MINlJlFS ARCADIA CIlY PLANNING COMMISSION REGULAR MEETING Tuesday. November 8, 1988 The Planning Commission of the City of Arcadia met in regular session on Tuesday, November 8 1988 at 7:30p;m. In the Council Chambers of the Arcadia City Hall. 240 West Huntington Drive, with Chairman Larry Papay presiding. PlEDGE OF ALlEGIANCE ROLL CALL: PRESENT: ABSENT: Commissioners Amato, Clark, Hedlund, Szany, Papay None MINUTES MOTON It was moved by Commissioner Szany, seconded by Commissioner Hedlund to approve the Minutes of October 25, 1988 as published. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Ciark, seconded by Commissioner Amato to read all resolutions by title only and waive the reading of the full body of the resolution. The motion passed:.by voice vote with none dissenting. Santa Anita Avenue and 15 East Newman Avenue Bowden Development, Inc. Consideration of a zone change from R-3 600 and (multiple-family res) and R-l (Single-family res) to CoO (professional office) Chairman Papay opened the public hearing for additional testimony. ;' vi . . Bruce Adams, General Manager, Bowden Development, the applicant, 425 East Huntington Drive, Monrovia, spoke in favor of the zone change. There were concerns. voiced in the original meeting concerning parking and traffic. After the original meeting he talked to some of the neighbors and indicated the developer's willingness to work with them and try to mitigate any negative impacts which might be associated with any type of development on this site. He felt the best use of this property, an office use, is consistent with the development to the north of this property which Is office use and most of the other uses along Santa Anita J\venue. He indicated the building would be oriented towards Santa ,Anita Avenue, The east portion of the lot will be utiiized for parking, Mike LudekllY. 25 South First Avenue, Arcadia. business owner in downtown Arcadia, spoke in favor of this zone change. He felt this was the kind of development which would encourage more business, for the City of Arcadia. He felt this developer would do the best job on this site. David K. Robinson, Attorney with Hahn & Hahn, 301 E. Colorado Boulevard, Pasadena spoke on behalfof'his sister-in-law, wife, and children of his deceased brother, who own the property at 610 North Santa Anita, which, is next to this particular property. He spoke in favor of the proposed zone change. It was his opinion that this isa responsible and proper development for the property. He noted that Santa Anita is a heavily travelled street and is not appropriate for residential and he feit that the proposed zone change Which is consistent with the general plan is the best use of the property. Gene Gioia, 21 East Newman Avenue, spoke in opposition to the zone change. He noted that everything north of the freeway is residentisl and every1hing south of Huntington Drive is all residential. The four corners of Santa Anita and Newman are residential. Since the last meeting, all sixteen of the residents have indicated their opposition to the proposed zone change. They 'are concerned with added traffic and egress from Newman Avenue. Also an increased danger to children on the block. An office use is not appealing to the area. Newman Avenue is strictly residential and the property owners on Newman Avenue would like to keep it that way. Bruce Adams spoke in rebuttal stating that. he felt that R'3'would create the same types of problems in regards to traffic, ingress and egress and parking. He did not feel that C-O would be any more negative than R'3. C'O is a professional office' zone and not retail which could result in the concerns expressed by Mr. Gioia. He indicated they were prepared to work with the neighbors in regards to the design of the project in terms of ingress and egress, parking, landscaping, etc. ~TION It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing on zone change Z-88-004. The motion passed by voice vote with none disseniing. Commissioner Hedlund intlicated that he did not feel that a parking lot serves as ail adequate buffer between residential and commercial. The parking would have an additional Impact in the area. He did not see the need for additional office space at-this location and felt II should remain residential. Commissioner Clark agreed with Commissioner Hedlund. He felt that the Commission should take Into consideration that the sixteen residents that live in this area do not want commercial on this block. Commissioner Amato concurred with Commissioners Hedlund and Clark and thought it should stay the way it is. Commissioner Szany thought R-3 was the best buffer for R-L Arcadia City Planning Commission November 8 1988' Page 2 . . Chairman Papay, thought there was a significant differen~ between R-3 and commercial in regards to people working there and people living in a neighborhood. He felt R-3 was a good buffer between R-1 and anything commercial. M:>TION Moved by Commissioner Hedlund, seconded by Commissioner Clark. that the staff relay to the City Council that the consensus of the Planning Commission is in opposition to zone change Z-88- 004 and that the property remain R-3. PUBLIC HEARING M.P. 88-027 423 California Street Paul Bazerkanian for Rebecca Lu Consideration of modifications for 'a proposed 3 unit multiple-family residential complex ' The staff report was presented and the public hearing was opened. Commissioner Hedlund noted that the open space between the buildings was being used for parking. In response to a question from Commissioner Szanyil was indicated that the air conditioning unitS would be located in wells on the roof. Paul Bazerkanian, 2696 Hacienda Drive; Duarte, representing the applicant ind,icated that the air conditioning units would be located in the roof, unseen from the street. They also had no problems with any of the conditions of approval. M:>TION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed, by voice vote with none dissenting. Commissioner Clark noted that the 'modificatJons requested were ones which have been granted before and are not unusual. He thought this was', a logical and good development of the property and that the materials and colors are attractive. Commissioner Amato indicated the only concern he had was with the air conditioning units, otherwise he thought it was a good development. Commissionar Szany indicated that the development looked good to him. Commissioner Hedlund indicated he did not like the 5'-0' side yard setback and thought there were too many modifications and that it was an awfully tight development on a narrow lot. Commissioner Szany asked if it would be possible to get a 1'-0' planter strip along the driveway, something that could grow up the side of the wall. There was discussion regarding providing a landscape area along the driveway and the impact on the driveway and back out area. MJTPN Motion was made by Commissioner Szany, sec~nded by Commissioner Amato to approve MP 88- 027; that the modification would secure an appropriate improvement and that it comply with all conditions set forth by staff with the additional condition that landscape treatment be provided along the westerly wall without affecting the vehicular turn.around, and find that the design concept plans are in compliance with the ADR criteria. PUBLIC HEARING'C.U.P. 88-026 590 South Third Avenue Sierra Madres Girl Scout Council Consideration of conditional use permit to expand the uses conducted at the Girl Scout meeting house The staff report was presented. Staff noted that they had received a letter from Francis Fletcher in opposition to the conditional use permit. Chairman Papay asked if under the existing conditional use permit are there any limitations in terms of hours of operation. Staff indicated 10:00 p.m. Commissioner Hedlund askad if the vacation day school just operated during vacations and is it for commercial purposes. Staff indicated it doss operate during ,summer vacation and spring vacation according to Ms. St. George. but did not know if it operated for commercial purposes. Staff noted that they are young children not girl scouts which are using the facility for vacation day camp. In response to a question from Commissioner Szany staff indicated that if this conditional use permit was denied they woUld go back to operating as per the original conditions of approval in C.U.P. 76-16 which allowed girl scout activities only. The painting of"the garage, landscaping, etc. are property maintenance problems and whether or not this conditional use permit is approved, must be brought into code compliance. The public hearing was opened. Jane St. George. Assistant Executive Director with the Sierra Madres Girl Scout Council, 101 East Wheeler Avenue. spoke in favor of the cond'itIonal use permit. In regards to the garage the Council has a grant proposal Into the Santa Anita Foundation which would take care of the removal and rebuilding of a garage on the premises. It will be approximately one or two months before they will know if it ha's been Arcadia City Planning Commission November 8 1988 Page 4 . . approved. There are 754 girls from the City of Arcadia and 432 adults which use the facility. As far as parking problems, there are really only about 20 days out of the entire year it is used in the evening for meetings by adults or training. The vacation day camp that they have is a program policy they were starting to see if they could generate more membership, They had approximately 30 children. 10 of which were paid for by tha City of Arcadia Subordinating Council. They do provide girl scouting programs to boys and girls; In regards to the boat. the mariner scouts will be taking that out and using it ,in the l1ear' future. We most definitely plan to take care of the problems that you see there. She indicated that she had no problems with the conditions of approval. She noted that as far as the day camp, the program has changed and she Indicated that they will not' be doing that this year because it did not. do as well as expected In advancing membership and will just be on a week to week basis throughout the community. Commi.ssioner Hedlund asked iithey would be having the day care? Ms. St. George Indicated not in the capacity that they had had it during the summer. It was being done all summer and it did not accomplishing what they had Intended to start out with. This year it will be going from community to community as a program event we do asa girl scout day camp. The City Attorney asked if they charged for the day camp? Ms. St. George answered that they charged just enough'to cover fot someone to be there. They end up paying for It, mainly because it does cover all the expenses that we .have. The City Attorney asked if any sort of State Licensing was required for this type of operation? Ms. SI. George indicated she was not aware of any because they operate a day camp and this is' similar to the day camp. B. F. lamb, representing Mrs. Frances W. Fletcher who lives at 600 South Third Avenue spoke in opposition to the expansion of the c.u,p. Mrs. Fletcher has had a lot of complaints throughout the years because she has experienced parking problems from the girl scout activities. They have a habit of parking in the driveways and have not been very cooperative with Mrs. Fletcher. She is concerned that there will be more traffic with the expansion of the activities. He noted that this summer there were an exceeding number of children on the premises and this is a residentiai area and there didn't seem to be much control to keep the children quiet. When you add day care type of activities it becomes more of a business instead of a community, project. He talked to the homeowners just, south of the, school and two of the people are not in favor of these new activities. Jack Miller, owner of the property at 314-316 EI Dorado Street which is directly north of the girl scout house. spoke in opposition to the conditional use permit. He noted that since the time the girl scout house was built this area has changed and apartments and condominiums have been, built in the area. His apartments back up the scout house. His concern is that if they are allowed to have over night activities there could be additional noise from the premises which would affect his tenants. Some of his tenants work nights and sleep days and the extended day care activities are a problem and could be detrimental to his property. Dean Johnson. owner of the property at 516 Soulh Third Avenue. north of the girl scout house. He Indicated that ,he, has lost tenants because of the noise factor. The day camp activities have had an affect on the desirability of his income property. When they had the day camp last summer he thought there were 40 or more children on the premises. He felt this was too close to his property and was not an appropriate use. Arcadia City Planning Commission November 8 1988 Page 5 . . Commissioner Amato asked if the four unit complexes around this property have been there all the time or were they just built recently? Mr. Johnson indicated his complex was built approximately 15 years ago. Jane St George spoke in rebuttal indicating that these people have been good,neighbors. As far as ovemight camping is concerned, It is only fOr'lhe brownies and they are not allowed to camp outdoors, As far as the day camp, she noted they,are planning only to do it for one wee,k at a time. She felt that the Arcadia Scout House has been a credit to the communi!y. In regards to the day camp, many children live in the communi!y and walk to the day camp and if parents drive, they take children to the door, sign in and then leave. As far as the training that we have, there are approximately 20 per year with an attendance of 40 people. There are nine parking spaces on, the site and many of the people car pool. It is not used that much during the year. Commissioner Szany asked what they use the garage for? Ms. St. George indicated that it is used for .,storage of camping equipment which is .loaned out to troops, storing of calendars, craft supplies; equipment, tents, flags, etc. Commissioner Szany asked when most people drop their children off during the day time, do they usually park in the street and" walk to the gate? Ms. SI. George indicated most do, however, soms do park in the parking area. Commissioner Szany asked if they would have any problems with limiting the amount of children there at one time during the day, Ms, St. George Indicated there would be no problem in limiting the number of children for the day camp, however, some of the troops do exceed 30 children. Commissioner Hedlund asked how frequently they would have to have day camp and camp outs? Ms. St. George indicated that camp outs are something that they do the most of during the spring; it is at the discretion of the troop leader. It is not very many times. The day camps itself Is one per community during the summer and it generally lasts from 3 to 5 days. The extended day camp was a program event in oider to bring in memberships and extend the girl scout way of living" etc. and provide a help to the parents. Staff indicated that the indoor camp out was an approved activi!y in the original conditional use permit the only major change in this conditional use permit from the original conditional use permit is the vacation day camp. t.<<)IDN Motion was made by Commissioner Szany and seconded by Commissioner Clark to close the public hearing. The motiori was passed by voice vote with none dissenting. Commissioner Clark asked if the vacation day camp was the only additional activl!y that was being requested by this conditional use permit. Staff indicated that that is the major exception. There were a couple of additional items but they are girl scout related activities, The complaint that staff received was on the vacation day camp activity because it was an expansion of the activities on the premises. Arcadia Ci!y Planning Commission November 8 1988 Page 6 . . The City Attorney ask/ld if the C.U.P. 76-16 stated that this is for the .use of girl scout activities.. Staff indicated that was correct and then it listed some specific ,activities such as indoor campout,- cookouts, but did not include vacation day camp. The City Attorney indicated that the other uses then were a matler of right under the old conditional use permit and the only exception seems to be the vacation day camp. Commissioner Szany lodlcated he was concerned about this extending Into a day care facility. Chafrman Papay indicated that because this was a residential area the major concern which has been expressed is regarding the inclusion of the day care activity and this saams to be the crux of the matter. There was discussion ragarding the evolution, of this from a day camp to a day care cenier. A week day camp is more in concert with girl scout activities. Chairman Papay indicated that Mrs. S1. James had indicated the purpose of the vacation day camp was to try to increase enrollment of the girl scouts by children coming there for the experience and she has indicated that it was not successful. He thought the reason it was unsuccessful was because people were using it for a day care center. It if is to be a day camp activity It is II weak here and a week' there. Commissioner Clark felt the expanded uses were too intense for a residential area. He felt they should comply with C.U.P. 76-16 and not expand the actiVities, He felt It was broad enough regarding the types of activities permitted. In concerns regarding noise and the impact on the neighborhood are very valid. There was discussion regarding limiting the hours and .the number of children a vacation day camp activity could have. Commissioner Szany asked staff how this would"be policed. Staff indicated the only way this could be policed was by complaints. Staff commented that when they were out there, it appeared to be, a day care school and the activities did not appear to be an activity normally associated with girl scouts. Most ofthe children were small children and staff was not sure how this would encourage those children to participate in girl scout activities, It appeared to be more of a community service. PUBLIC HEARING T.M. 46931 120-122 Diamond S1. Adel Moufarrej Consideration of a tentative map for an 8 unit residential condominium project Arcadia City Planning Commission November 8 1988 Page 7 . . ComlT1lssloner Szany indicated that his firm was Involved in the design of this project, therefore, he was abstaining from this project. The staff report was presented. AI Derenzi with L & D Engineering. 1 06 West Lime Avenue, Suite 205, Monrovia, the engineer spoke In favor of the project and indicated that the applicant has' reviewed the, conditions of approval and accepts them; ~mN Motion was made by Commissioner Clark. seconded by Commissioner Amato to close the public hearing On T.M. 46931. The staff report was presented. Engles Shen, 600 West Main Street. Alhambra, representing the applicantlndlcatd the datached four unit compiex meets or exceeds all code requirements. They'agreed with all conditions of approval. Brian Kist, 320 Diamond Street, wanted to go on record noting that this is the second unit of this type on Diamond Street in this area and he expressed concern regarding the proliferation of units in this area. He was also concerned with blocking the view of the mountains. He thought, however, that the detached units were more desirable than attachad units. Mr. Shen indicated in rebuttal that this is a wide lot and four units is an appropriate development on the site. ~TON Motion was made by Commissioner Szany and seconded by Commissioner Amato to close the public. hearing. The motion passed by voice vote with none dissenting. Chairman Pllpay noted Mr. Kist's concem but notedth!lt this is one of the nicest and least dense projects the Commission has ,seen in that area. PUBLIC HEARINGT.P.M. 88-020 811 South Second Avenue Un Ming.Te Consideration of a tentative parcel map for a 2 unit residential condominium project The staff report was presented. Engles Shen, 600 West Main Street. Alhambra, representing the owner spoke in favor of the project, and indicated acceptance of all the conditions of approval. M:>TION Motion was made by Commissioner Clark, seconded by Commissioner Amato to close the public' hearing. The motion passed by voice vote with none dissenting. Commissioner Hedlund was concemad about who regulates two and three unit condominium projects' and the maintenance of said projects. The City Attorney advised that he reviewed the covenants for two and three unit condominiums and indicated that the City was including in the CCR's to agree to adhere to all of the City's property maintenance requirements and a copy of those requirements are attached as an exhibit. The developrs that have done the last couple of covenants have willingly accepted this and ,signed the CCR's. This helps to insure that the property will be adequately maintained and there are specific standards which are set forth in our property maintenance ordinance. This hopefully helpS mitigate some of tha possible problems that have been alluded to. There was discussion regarding a project complying with all coda requiraments as part of the requirements for a tentative parcel map. PUBLIC HEARING MP 88-030 407-411 South Third Avenue Jason Fan, President of Antron Builders CO"lnc. Consideration of modifications for a 5 unit residential condominium project The staff report was presented. Commissioner .Hedlund asked if staff had a reason for /8Commending approval of the S'-O. between buildings in lieu of the 20'-0. required. It was indicated that in staffs opinion the building separation accommodates the architectural projections and stili provides for air space. Jason Fan. 505 East Longden Avenue, Arcadia, the applicant. spoke in' favor of the project and concurred with all the conditions set forth in the staff report. He noted the project provides for more open space and the,detached units provide for more'guest parking spaces than required by code. Mr. Fan commented that the 8'-0' between units is where there are architectural projections; the average distance is approximately 11 '-0. and this is between the bathroom areas and not living areas. Commissioner Szany indicated he didn't mind the distance between buildings as long as it was not betWeen the living areas. M;)IDN Motion was made by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark Indicated he Iik,ed the project and the detached unit concept and thought the three modifications requested were minor. Commissioner Szany, said 'he didn~t mind them detached and gelling the ail space in between the units as long as you don't have major rooms adjacent to each other, i.e.. living rooms, bedrooms, etc. The way it is desig ned here the designer has'taken that into consideration. Chairman Papay thought it was Weli designed. M;)IDN Motion was made by Commissioner Clark, seconded by Commissioner Amato to approve MP 88- 030 with the finding thanhe request would secure an appropriate improvement and the design concapt plans are in compliance with the ADR criteria and subject to the conditions outlined in the staff report. PUBLIC HEARING MP 88-031 307'E.Duarte Road Kuang-Un David Wang Consideration of modifications to permit a third unit The staff report was presented. Kuang-Lin David Wang, the owner, spoke In favor of the request noting that the sleeping quarters had been converted into a third unit by the previous owner, and that it was nice construction. He noted the site would allow three units per the code requirements, Charles Fibus, 313 E. Duarte Road, Arcadia, questionad what the applicant was going to do. He was opposed to the location of the trash enclosure. It was explainad" by the Commission that the applicant was not proposing anything new, but just requesting to keep the existing units. . Mr. Wang indicated there was more than one place they could put the trash enclosure. M:)TION Motion was made by Commissioner Szany and seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Szany did not find the parking modification acceptable and was concerned with the substandard unit size. It was Chairman Papay's opinion that modification requests C and D relating to the unit size and the parking were not acceptable. He felt that an undersized unit and being minus 3 parking spaces was a problem that could not be resolved. Commissioner Hedlund had a problem with making this substandard unit legitimate. Commissioners Clark and Amato agreed that requests C and D were too major a modification. M:)TION Motion was made by Commissioners Clark, seconded by Commission Amato to'deny MP 88-03t finding tMt the proposed request would not secure an appropriate :improvement or promote uniformity of development. PUBUCHEARlNG Home Occupation Permit 85-124 136 W. La Sierra Drive Mr. & Mrs. Wayne Brooks Dreamscape limousine Service Consideration of an appeal of the condition of approval of 1he Home Occupation Committee to allow the operation of a limousine service subject to the condition that only one limousine be allowed; applicant is requesting three limousines to be parked on the premises The staff report was presented. Commissioner Hedlund asked if goods and services are not to be generated to or from the property as part of a home occupation perm". He did nollhink a limousine service was compatible with thaI. The City Attorney indicated that generally that is the policy and principal behind the home occupation ordinance because we are trying to preserve the residential character of a neighborhood. Elizabeth Brooks, 136 W. La Sierra Drive, applicant. spoke in favor of the request. She noted that when they applied for the original permit in October, 1985. they only had one car. In 1986 they acquired another car and ,got the necessary permits and decals from the business license. In 1987 they got the third car and got the permits and decals for the three automobiles. They were not aware that,the original home occupation permit only allowed one 'car because they had gotten the necessary permits and decals from the Business License office. The limousines are parked behind gates and are not visible from the street unless they are being moved out. They do have other cars parked in the driveway. They had anticipated building a large garage in the back of the house to clean and house the cars. We have talked to many neighbors and most do not care about the business. She commented that their son has detailed cars in the front but "is not a business. he does it just for friends. Mrs. Evars stated in her letter that we wash the limousines in the street with the doors open; Mrs. Brooks said they do wash them in the street which they started in late September because of all the changes"lhey were doing in the bac'k yard. They try to operate their business properly and not harm anyone. Moving the service out of their home after operating for almost four years ihere would be very costly for them. The least expensive thing they have found to house the limousines cost approximately $1644 a month. Being a part-time business they cannot afford to do thaI. They requested that the permit be renewed and they would be willing to make any' necessary changes to make it work. Commissioner Szany asked how many vehicles they have? Mrs, Brooks indicated thay did have t~n vehicles including the limousines. Commissioner Hedlund asked how often the limousines leave the property? What hours? Mrs. Brooks answered that they are a part-time business and basically operate on Saturday. Commissioner Clark asked regarding Ihe home ocCupation permll which was granted in 1985, did they not realize il was limited to one permit? Mrs. Brooks said it started, as a pari time business. They thought il was okay because they had secured the permits for the other cars. In response to a question from Commissioner Hedlund, Mrs. Brooks indicated that .they do not have any other employees and she does nol recall signing any conditions of approval. The City Attorney commented in response 10 one of Commissioner Hedlund's questions, there is a specific code section which states in part that the home occupation shall not result in or generate parking or storing of commercial or non-commercial vehiclas on public streets, then it goes on to define commercial vehicles. It ,specifically refers to public streets. Mr. Wayne Brooks, 136 West La Sierra Drive indicated they did not know they were in violation of the code other than washing cars out in the street. He noted this can be corrected and that' he has enough room.in the back, where he can wash and maintain all the cars. He indlcated'he was going tostart'gettin9 rid of some of his cars; he would like to house all the limousines on the site. Dean Horstman; 116 West Las Sierra Drive, spoke In opposition to the expansion of the home occupalion permit. He noted that one of the big objections to having all these limousines on the property is the fact that they are heavily used on Saturday nights and about ,lor 2 in the morning the limousines return and they tend to shuffle cars around and it is very disruptive to the immediate neighbors. This also happens on Friday nighls. He fell il was an inapproprlale use to be operated in a residential neighborhood. The motion passed by"voice vote wilh none dissenting. Commissioner Hedlund indicated Ihat he did not feel a limousine service was an appropriate use in a residential neighborhood and it was his opinion that the permit should not have even been granted for one limousine. Commissioner Szany agreed wilh Commissioner Hedlund. He thought the purpose of the home occupalion ordinance was for very low use, not an intense use. He thoughl the limousines should 'be stored in the proper commercial area; not in a residential area. One Iimousine--might be okay, but three limousines are, gelling to be .too intense'a business. plus they have seven other vehicles on the same site; he just did not think iiwas tha 'proper location. Commissioner Clark Ihought three limousines were 100 intense; he could live with one limousine but three were 100 many. Commissioner Amato concurred. Chairman Papay notedthatthis demonstrates the type of"problem you can get into when you have a home businessas thaI starts out "modestly and if ilis successful it grows beyond Ihe bounds of a home business.
