amount as required for an Administrative Modification
application shall be submitted at the rime said application.is filed with the City.
9705. ACTION ON APPLICATION
A. Oak Tree Permit for the removal of diseased and hazardous oak trees.
1. Upon the receipt of an application to remove a diseased or hazardous
oak tree, the Community Development Administrator or his/her designee shall
have five (5) working days to approva, conditionally approve, or deny the
application.
2. If the Community Development Administrator or his/her designee
denies such applicarion, the decision may be appealed to the Modification
Comxnittee. Such appeal shall be processed pursuant to the modification •

regulations. The fee for an appeal shall be the same as for a Modificarion
• application.
3. The privileges granted an applicant in this Section shall become null and
void if not utilized within one (1) year from the date of the approval.
B. Oak Tree Permit for the removal of healthy oak trees.
1. T'he application for an Oak Tree Permit for the removal of a healthy oak
tree or trees shall be subject to the approval or conditional approval of the
Modification Comrnittee or the Planning Commission (on appeal) or City Council
(on appeal) pursuant to the modification regulations.
2. If the applicant lives within a Homeowners Association area established
pursuant to Section 9272.23 of the Arcadia Municipal Code, the applicant shall
submit their tree removal plans to the Architectural Review Board (Committee) of
• said Homeowners Associarion for review and approval, conditional approval or
denial, prior to filing an applicarion with the City. ~
3. The Architectural Review Board's (Committee's) review and comment
are not required if the Homeowners Association has filed a letter with the
Community Development Division stating that their Association does not wish to
perform such review.
4. The privileges granted an applicant in this Secrion shall become null and
void if not utilized within one (1) year from the date of the approval or condirional
approval.
C. Oak Tree Pernrit for Encroachment Into a Protected Zone.
1. Upon the receipt of an application to encroach into the protected zone of
an oak tree, the Community Development Administrator or his/her designee shall

2. If the ` Community Development Administrator or his/her designee

Recommendation: Adopt.
SUMMARY
On August 19, 2003 the City Council adopted Resolution No. 6381 authorizing staff to
invest City funds in the Local Agency Investment Fund (LAIF). The State is now
requesting that the Arcadia Redevelopment Agency (ARA) also adopt a resolution
authorizing staff to invest ARA bond proceeds in LAIF. Bond proceeds have been
• invested in LAIF since their issuance. As such, the State's request is simply a matter of
"housekeeping". Thus, staff recommends that the ARA adopt Resolution No. ARA-214
authorizing staff to invest bond proceeds in LAIF.
BACKGROUND / DISCUSSION
- The Local Agency Investment Fund (LAIF), is a voluntary program created by statute;
began in 1977 as an investment alternative for Califomia's local governments and special
districts and it continues today under Treasurer Phil Angelides' administration. The
enabling legislafion for the LAIF is Section 16429.1 et seq. of the California Government
Code.
This program offers local agencies the opportunity to participate in a major portfolio,
which invests hundreds of millions of dollazs, using the investment expertise of the
Treasurer's Office investment staff at no additional cost to the taxpayer, This in-house
management team is comprised of civil servants who have each worked for the State
Treasurer's Office for an average of 20 yeazs.
The LAIF is part of the Pooled Money Investment Account (PMIA). The PMIA began in
1953 and the Pooled Money Investment Board (PMIB) and an in-house Investment
Committee provide oversight. The PMIB members aze the State Treasurer, Director of
Finance, and State Controller.

The Local Investment Advisory, Board (LIAB) provides oversight for LAIF. The Board
consists of five members as designated by statute. The Chairman is the State Treasurer or
his designated representative. Two members qualified by training and experience in the
field of investment or finance, and the State Treasurer appoints two members who aze
treasurers, finance or fiscal officers or business managers employed by any county, city
or local district or municipal corporation of this state. The term of each appointment is
two yeazs or at the pleasure of the appointing authority.
All secwities aze purchased under the authority of Government Code Section 16430 and
16480.4. The State Treasurer's Office takes delivery of all securities purchased on a
delivery versus payment basis using a third party custodian. All investments aze
purchased at market and a mazket valuation is conducted monthly.
Additionally, the PMIA has Policies, Goals and Objectives for the portfolio to make
certain that our goals of Safety, Liquidity and Yield are not jeopazdized and that prudent
management prevails. These policies are formulated by investment staff and reviewed by
both the PMIB and the LIAB on an annual basis. •
The State Treasurer's Office is audited by the BurBau of State Audits on an annual basis
and the resulting opinion is posted to the STO website following its publication. The •
Bureau of State Audits also has a continuing audit process throughout the yeaz. The State
Controller's Office as well as an in-house audit process involving three separate divisions
audit all investments and LAIF claims on a daily basis.
At LAIF, bond proceeds are maintained in sepazate bond accounts, are not subject to the
$40 million maximum that applies to regular LAIF acwunts, and aze limited to one
withdrawal per 30-day period. The special nature of bond proceeds makes these special
pazameters appropriate.
The LAIF has grown from 293 participants and $468 million in 1977 to 2,715
participants and $17.9 billion in 2005.
FISCAL IMPACT
Under Federal Law, the State of California cannot declare bankruptcy, thereby allowing
the Government Code Section 164293 to stand. This Section states that "moneys placed
with the Treasurer for deposit in the LAIF by cities, counties, special districts, nonprofit
corporations, or qualified quasi-governmental agencies shall not be subject to either of
the following: (a) transfer or loan pursuant to Sections 16310, 16312, or 16313, or (b)
impoundment or seizure by any state official or state agency."

During the 2002 legislative session, California Govemment Code Section 16429.4 was
added to the LAIF's enabling legislation. The Section states "the right of a city, county,
city and county, special district, nonprofit corporation, or qualified quasi-governmental
agency to withdraw its deposited moneys from the LAIF, upon demand, may not be
altered, impaired, or denied in any way, by any state official or state agency based upon
the state's failure to adopt a State Budget by July 1 of each new fiscal yeaz."
The adoption of Resolution No. ARA-214 will not have an impact on the Agency's bond
proceeds invested in LAIF, other than allowing the CiTy to keep those monies in LAIF.
RECOMMENDATION
Adopt Resolutian No. ARA-214, a Resolution for the Board of Directors of the
Arcadia Redevelopment Agency, authorizing investment of Arcadia Redevelopment
Ageucy bond proceeds in the Local Agency Investment fund.

SUMMARY:
Ordinance No. 1432 of the City of Arcadia empowers the Director of Emergency Services to
proclaim the existence or threatened existence of a local emergency when said Ciry is affected
or likely to be affected by a public calamity and the City Council is not in session.
`• The Director of Emergency Services (Director) of the City of Arcadia found that conditions of
extreme peril to the safety of persons and property arose within Arcadia caused by torrential
rain, which began on January 8, 2005. The Director signed and issued a local emergency

Pursuant to Ordinance No. 1432, Section 2213.2.1., whenever a local emergency is proclaimed
by the Director, the City Council shall take action to ratify the proclamation within seven (7)
days thereafter or the proclamation shall have no further force or effect. In addition, the City
Council must act to renew the proclamation at each of their subsequent meetings until final
termination of the emergency.
At their ]anuary 18, 2005 meeting, the City Council acted to approve the local emergency

four hours a day, seven days a week, extending the services the Library can provide beyond the
Library's weekly total of sixty hours of in-person service.
Librazy staff has cazefully evaluated other similaz online databases available from other vendors and has
• concluded that these databases provide the best mix of resources and materials for the citizens of the
City of Arcadia. Gale Group is one of the largest publishers of library reference materials and has an

FISCAL IMPACT
A total of $37,911.01 has been budgeted from the Friends of the Arcadia Public Library Trust Account,
the Arcadia Public Library Foundation Trust Account, and the Public Library Funds Trust Account for
the purchase of these databases and the Librazy Boazd of Trustees has approved tlus expenditure.

On April 6, 2004, City Council awarded a contract to Control Management Systems in
the amount of $62,065.00 for the Library HVAC Building Communications Repiacement
project. The terms and conditions of this project have been complied with and the work
has been performed to staff's satisfaction for a total project cost of $62,065.00.
Staff recommends that the City Council accept all work performed by Controls
Management Systems as complete and authorize the final payment to be made in
accordance with the contract documents, subject to a retention of $6,206.50.
DISCUSSION
The Public Works Services Department is responsible for the operations and
maintenance of the Library's HVAC mechanical equipment. The Honeywel~ system, the
Library's old HVAC telecommunication system, had become obsolete due to the
technological changes in the industry; parts are no longer available and technical
support has been discontinued. This necessitated the upgrade of the Library's HVAC
building communication system to the new Andover system, which is a stand alone
state-of-the-art system that is now standard for all City facilities and is capable of
incorporating future system upgrades, new HVAC equipment and computer software
changes. By adding this system to the Library facility, it standardizes their climate
• control system with the Police Department and Council Chambers making it easier for
staff to communicate and adjust HVAC operations at these facilities.

The scope of the project involved the replacement of existing Honeywell heating, •
ventilation and air conditioning (HVAC) telecommunications, sensors, controllers,
automated electrical panels and variable speed drives.

$62,065.00.

SUMMARY
It is recommended that the City Council approve an agreement with Unified Nutri-Meals to
provide luncheon meals for the Senior Nutrition Program offered by Arcadia Senior Citizen
Services at the Arcadia Community Center from July 1, 2005 through June 30, 2006.
BACKGROUND
The City of Arcadia, Senior Citizen Services is contracted with the Arcadia Unified School
District (AUSD) to provide luncheon meals for the Senior Nutrition Program offered at the
Arcadia Community Center Monday through Friday until June 30, 2005. The City desired to
renew the existing agreement with AUSD, however they could not continue the current price
($3.25) per meal of the existing contract. The contract with AUSD will expire June 30, 2005.
Guidelines set forth by the Community Development Commission (CDC) indicate that the
City must follow a competitive bidding process whenever awarding a new contract.
• Senior Services staff prepared and mailed a Request for Proposal (RFP) to ten (10) vendors
and published.a Public Notices inviting bids for the 2005-2006 contract in the local papers to
meet the CDC competitive selection process. Three (3) vendors submitted bids, they where

Arcadia Unified School District, at $3.95 per meal, Catering Systems Inc at $3.25 per meal
and Unified Nutri-Meals at $2.80 per meal. The low bidder was Unified Nutri-Meals.
Staff met and conferred with Unified Nutri-Meals to determine if their bid would meet the•
spec~cations stated in the RFP. Staff also surveyed the surrounding cities of Alhambra,
Duarte, Baldwin Park and Glendora currently contracted with Unified Nutri-Meals to ascertain
the reliability of their service and the quality of their product. Based on our meeting and
survey, our staff is confident in Unified Nutri-Meals' adequacy to perform the service of
providing luncheon meals for the Senior Nutrition Program.
Presently the cost per meal is $3.25. The bid price reduces the cost to $2.80 per meal.
Participants currently pay $2.00 and Community Development Block Grant (CDBG) funds
subsidize $1.25 per meal. For fiscal year 2005-2006 it is proposed that participants continue
to pay $2.00 and that CDBG funds and City funds subsidize the remaining $.80 of the cost
per meal. The proposed Senior Nutrition program budget for fiscal year 2005-06 is $40,800
(a combination of CDBG and City funds), which is sufficient to cover the bid per meal cost.
The senior lunch program averages 42 meals per day indicating that the Senior Nutrition
Program meets the needs of the senior community. The Senior Cftizens Commission has
concurred and supports the continuance of the Senior Nutrition program.

The proposed Senior Citizen Meals Program budget for Fiscal Year 2005-06 is $40,800;
$20,800 in CDBG funds to continue subsidizing the luncheon meals costs, and $20,000 from

Operating Budget, which is offset by participant payments. The proposed budget is sufficient
to continue the program.

SUMMARY
On April 1, 2005, the City of Arcadia was announced as a grant award winner for our
• request for funding from the FY04 FEMA Assistance to Firefighters Grant Program for
Fire Prevention. The grant award is for $98,553, with a cost share of $37,951. These
funds will be used to implement a smoke detector program within the City of Arcadia
and must be completed by March 25, 2006.
The Fire Department is requesting that the City Council authorize staff to accept the
grant award and for the City Council to appropriate $37,951 to a trust account for
implementation of this program.
DISCUSSION
On September 30, 2004, the City of Arcadia Fire Department applied for a grant through
FEMA's Assistance to Firefighter Grant Program for Fire Prevention Grants.
Following the priorities of the grant program, the Arcadia Fire Department submitted a
request to provide smoke detectors and/or batteries for smoke detectors within the
community at no charge to the resident. This grant program aims to target residences
with children under the age of 14 residing in the home andlor seniors over the age
of 65. Smoke detectors will be installed by appointment or provided by the department
along with fire prevention materials. A component of this program also allows for
translation of fire prevention materials to the Asian community and in-home education
on proper maintenance of smoke detectors. The program specifically identifies this
target community, which may have been overlooked in other fire prevention efforts due
to limited knowledge of the English language.

This grant award includes personnel expenses for the Fire Department to hire
administrative interns to assist with translation of fire prevention materials,
communication within the community, scheduling of appointments, appearances at
public events, and coordination with identified organizations within the community.
Implementation of this program will complement the Fire DepartmenYs efforts toward
fire prevention and reduction of the loss of life from accidental fires in the home. The
Fire Department hopes to successfully distribute 5,000 smoke detectors within the
community during the grant period. Arcadia residents with existing smoke detectors
may request a fire prevention inspection, which may include installation of smoke
detectors andlor new batteries, as necessary.
FISCAL IMPACT
The project budget for this grant is $126,504. FEMA has awarded $88,553, and the
City of Arcadia' s cost share is at 30% or $37,951.
RECOMMENDATION
It is recommended that the City Council approve
(1) the acceptance of $88,553 in grant funds for the FY04 FEMA Assistance to
Firefighters Grant Program for Fire Prevention;
(2) the appropriation of $37,951 to a trust account; and
(3) to authorize the City Manager to execute any necessary forms and/or
documents necessary to implement this grant, subject to review and
approval as to form by the City Attorney.

The roadway and utilities along Golden West Avenue between Vaquero Road and
Monte Vista Drive are in need of modifications and repair due to excessive deformity
caused by unsuitable soil conditions. This contract will repair the roadway at Golden
West Avenue between Vaquero Road and Monte Vista Drive and the City's
underground utilities. In addition, broken sewer pipes will be repaired at four (4) other
locations (Canyon Road, an alley at St. Joseph Street, San Luis Rey Road and
Newman Avenue) identified by this year's annual CCN inspections as emergency
repairs.
Staff received three (3) bids for this project. Powell Engineering Construction submitted
the lowest qualified bid and has successfully completed similar projects. Staff
recommends that the City Council award a contract in the amount of $226,736.00 to
Poweli Engineering Construction for the Golden West Avenue Roadway Rehabilitation,
Waterline Rehabilitation and Sewer Repair Project.
DISCUSSION
The roadway along Golden West Avenue between Vaquero Road and Monte Vista
Drive sits upon a natural artesian spring and ove~ time the street and underground
utilities have been damaged from ground movement caused by rising and falling water

The roadway and utilities in this area are severely deformed and are in need of
extensive repair. Roadway deformations at some locations are in excess of one foot.
Additionally, the sewer has severe undulations, which may restrict the proper flow of
sewage, which could cause problems in the system. In the past, earth movements have
resulted in major water main breaks causing major pipe repairs and street damage.
Therefore, the replacement of vulnerable underground utilities and the rehabilitation of
the roadway surfacing are appropriate at this location.
A hydro geologic evaluation of this street segment indicated that full stabilization of the
street would be cost prohibitive. Moreover, evaluation of several aerial photos indicate
that continual geologic movements over time may impact even the most expensive
repair processes. Therefore, a conventional design that targets the immediate surface
problems through the use of cost effective enhancements was selected for this project.
The design would include the following: accommodate potential future ground
movements, replace the existing water line, repair sagging and cracked portions of the
sewer line, and reconstruct the roadway. Soil stabilization procedures will also be
implemented to protect the new infrastructure.
This year's CCN inspections of our sewer lines identified four (4) sections of pipe on
Canyon Road, an alley at St. Joseph Street, San Luis Rey Road and Newman Avenue
as a high priority due to severity of pipe damage. These particular sections of sewer line ~
are cracked and leaking requiring them to be removed and replaced in kind as soon as
possible. Based on this information, staff added these sections to the bid package to
take advantage of lower unit prices typically associated with a larger project and a larger
economy of scale. The cumulative length of the pipeline repair will be 107 feet. The
cost for this portion of the bid is $18,533. Sufficient funds are available in this project to
accomplish this work. Staff is requesting that the City Council authorize the inclusion of
these four (4) locations as part of this project.
Notices inviting bids were published in the adjudicated paper and bid packages were

4,500 square foot warehouse and office building at 133 E. St. Joseph Street. The
building is setback 10 feet from the property line along St. Joseph. There are two tan
stamped concrete walkways proposed to enter the building. The remaining area will be
landscaped with two (2) 24 inch boxed trees, sod, shrubs and groundcover. The

parking area will be accessed off the alley to the north of the property. This area has
been designed to accommodate 10 parking spaces, a loading area, trash enclosure and
a bicyGe parking area. Landscaping has also been incorporated into the layout of the
parking area.
Based upon the building size and the uses proposed, the Arcadia Muniapal Code
requires that the Applicant provide 11 parking spaces. However, the City Council at
their May 3, 2005 meeting, approved a modification that allowed the Applicant to
provide 10 spaces in lieu of the 11 required. The modification also permitted an
industrial development on a legal lot of less than 15,000 square feet.
The proposed architectural style of the building (French Provincial) is unique to this
area. It will provide additional character to a predominately industrialized area with an
existing eclectic mix of architectural styles. Additionally, the building's massing,
proposed colors and building materials are consistent with the CBD Design Guidelines
and other surrounding developments. The front fagade or south e-evation has eight (8)
grid style windows (4 on the second story and 4 on the first story) of which seven (7) will
• have evergreen shutters. The remaining teaded glass window is much smaller and has
been placed directly over the front entrance to provide a second story accent to the
entry. The windows and shutters have been uniquely designed to match the
architectural styfe of the building. The wall surfaces will consist of Birch white stucco on
the second story and a Coronado stone veneer on the first story. A second story
balcony on the west side of the building with omate wrought iron railing has also been
proposed.
The rear fa~ade or north elevation has five (5) grid style windows, two (2) doors and one
(1) loading door. Evergreen shutters will be added to three (3) of the flve windows. The
loading doar also incorporates the grid pattem to match the widows. The rear farade
wall surfaces will be Birch white stucco.
The building will have a hip roof that will vary in height. The roof material, as proposed,
is dark green slate tiles.
B. STAFF CONDITIONS OF APPROVAL
The buifding colors and materials shall be consistent with the colored elevation,
sample materials board and the plans (Attachment 2).
• . The Applicant shall comply with ARA Reso. 126 - which approves this design review
for a period of one year.
