MINUTES ARCADIA CITY PLANNING COMMISSION REGUlAR MEETING Tuesday, August 9, 1988 The Planning Commission of Ihe City of Arcadia met 111 regular session. on Tuesday, August 9, 1988 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. MOTION II was moved by Commissioner Clark seconded by Commissioner Szany to read all resolutions by title only and waive reading the full body of the resolutions. Planner Wilfred Wong Assistant Planner James Kasama Secretary SilVa Vergel . . . PUBUC HEARING CUP 88-019 536-600 W. Las Tunas Dr. Richard Slen, Terry and. Louisa Kuo Considerallon of a conditional use permit to operate a 5,000 sq. ft. restaurant. The staff report was presented and the public hearing was opened. Red Wong, 212 Monterey, S. Pasadena, was representing the owner. He Informed the Commission that King's Broiler will probablyre-occupy the building and noted that they are in agreement with all of the conditions in the staff report. Kenneth Schmidt, 534 Workman, asked what the other proposed buildings would be and what type of businesses would occupy them. He noted that on quiet nights they can clearly hear the patrons placing their orders at Wendy's which is on the other side of Baldwin. He was concemed about possible problems such as increase in noise and lighting. He remarked that on occasions patrons park on their street to go to Pic 'N Say and was concerned about the safety In the area. In response to Mr. Schmidt's questions, staff explained the c.u.p. procedure and remarked that businesses such as a yogurt shop, nail shop, boutique and take out food would be able to go on the site without a public hearing but an eating establishment would require a public hearing which would mean that the surrounding property owners would be notified. He noted that the building next to the restaurant would be a two-story building with office on the Second floor and retail uses on the first floor. It was noted' that there is only one developer but the site consists of 3 lot!; and a covenant would be required to keep the lots as one parcel. It was noted that the buildings would be at ,least 75' away from the preschool to the east and there will be a block wall separating it from the properties to the rear, the buildings will be located closer to Las Tunas. The proposed plans were shown to Mr. Schmidt. Commissioner Papay reiterated what staff said and assured Mr. Schmidt that public hearings would be held for certain types of retail uses such as an eating establishment. He said that outdoor lighting would ensure the security of the center. He reminded Mr. Schmidt that this cup is for the restaurant only. The City Attorney, Mike Miller, explained that the Planning Commission can approve, conditionaily approve or deny the project. .It Is the Commission's prerogative to establish conditions to mitigate specific concerns which would give the Commission greater control over the situation. The c.u.p. allows the City to take a closer look at certain types of uses and the city is expanding the types of uses. that require a c.u.p. prior to coming into an area so that it isn't just a matter of right and that they have to meet the zoning code. By making more uses subject to the c.u.p. process-they are affording the 'City greater control in approving uses which come into Arcadia. Terry lenox, 547 Workman, commented that she felt the same as Mr. Schmidt. She was concerned about the safety In the area and the Integrity orthelr neighborhood. She was afraid that this might create some problems. She was not pleased with retail stores going into the center and said. that she would prefer office buildings there and noted that on occasions she has noted sometimes people loiter In the Pic 'n Sav parking lot and create problems. She asked If the windows of the office building would face their properties. She noted that at the present time there aren't many buildings on the site and police can easily monitor the parking lot for possible problems while driving by Baldwin or Las Tunas but with the increase in the number of buildings, it would be more difficult for them to see between buildings. Ms. Butler remarked.that if the windows are facing to the east and to the west. She stated that they are only 1 parking space shy of what Code requires and noted that that request for the reduction of one parking space was approved by the Modification Committee who felt that this was not a significant variation from the Code. l.ynn Juememann, 535 Workman was concerned about the lights shining down on her property and asked about the locations of the buildings in relation to Las Tunas. Staff said that the total site consists of 64,320 sq. ft. and the office building would setback 5'- O' from Las Tunas and would sit 50' from the south property line. Mr. Schmidt,asked if the L1ses that are specified in the plans have been approved and said thathe was concerned about lights shining down on his property asked if delivery hours could be limited. Staff commented that the uses shOwn on the plans are examples only and have not been approved by the City. Staff indicated that Code prohibits the lights from shining directly into adjacent properties and noted that. the lights would be lowered to minimize that problem. Staff informed the Commission that delivery hours can be limited as a condition of approval. M)~ It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote With none dissenting. Chairman Papay wondered if ihe delivery hours as well as the restaurant hours could be limited. Commissioner Clark said that it is a nice development arid the landscaping woUld enhance the center. Commissioner Amato agreed and said that he liked the concept. He didn't think that hours should be imposed on the restaurant but felt that it would be appropriate to limit the delivery hours. Mike Miller said that the center could be monitored and if problems arise then the c.u.p. could be brought up before the Commission for additional hearings to resolve the problems. MOllON It was moved by Commissioner Szany, seconded by Commissioner Clark to approve CUP 88-019 subject to the conditions in the staff report with the additional condition that deliveries shall be prohibited between the hours of 7:00 p.m. and 7:00 a~m., that the c.u.p. remains subject to the imposition of business hours requirements if reports and complaints warrant the consideration of such a condition and that the Plan~ing Commission retains continuing jurisdiction concerning business hours and that the uses shown on the applicants' plans are not approved and are used as examples only. Ruiz Consideration of a conditional use permit for the expansion of a!l existing automobile garage with modifications. The staff report was presented. Staff remarked that the on,site parking cOmplies with Code. The public hearing was opened. Robert Ruiz. 333 N. First. stated that he is in agreement with all of the conditions in the staff report. He anticipated construction In December or January and said that the proposed plans are the best; both economically and as far as how it fits on the lot. The garages will not be facing First Avenue and asked for the modification for the planter to be approved. He commented that all work would be done inside ihe garage and they have enough room or5 cars. M01lON It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by vciice vote with none dissenting. Commissioner Hedlund. felt that it is better to work on the cars in$ide a building than outsjde and he was in favor ofthe cup. Commissioner Amato wondered If the construction could be expedited. Commissioner Clark agreed. Consideration of a conditional use permit for a commercial building containing more than 20,000 square feet within 100 feet of residentially zoned property. Existing commercial retail center contains 37,024 sq. ft. Applicant proposes to demolish existing 8,320 sq. ft. of retai, shops and enlarge grocery store by 13,000 sq. ft., which would add 4,680 sq. ft. of building to the site. The staff report was presented. Staff said thatthe oak tree will remain on the lot and said that there .is an existing 22' high wall and the requested modification Is for the same. The public hearing was opened. James Thomas. T.J. Scofield, 455 Main, Boise, Idaho, was there representing Ralphs. He said that Ralphs is trying to keep up with the existing grocery store industry and noted that they are in agreement with all of the conditions in the staff report. He noted that most of the delivery is done during the day and noted that they would not be opposed to limiting the hours ofdelivery. Dee Carrillo, 1101 Artesla, Compton, representing Ralphs, asked about the hours of delivery. Commissioner Szany commented that the limitation on the hours of delivery is necessary due to the center's proximity to residential properties to the rear. James Wilcher, 168 E. Sycamore, feli that they should comply with all the regulations. He asked when would they sweep the site,and said that those machines.are noisy. Staff explained that when the building was constructed, many of-the present regulations were not required. However, they are required to comply with present Code requirements. It was noted that at the present time there is a total of 1800 sq. ft. and no landscaping at the corner of Second and Foothill. After the proposed remodeling the landscaping will increase to approximately 8500 sq. ft. which will improve and enhance the site. Chairman Papay said that 7 out of 8 requested modifications are an 'improvement to the existing situations even though they are modifications. Roger Oepkes;242 E. Sycamore, said that the expansion would increase traffic and noise. He said that the wall will be 8' on Ralph's side but In some areas it will not even be 5' on the resldentlal properties to the north ili lieu of the 6' required by Code. Hefelt"that truck access should be reduced and commented that it would be difficult for emergency vehicles such as fire trucks to get to the klcation and could be a hazardous situation. He didn't think that the parking lot is efficient and said that In some cases people park on t,he cul-de.sac and walk over to the stores. He felt that the reduction in parking spaces would be detrimental. Mrs. Guiwits, 238 E. Sycamore, concurred with Mr. Oepkes and said that there were 2 fires in the past in the trash cans and the wind blew it,onto the roofs of the two homes to the rear which caught on fire. Mr. Thomas said that the trash enclosures will be relocated and this will help mitigate that problem. He noted that'they wiil have security lights on the site. He commented that this particular store will not be converted to a "Gianr store. The driveways will be Improved to better accommodate Ingress and egress from the site. He noted that they would be In agreement with setting up the hours of sweeping and delivery. He commented that they will be upgrading the site by improving the facility, adding parking spaces and landscaping. MOllaII It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. The,motlon passed by voice vote with none dissenting. Commissioner Amato wondered if the transformer to the north would be a noise factor, He felt that it is a nice project He was pleased to see the center better lighted and the additional landscaping. Commissioner Clark felt that It was a nice Improvement. He said that the improvement will reduce loitering. He said that at the present there is hardly any landscaping and liked the Idea that the landscaping would be increased. He said that their parking lot will be improved. He felt that overall the proposal i"s an improvement. Commissioner Hedlund agreed and said that the elimination of some of the stores is a good Improvement. Staff explained the hours of delivery and the sweeping of the site. It was noted that the wall is measured from the lowest adjacent grade and would serve as a buffer between commercial and residential properties and would protect the residential properties, Commissioner Szany felt that It would be an Improvement over the ex/sting situation. Chairman Papay said that it would be improving existing deficiencies. PUBLIC HEARiNG MC 88.64 350 Laurel Ave. Frederick Garside Consideration of modifications for a new two- story house and detached garage (referred from the Modification Committee). Staff noted that 2 houses are being built to the west of the project which were approved under the old regulations totalling approximately 3000 sq. ft. including the garage. The public hearing was opened. Frederick Garside, 350 Laurel, spoke for the requested modifications. He said that he was In agreement with all of the conditions in the staff report. He said that they could move the overhangs back and eliminate the bay window on the second floor, thereby eliminating some of the modifications. He remarked.that the narrowness of the lot necessitates the placing of the garage in the rear yard which would require the modification. He submitted photos of the surrounding area to the Commission. He remarked that they would be able to use the alley to get to the garage. He said that most of the lots in the area are the same size and use the alley. MOllOII It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Szany said that the proposed house is very attractive but does not fit on the lot. The lot is 6300 sq. ft. which Is less than the required 7500 sq, ft. and the proposed house may look like a box if the bay windows and the overhangs were deleted even though it would eliminate some of the requested modifications, The proposed house extends from property line to property line and is not In proportion with the lot. He wasconcemed about the use of the alley which is not easy to move around in and noted that it Would be very tight. He felt that architecturally the house Is too big for the lot. He notedthatthe lots in that area are abnormally small and he was concemed that this would~set a precedent. Commissioner Hedlund wasconcemed about the use of the alley. He commented that he didn't want to penalize. this particular owner but the proposal is too much house for the lot and does not fit well. Commissioner Amato commented that although it Is a nice design, it doesn't fit the lot. Commissioner Clark agreed and said that the house Is too large for the lot. Chairman Papay said thatthis Is a small lot and difficult to work with. The Commission was informed of the options that it has of continuing the hearing to allow the applicant to revise his plans to accommodate Commission's concems, or to deny the request and give the~pllcant the opPOrtunity to appeal the denial to the City Council. Commissioner Szany feit that many of the modifications would not be necessary if the house was smaller. MOllOII It was moved by Commissioner Amato, Seconded by Commissioner Clark to re-open the public hearing. The motion passed by voice vote with none dissenting. Mr. Garside commented that'this area of the City Is the lowest priced area where young couples can still afford to buy. The proposed house covers less than 45% of the lot which is the Arcadia City Planning Commission Avt./J->1" "l Jvly-U, 1988 Page 7 . . permitted coverage by Code. His proposed house is 10' shorter than the new homes that are being constructed .to the west. He said that he didn't want to put the garage on .the side because it would take away from the width of the lot and the garage would then take half of the front.yard. He noted that if the garage was on the side they would lose both landscaping and view from the house. He asked whatthe Commisslonwould approve. Mike Miller discouraged the Commission from advising the applicant about what the Commission will and will not approve. He explained that the applicant should redesign based on the Commissions' comments and feelings. Commissioner Szany didn't think the design fits well on the lot and that it would be beneficial to the,street. He thought there should ~ more space between houses. Mr. Garside asked the Commission to continue ihe hearing to Its next meeting. PUBUC HEARING MC 88-65 356 Laurel Ave. Frederick Garside Frederick Garside. 350 Laurel. said that he was in agreement with all of the conditions in the staff report. He said that he would be willing to reduce the height ofthe wall to 3' and put a 3' wrought iron fence on the 3' wall. Staff commented that the wall will be on the property line. MOOON It was moved by Commissioner Clark, seconded by CommissionerAmato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Szany felt that this house fits on the lot and he liked the proposal. The consensus of the Commission was favorable. RESOLUTION 1382 A resolution approving MP 88-022, for a proposed one-story dwelling with attached garage and overruling the Santa Anita Village Architectural Review Board's at 1010 Coronado Dr. RESOLlJTION 1383 A resolution granting C.U.P. 88~016 to expand an existing eating establishment from 12 to 32 persons at 46 W. Las Tunas Dr. Ms. Butler read the titles of the resolutions. MATTERS FROM COUNCIL None MATTERS FROM COMMISSION Commissioner Hedlund mentioned about the dish antenna being visible from Wistaria and asked if staff could look irito that matter and commented on the manner which it was mounted. He also remarked aboutchlmnys being higher than the roof of the house. Mike Miller noted that if the dish antenna regulations are being challenged, a text amendment could be done to mitigate that. The Commission was concerned about the lots on the east;side which are below the 7500 sq. ft. minimum wllich use the alley as access to the garages in the rear and wondered what alternatives they have in remedying that potential problem. Ms. Butler commented that if regulations were established for maximum floor area allowed, it should be for the whole Cily and not for just one'specific area. She said she could prepare 'a report and submit it to the Commission at a later meeting with options in regard to the fire place encroachments into the setback. At the present a maximum encroachment of 2' is allowed into the side setback which means there is a 3' clearance to the property .line.
