HomeMy WebLinkAboutItem 12a - Regular Meeting Minutes of August 3, 2021 1 08-03-2021 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, AUGUST 3, 2021 CALL TO ORDER – Mayor Tay called the Closed Session to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Verlato, Cheng, and Tay ABSENT: Chandler It was the consensus of the City Council that Council Member Chandler be excused from this meeting. PUBLIC COMMENTS – No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54956.9 (d)(1) to confer with legal counsel regarding the matter of the City of Arcadia vs. The Dow Chemical Company; Dow Agrosciences LLC; Shell Oil Company, et al., United States District Court, Central District (Case No. 2:18-cv-10139). b. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: City Manager Dominic Lazzaretto, Assistant City Manager/Development Services Director Jason Kruckeberg, and Administrative Services Director Hue Quach. Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Firefighters’ Association, and unrepresented employees: Department Heads, Division Managers, Supervisors, and part-time employees. No reportable action was taken on the Closed Session Items. The Closed Session ended at 6:52 p.m. Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the Regular Meeting to order at 7:00 p.m. 2. INVOCATION – Reverend Jolene Cadenbach, Arcadia Congregational Church 3. PLEDGE OF ALLEGIANCE – City Clerk Glasco 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Verlato, Cheng and Tay ABSENT: Chandler 2 08-03-2021 A motion was made by Council Member Beck to excuse Council Member Chandler from this meeting. The City Council concurred. 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that prior to the Regular Meeting the City Council met in a Closed Session to consider the two items listed on the posted agenda and stated that no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that 6 emails were received for public comment. The comments were generally related to Tiny Homes and homelessness, and that all have been forwarded to the City Council for consideration. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Beck and seconded by Mayor Pro Tem Cheng to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Presentation by the Upper San Gabriel Valley Municipal Water District Director Tony Fellow and General Manager Tom Love regarding the state-wide drought and water resources in the Main San Gabriel Basin. b. Presentation by Richard Schulhof, CEO of the Los Angeles County Arboretum and Botanic Garden, regarding the Lightscape Holiday Event. 9. PUBLIC COMMENTS Anton Russell, a Business owner in Arcadia, appeared and expressed his concerns with the issue of homelessness and asked the City Council what they plan on doing to assist these businesses with ongoing issues; and asked if there are any City services available to assist business owners with ongoing issues related to homelessness. Steve Dai, an Arcadia resident, appeared and stated that the Arcadia Newsletter provided by the City provides misleading information to the public. The following Arcadia residents appeared and expressed their reasons why they are in support of the Tiny Homes Project: Mike Veerman Angela Iniguez Jean Jerosz Jacob Pierce Sonia The following Arcadia residents appeared and expressed their reasons why they are opposed to the Tiny Homes Project: 3 08-03-2021 Shan Wang Angie Gren Susan Guo Angela Hui, an Arcadia resident, appeared and played a YouTube video about how homeless should be treated. 10. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck addressed comments made by the speakers regarding the unsheltered population in Arcadia; he stated that he participated virtually in Judy Chu’s Volunteer of the Year Awards on Saturday, and congratulated Ellie Yokota and the Foothill Unity Center for being awarded; he attended the Arcadia Woman’s Club Open House on Friday; he announced that the City was having the Concert in the Park at City Hall on Thursday; he further announced that there would be a hazardous waste collection event Saturday, August 7 at Santa Anita Park; he indicated that he would like to bring the City’s Anti-Camping Ordinance back to revisit the hours and asked for City Council support. Council Member Verlato and Mayor Pro Tem Cheng concurred. Council Member Verlato thanked her neighbor, Tony Fellow, who is on the Board for the Upper San Gabriel Municipal Water District for doing such a great job with water conservation; she further thanked Mr. Schulhof for bringing Lightscape to the Arboretum; she attended an event at the Arcadia Woman’s Club for the 90th anniversary of their building and noted that they are in the process of applying for historical designation of that building; she thanked the Arcadia Chinese Association for donating $1,000 to the Arcadia Woman’s Club; she indicated that she would like to bring a future item to an agenda for a Resolution opposing SB-9 and SB-10 and asked for City Council support. Council Member Beck and Mayor Pro Tem Cheng concurred; she shared a social media post from Patricia Ibarra and stated that the post reinforces the need for shelters in Arcadia and asked Police Chief Nakamura to address the concerns of the police advising these victims to avoid the Downtown Arcadia area. In response to Council Member Verlato, Police Chief Nakamura stated that some of the concerns of the post may have been taken out of context. The officer only advised the victims to avoid the area as the suspect was still at large. The suspect was later apprehended. Council Member Verlato shared a second social media post by Adrian Benitez which asked if the Arcadia Police would have more officers guarding the streets as children return back to school; she further asked what residents should do if they see homeless near the schools. In response to Council Member Verlato, Police Chief Nakamura advised that children’s safety is a high priority and stated the Arcadia Police will provide high visibility and direct enforcement. He stated that safety starts at home and reminded residents to talk to their children about safety; he further addressed that “see something say something” is one of the best messages he could relay. City Manager Lazzaretto also responded to inquiries made by Council Member Verlato; and advised that the public can report seeing the homeless to the City’s Recreation Department and it will be reported to the City’s case manager who would offer them services. Council Member Verlato shared a third social media post by Kristian Martinez asking if it was legal for a 12-year-old to carry pepper spray. 4 08-03-2021 In response to Council Member Verlato, Police Chief Nakamura advised that it is illegal for minors to carry pepper spray. Council Member Verlato shared a final post by David Vance Gardener stating that a transient was walking around Arcadia without any pants and asked the Chief what the residents should do and how would the police respond. In response to Council Member Verlato, Police Chief Nakamura advised the public to call 911 and advised that the police would identify the person and place that person under arrest. Council Member Verlato encouraged residents to join the Community Forum on Homelessness on August 7 and reminded residents to fill out the homeless survey due by this Thursday; she announced that this Thursday the City will have concerts and movies in the park. Mayor Pro Tem Cheng shared a story about taking his mother to a pharmacy and stated that he was so focused on helping his mom he wasn’t listening to what she was saying; he urged people to stop for a second and listen to people before jumping to any conclusions; he thanked Brian Greene and congratulated the Santa Anita Little League All Star team ages 13-14 who won the Southern California Championship, typically they would attend the World Series; however, due to COVID, they could not attend; he attended the Arcadia Woman’s Club event and announced that it is a great location to hold special events up to 175 people; he further announced that the State Fair is free and will be open until August 22; he thanked public comment speaker Shan Wang for his bravery in speaking Mandarin; he stated that Roger Chandler’s birthday is August 5 and thanked him for being the longest serving elected official and encouraged people to send cards to Roger through the City Manager’s Office; he further thanked City staff for coming in to work every day during the pandemic; he indicated that the Community Forum on Homelessness is this Saturday and encouraged residents to attend. City Clerk Glasco provided an update on the projected re-opening of Rod’s Grill later this month; and further advised that Rod’s is currently interviewing for potential future employees in case anyone is interested. Mayor Tay asked Police Chief Nakamura if residents can call the police if they see someone strange in their neighborhood and further announced that if you see something, say something. In response to Mayor Tay, Police Chief Nakamura advised that residents may report homeless or someone that appears suspicious to the police. Mayor Tay reminded residents that the City is looking for applications for the Charter Review Committee and further announced that the Leadership Academy is also looking for applicants that are 18 and over to participate in the 8-week program. 11. CONSENT CALENDAR a. Special Meeting Minutes of July 19, 2021, Regular Meeting Minutes of July 20, 2021, and Special Meeting Minutes of July 28, 2021. Recommended Action: Approve b. Contract with Onyx Paving Company, Inc. for the Fiscal Year 2020-21 Pavement Rehabilitation Project in the amount of $765,000, with a 10% contingency. 5 08-03-2021 Recommended Action: Approve c. Purchase Order with Core & Main for the purchase of AMI Radio Read Water Meters and related infrastructure for the City’s Water Distribution System in the amount of $800,000. Recommended Action: Approve d. Purchase Order with Daniels Tire Service, Inc. for the purchase of Tires and Tire Related Services for City vehicles in an amount not to exceed $75,000. Recommended Action: Approve e. Purchase Order with 72 Hour LLC dba National Auto Fleet Group for the purchase of one 2022 four-wheel drive Chevrolet Silverado pick-up truck in the amount of $59,324.62. Recommended Action: Approve f. New classification specification for Plans Examiner and revise the existing classification specifications for Combination Inspector and Senior Combination Inspector. Recommended Action: Approve g. Final Tract Map No. 82355 with a categorical exemption under the California Environmental Quality Act (“CEQA”) for a six-unit multi-family residential condominium subdivision at 418 Fairview Avenue. Recommended Action: Approve It was moved by Council Member Beck, seconded by Mayor Pro Tem Cheng, and carried on a roll call vote to approve Consent Calendar Items 11.a. through 11.g. AYES: Beck, Cheng, Verlato and Tay NOES: None ABSENT: Chandler 12.
