SUBJECT: PROFESSIONAL SERVICES AGREEMENT WITH KREUZER
CONSULTING GROUP FOR STREET PAVEMENT REHABILITATION
AND RELATED DESIGN SERVICES IN THE AMOUNT OF $189,990,
INCLUDING A 10% CONTINGENCY
Recommendation: Approve
SUMMARY
Engineering design services are needed to assist on three upcoming street improvement
projects. The projects are:
• Baldwin Avenue and Live Oak Avenue Arterial Concrete Pavement Rehabilitation
• First Avenue and Santa Clara Street Area Asphalt Pavement Rehabilitation
• Westbound Huntington Drive Sidewalk and Curb Ramp
A Request-for-Proposals (“RFP”) for design services for the projects listed above was
sent to three (3) qualified firms. Kreuzer Consulting Group (“KCG”) was the only firm that
submitted a proposal. The other two firms did not submit proposals due to workload and
schedule constraints. KCG’s proposal for the services is at a cost of $189,990.
It is recommended that the City Council approve, and authorize and direct the City
Manager to execute, a Professional Services Agreement with Kreuzer Consulting Group
for design services in the amount of $189,990 and approve a 10% contingency.
BACKGROUND
There are several major street improvement projects planned for the near future. In order
to administer them in a timely manner, engineering design services are needed for three
projects: the Baldwin Avenue and Live Oak Avenue Arterial Concrete Pavement
Rehabilitation, the First Avenue and Santa Clara Street Area Asphalt Pavement
Rehabilitation, and the Westbound Huntington Drive Sidewalk and Curb Ramp project.
Each of these projects is described in detail below.

The Baldwin Avenue and Live Oak Avenue Arterial Concrete Pavement Rehabilitation
project was budgeted in two parts. The Baldwin Avenue portion was budgeted in the
Fiscal Year 2020-21 Capital Improvement Program (“CIP”) and the Live Oak Avenue
portion in the FY 2021-22 CIP. The project includes the following:

The First Avenue and Santa Clara Street Area Asphalt Pavement Rehabilitation Project
was budgeted in the FY 2021-22 CIP. After completion of the Gold Line Pedestrian
Linkage Project, the streets in and around the boundaries of the project need to be
rehabilitated to complete the improvements in the extended downtown area. This project
includes the following:
• A full grind & overlay of all pavement surfaces on the following segments:
o First Avenue from Huntington Drive to Colorado Boulevard
o Santa Clara Street from First Avenue to Fifth Avenue
o St. Joseph Street from Flower Street to Second Avenue

The Westbound Huntington Drive Sidewalk and Curb Ramp Project was budgeted in the
FY 2021-22 CIP. This project will provide ADA access on the north side of Huntington
Drive and will include the following work:
• Install 6-foot wide sidewalk with ADA accessible curb ramp on the north side of
Westbound Huntington Drive from Cortez Road to existing sidewalk at the former
Union Bank site
• Modify or relocate curb and gutter along Westbound Huntington Drive from
Cortez Road to existing curb and gutter at easterly property line of the former
Union Bank site
• Relocate or adjust obstacles and utilities to grade
• Remove trees, landscaping, and irrigation as necessary
• Reconstruct the west corner of Cortez Road and Westbound Huntington Drive
curb return with new radius (20’ minimum) and spandrel.
DISCUSSION
An RFP for design services for the above-described projects was sent to three (3)
qualified firms: Kreuzer Consulting Group (“KCG”), KOA Corporation, and Kimley Horn &
Associates (“KHA”). All firms are highly qualified and have previously provided
engineering design services to the City.
KCG was the only firm that submitted a proposal. KOA Corporation notified the City that
they did not send a proposal due to their workload, and Kimley Horn & Associates was
unable to submit a proposal due to scheduling conflicts.
The RFP was structured to request separate fee proposals for the three projects because
of the three separate project budgets. KCG’s proposal breakdown is as follows:
FIRM
Concrete
Rehabilitation
AC
Rehabilitation
Huntington
Sidewalk
TOTAL
Kreuzer Consulting Group $82,540 $89,300 $18,150 $189,990
KCG has previously been chosen by the City for similar design work for the Live Oak
Avenue Rehabilitation, Huntington Drive Rehabilitation, and Miscellaneous Arterial Street
Rehabilitation projects. KCG’s previous cost proposals have been reasonable and
competitive, and they have provided the City with an exceptional level of service and
design. Their latest cost proposal was compared to previous design proposals based on
total budget amount, extent and detail of the work, and number of design plan-sheets
anticipated. The current proposal is proportionally equivalent and in line with past
proposals and the City’s expectations and estimates. Based on KCG’s past project
experience with the City, and their reasonable and competitive cost, it is recommended
that they be awarded the project.

ENVIRONMENTAL ANALYSIS
The proposed action does not constitute a project under the California Environmental
Quality Act (“CEQA”), Section 15061(b)(3) and it can be seen with certainty that it will
have no impact on the environment. Thus, this matter is exempt under CEQA.
FISCAL IMPACT
Kreuzer Consulting Group proposes engineering design services for three projects at a
total cost of $189,990. The three projects were budgeted as follows:
PROJECT FUND AMOUNT KCG Proposal
Baldwin Avenue and Live Oak Avenue
Arterial Concrete Pavement Rehabilitation
Prop C $1,100,000 $82,540
First Avenue and Santa Clara Street Area
Asphalt Pavement Rehabilitation
Prop C $800,000 $89,300
Westbound Huntington Drive Sidewalk
and Curb Ramp
TDA
Article 3
$100,000 $18,150
TOTAL $2,000,000 $189,990
These three projects are funded entirely with road repair and improvement funds:
Proposition C and TDA Article 3. The design costs, as proposed, represent approximately
9% of the total project budgets. Typically, 10% of a project’s budget is used for estimating
design costs, so this proposal is reasonable and within the expected costs. There are
sufficient funds available to cover the cost of these services.
RECOMMENDATION
It is recommended that the City Council approve, and authorize and direct the City
Manager to execute, a Professional Services Agreement with Kreuzer Consulting Group
for street pavement rehabilitation and related design services in the amount of $189,990
and approve a 10% contingency.

canceled and not replaced, City has the right but not the duty to obtain the insurance it deems

shall not be restricted to insurance proceeds, if any, received by Consultant, the City, its officials,
officers, employees, agents, or volunteers.
b. To the extent required by Civil Code section 2782.8, which is fully
incorporated herein, Consultant’s obligations under the above indemnity shall be limited to claims
that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the
Consultant, but shall not otherwise be reduced. If Consultant’s obligations to defend, indemnify,
and/or hold harmless arise out of Consultant’s performance of “design professional services” (as
that term is defined under Civil Code section 2782.8), then upon Consultant obtaining a final
adjudication that liability under a claim is caused by the comparative active negligence or willful
misconduct of the City, Consultant’s obligations shall be reduced in proportion to the established
comparative liability of the City and shall not exceed the Consultant’s proportionate percentage
of fault.
13. California Labor Code Requirements.
a. Consultant is aware of the requirements of California Labor Code Sections
1720 et seq. and 1770 et seq., which require the payment of prevailing wage rates and the

works” or “maintenance” project, as defined by the Prevailing Wage Laws, and if the total
compensation is $15,000 or more for maintenance or $25,000 or more for construction, alteration,
demolition, installation, or repair, Consultant agrees to fully comply with such Prevailing Wage
Laws. Consultant shall defend, indemnify and hold the City, its officials, officers, employees and
agents free and harmless from any claims, liabilities, costs, penalties or interest arising out of any
failure or alleged failure to comply with the Prevailing Wage Laws. It shall be mandatory upon
the Consultant and all subconsultants to comply with all California Labor Code provisions, which
include but are not limited to prevailing wages (Labor Code Sections 1771, 1774 and 1775),
employment of apprentices (Labor Code Section 1777.5), certified payroll records (Labor Code
Sections 1771.4 and 1776), hours of labor (Labor Code Sections 1813 and 1815) and debarment
of contractors and subcontractors (Labor Code Section 1777.1).
b. If the services are being performed as part of an applicable “public works”
or “maintenance” project and if the total compensation is $15,000 or more for maintenance or
$25,000 or more for construction, alteration, demolition, installation, or repair, then pursuant to
Labor Code Sections 1725.5 and 1771.1, the Consultant and all subconsultants performing such
services must be registered with the Department of Industrial Relations. Consultant shall maintain
registration for the duration of the Project and require the same of any subconsultants, as
applicable. This Project may also be subject to compliance monitoring and enforcement by the
Department of Industrial Relations. It shall be Consultant’s sole responsibility to comply with all
applicable registration and labor compliance requirements.
c. This Agreement may also be subject to compliance monitoring and
enforcement by the Department of Industrial Relations. It shall be Consultant’s sole responsibility
to comply with all applicable registration and labor compliance requirements. Any stop orders
issued by the Department of Industrial Relations against Consultant or any subcontractor that
affect Consultant’s performance of services, including any delay, shall be Consultant’s sole
responsibility. Any delay arising out of or resulting from such stop orders shall be considered
Consultant caused delay and shall not be compensable by the City. Consultant shall defend,
indemnify and hold the City, its officials, officers, employees and agents free and harmless from
any claim or liability arising out of stop orders issued by the Department of Industrial Relations
against Consultant or any subcontractor.
14. Verification of Employment Eligibility.
By executing this Agreement, Consultant verifies that it fully complies with all requirements
and restrictions of state and federal law respecting the employment of undocumented aliens,
including, but not limited to, the Immigration Reform and Control Act of 1986, as may be amended
from time to time, and shall require all subconsultants and sub-subconsultants to comply with the
same.
15. Laws and Venue.
This Agreement shall be interpreted in accordance with the laws of the State of California.
If any action is brought to interpret or enforce any term of this Agreement, the action shall be
brought in a state or federal court situated in the County of Los Angeles, State of California.
16. Termination or Abandonment
9
Updated Feb. 2020

under this Agreement by giving ten (10) calendar days written notice to Consultant. In such event,
City shall be immediately given title and possession to all original field notes, drawings and
