A RESOLUTION OF THE CITY COUNCIL OF THE CITY OFARCADIA,
CALIFORNIA, DECLARING AND AFFIRMING A VOTE OF NO
CONFIDENCE IN LOS ANGELES DISTRICT ATTORNEY GEORGE
GASCON
WHEREAS, the current Los Angeles County District Attorney ("DA") George
Gascon was elected on November 3, 2020, capturing 54% of the vote; and
WHEREAS, on December 7, 2020, DA Gascon announced a series of Special
Directives ("SDs") to reform criminal prosecutions in Los Angeles County; and
WHEREAS, DA Gascon's reforms are eliminating key components of the criminal
justice system itself, undermining law enforcement's ability to effectively police our
communities, and dismantling the rule of law in Los Angeles County; and
WHEREAS, SD 20-06, entitled "Pretrial Release Policy," eliminates cash bail in
Los Angeles County even though Californians just voted to keep cash bail and DA
Gascon has signaled that he will not obey the will of the voters and will not follow the
law; and
WHEREAS, The DA's Special Directive ("SD") 20-07, entitled "Misdemeanor
Case Management," essentially outlines 13 crimes that can be committed in Los Angeles
County without fear of prosecution; and
WHEREAS, SD 20-08, entitled "Sentencing Enhancement and Allegations,"
eliminates most sentencing enhancements, special circumstances, life-without-parole-
eligible sentences, and the death penalty; and
WHEREAS, DA Gascon's Special Directives contradict state laws that were
enacted by the legislature as well as approved by voters through the legislative ballot
initiative process to prevent and prosecute crime, and to protect the public; and
WHEREAS, policies that aim to restructure or amend prosecutorial directives
need to be consistent with state law, and issued with reasonable intent to enhance public
safety, protect victim's rights, and promote the rule of law.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Arcadia strongly urges that Los
Angeles County District Attorney George Gascon rescind Special Directives 20-06, 20-
07, and 20-08, and review all other directives to ensure that public safety, victim's rights,
and the rule of law are maintained or enhanced.
SECTION 2. The City Council of the City of Arcadia demands that Los Angeles
County District Attorney George Gascon uphold state law and refrain from issuing
further Special Directives that contradict or violate the spirit, letter, or intent of state
laws as enacted by the legislature or vote of the people.
SECTION 3. The City Council further calls on Los Angeles County District
Attorney George Gascon to resign or be removed from office if he continues to usurp
or contradict the rule of law.
SECTION 4. Adoption of this Resolution declares and affirms that the City
Council of the City of Arcadia has no confidence in Los Angeles County District Attorney
George Gascon.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
