The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to read all resolutions by title only and waive reading the full body of the resolutions. The staff report was presented and the public hearing was opened. SCOII Richardson, 671-4 Brea Canyon Rd., Walnut, representing the applicant explained that the applicant proposes to take the rear 75' of parcel 1 and adcfthatto parcel 2 facing EI Monte which would create more of depth for. that lot and will be in configuration with the rest of the lots ihthe area. MOTION II was moved by Commissioner Hedlund, seconded by. Commissioner ClarlIto close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Hedlund commented that the lot line adjustment seemed needless and felt that the existing depth would be beller for parcel 1, especially if the lot were to be slit in the future. Chairman Szany was concerened that even after the lot line adjustment ihe .appllcant can still split parcel 1. Chen Consideration of a conditional use permit and parlllng and landscaping modifications for a game arcade with 31 game machines. Arcadia City Planning Commission May 24. 1988 Page 2 . . The staff report was presented. Staff explained that the modifications are for 8 parking spaces and landscaping modifications in the parking lot. The public hearing was opened. long Chen, 230 E.Californla St., the applicantstated that he is In agreement with all of the conditions In the staff report. . Chairman Szany asked If Mr. long would be willing to reduce the hours of operation In the evening to minimize the affect on the residential properties to the south. In reply, Mr. long said that he would prefer keeping the hours as proposed - Sunday-Thursday, 11 :00 a.m. to 10:00 p.m., Friday and Saturday, 11.:00 a.m. to 11 :00 p.m. Bill Donahue,35 Chrlstina,objected to the proposed use. He commented that since the time that machines have been placed in the donut shop and the liquor store there have been numerous problems. The donut shop was broken into and there have been numerous kids loitering around the liquor store, many skateboards, bicycles, motor scooters and excessive speeds in the parking lot. There have been many kids trespasSing through the property. Two cars have been stolen from tlie parking iot and 4 burglaries in the condos on Christina. Paul Gill, 49 Christina. agreed with Mr. Donahue and added that the parking lot is behind the building and hidden from the street and there are many different activities taking place there and felt that the new business would magnify the existing problem. Robert Netherton, 63 Christina, was against the proposed use. Betty Norgarp, 20 Christina, said that there many people trespassing through her property and remarked thai her home was burglarized. She was concerned with the hours of operation. Anna Mae Troncolll. 11 Christina, agreed with her neighbors. Anita Donahue, 35 Christina, said that there areschoois inclose proximity to their house and kids from the schools loiter around the donut shop and the IIql!or store before school, during lunch hour and after'school and she didn't think that this is a good activity for the children. She commented that the kids run over their yardS with their bicycles and motor scooters and skateboards. The applicant was asked'if he would like an opportunity;for rbuttal and the applicant indicated 'no' by shaklng his head. M0110N It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Staff noted that the occupancy figure of150 was set by the Fire Department. Commissioner Hedlund didn't think that the use could accommodate 150 persons. He felt that the proposed business would infringe on the other businesses and said that there could be an enforcement problem. Arcadia City Planning Commission May 24, 1988 Page 3 . . Chairman Szany lelt a mall would be a better location lor this type of business. He thought that the use is fine but It probably would be better II it was located in an area where it could be easier policed. Commissioner Hedlund was concerned with the congregation 01 the people and parking and thought that it might be a potential problem even though it is a permitted use in said zone. Commissioner Amato was concerned with the traffic. MOllON . It was moved by Commissioner Clark, seconded by Commissioner Amato to deny C.U.P. 88-009. Las Tunas Dr. Juan & Hilda Alvarez Consideration 01 a conditional use permit and parking and landscaping modifications lor a pizza parlor with eight (8) seats. The staff report was presented. In answer to the Commissioner Hedlund's questions, staff said that there has not been a parking problem on the subject site. The public hearing was opened. Margaret Demlncibito, 1519 E. Caroline, Ontario, the real estate agent lor Herbert Hawkins who is leasing the building, was there to represent Mr. and Mrs. Juan Alvarez. She stated that the establishment would not open until 5:00 p.m. and will be mostly a take out and delivery type 01 an establishment. However, in order to better accommodate those patrons who would like to stay on the premises. it is desired to have some seats. She didn't anticipate a parking problem and noted that the conditions have-been revIewed by the applicants and they are in agreement with them. PUBLIC HEARING T.P.M. 88-011 1030 Old Ranch Rd. Mur-Sol, Inc. The staff report was presented. Staff said that the proposed lots are compatible with the lots in the area. Consideration of a tentative parcel map to create two lots from one lot. The pUblic hearing was opened. Richard Ruls. 125 Wheeler. the president for Mur-Sol. Inc. was present and said that they have reviewed. all of ihe cOnditions in the staff report and are In agreement with them. There will be two homes built on the lots. He noted that they have notdrawn.up plans yet and said that the existing homes in the area will be taken Into consideration when drawing up the plans for the new home. MOllON it was mov,ed by Commissioner Ciark, seconded by Commissioner Hedlund to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark noted that both the lots comply and said that he didn't think there would be any problems. PUBLIC HEARING T.P.M. 88-012 1020 Singlngwood Dr. Mur-Sol, Inc. Consideration. of a tentative parcel map to create two Iots.from one lot. The staff report was presented. . Staff said that this property is In the homeowners association and the removal of any trees and the design of any homes would require approval by the HOA and as a condition of approval the applicant is required to submit a tree preservation plan. The public hearing was opened. Richard Ruis, 125 Wheeler, the p~esl~ent for Mur-Sol, Inc. was present and said that they have reviewed all of the conditions in the staff report and are in agreement with them. There will be two homes built on the lots. He commented the new homes will have to be approved by the HOA. Dr. Robert Jay Costarella, 1044 Singingwood Dr., was opposed to splitling the lot and wondered how two homes would fit on those lots with all the existing oak trees. Margarie Lievsay, 970 Singingwood Dr., was opposed to the lot split. She was in agreement with Dr. Costarella and said that Mr. and Mrs. Anderson who live on the north side of the street are against the lot split. She was concerned with a two-story home being built on the new lots. Alfredo Jose, 1004 Singingwood Dr., the neighbor to the east, said ,that the new house will probably be very large and would be a detriment to his property. Irving Rosenbluth, 1001 Singingwood Dr., was against the lot split. He felt that it would be a major change in the character of the neighborhood. .Ronald ,Miller, 741 Singingwood Dr., said that he lives next to a very large and beautiful home that doesn'lbelong in the neighborhood next to all the ranch ,style homes. Ed Daniels, 7n Maakia Lane, chairman of the ARB. He suggested seeing the plans of what will be built before splitting the lot. Mike Millersaid thlltthe Planning Commission's jurisdiction Is the lot split and theARS's jurisdiction is over ihe eventu81 use whiCh ihen could be apPesied:to the Planning Commission or the City Council. Dr. Costarella agreed with Mr. Daniels. Chris Brown, 980 Singingwood Dr., president of the ARB said that moslof the homes in the I)eighborhood are single-story homes and wondered if the new homes would be two-story and what their impact would be on the neighbors. He was concerned about the trees on the lot and felt thatlhe new lots will be well below the standard lot In the area even though it meets code. He asked the Commission to givII this matter very careful consideration. Vince Daily, 950 Singingwood Dr., asked about the front setback and commented that if the lot'split was denied it would not creale a hardship for the owners. Arcadia City Planning Commission May 24, 1988 Page 6 . . Hilda Rosenbluttl. 1001 Singlngwood Dr., thought that this would set a precedent. In rebuttal, Mr. Ruls said that all of the concerns of the neighbors will be addressed through the ARB procedure and remarked that the lots meet or exceed all code requirements. Mike Miller explained that if the lot split Is approved and the developers decides to build homes on the subject Jots they will have to go through the ARB procedure and the ARB's decision can be appealed to the Commission by either the developer or the ARB. . Mr. Woolard commented thatthe designs of the homes are not a part of this procedure. Chris Brown, 980 Singingwood Dr., asked if an additional condition could be added to the approval stating that the developer cannot cut down any trees, give more than the minimum setback and keep the dwellings single-story. Mike Miller addressed Mr. Brown's questions and said. that a tree preservation plan is required, the developer has to comply with the underlying setbacks at the time of development.and unless the developers were to agree to single-story the Planning Commission cannot require single-story. Bart Payne, 1020 Singingwood Dr., the owner of one of the involved lots asked the Commission to approve the lot split and remarked that Mr. Brown remodeled his home several years ago and wondered why he is objecting to the proposal. He said that Mr. Brown~s lot is approximaUey 23,000 sq. ft. and said that he has done everything that he is objecting to. Ronald Miller, 74.1 Singingwood Dr.. wondered if the new homes would fit, even though the height, setbacks and size of the homes will be regulated. He thought that the adjoining neighbors will lose their privacy. Dr. Costarella stated that Mr. Brown's home fits in because although it Isa two-story home it looks like a single-story house. The house did have a f1.ai roof and that was changed several years ago. Alfred Jose, 1004 Slngingwood Dr., felt that this would set a precedent and commented that the existing tennis court is in violation. Commissioner Hedlund assured Mr. Jose'that anything .that is in violation will have to comply when the developer begins building. MOllON It was moved by Commissioner Clark,-seconded by Commissioner-Amato to close the public hearing. The motion passed by voice vote with none dissenting. Chairman Szany felt that the lot split will blend with the area but was concerned about the trees and how the homes will fit on the new lots. Commissioner Hedlund agreed with Chairman Szany and felt that It Is a shame to tear down the existing home. He wondered if a condition could be imposed on the applicant stating that the existing homes cannot be demolished until plans for the new homes have been submitted to the ARB. He stated that many of the lots are approximatley 23,000-24,000 sq. ft. and said that the proposed lots are approximatley 30,000 sq. ft. and the frontage seems to be compatible. Arcadia City Planning Commission May 24, 1988 Page 7 . . Staff remarked that some trees cannot be removed such as oaks, pines, sycamores. Iftheywantto remove a tree, the ARB has to approve it, however, if it is desired to remove a dead tree a statement from an arborist is required' before permission is granted for the removal of the tree. A motion was made by Commissioner Amato to deny the proposed lot line adjustment. The motion faiiled for lack of a second. Commissioner Clark said that even though what is before the Commission is the issue of the lot spilt. one can't help but be concemed about the tYPe of homes that will eventually be built 6n the site. He was not concerned about the lotsplil but about what would be built there. The consensus ofthe Commission was that if the ARB denied the applicant's plans the Commission wOuld most likely uphold the ARB's decision if it was to be appealed to the Commission. In answer to Commissioner Hedlund's question, Mr. Miller said that a Negative Declaration implies that the project has an affect but not substantial or significant enough to require a full environmental impact report. Chairman Szany felt that the motion should include a condition on the trees and said that he would like to see as many trees sllved as possible. He thought that the lot should be distrubed as little as possible to be able to blend.in with the neighborhood. In reply to Chairman Szany's comments, Mr. Woolard remarked that by doing so the Commission is imposing conditions on this developer that is not being imposed upon any present. homeowner of any property in that area. Everyone has the righlto seek to develop or add on to their house and take their plans to the ARB and if it requires a remov~1 of a tree, then they need approval from the ARB. He didnUhlnk conditions should be imposed on the developer that are unlike anything' that affects anyone in the area. Mr. Miller agreed with Mr. Woolard and said that the conditions have to be reasonable conditions and related to the applications and they can't become prohibition on development. MOllON It was moved by Commissioner Hedlund, seconded by Commissioner Clark to awrove T.P,M. 88-012 subject to conditions in the staff report with the modifications on Findings A.1, A.2 and A.3 to read that the project may have a significant impact on the environment. Amend Sec. 9115.12 relating to time extensions for tentative maps to be consistent with the State Subdivision Map Act. The staff report was presented. Staff explained that this would allow a maximum of 3 years for tentative maps, 2 years for the tentative map and one year for time extensions. The public hearing was opened. Mr. Woolard referred to the letters from the applicants which explains why they would like to modify the tree preservation plan. Consideration of a tree preservation plan; required as a condition of approval ofT.P.M. 87-7, a lot split to create two lots from one. Mark and Anne Phillips, 5355 Weiland Ave., Temple City, were present to answer any questions from the Commission. She said that the large deodora to the north is in the way of the proposed driveway, even if the driveway was to be moved, the tree is very large with a deep root system going very close to the driveway. The subjecnree is not noticeable from the street. She stated that they will be puttlng a wall along the property line and two trees are right in the way of the wall. She remarked that the neighbor to the north would like to see these trees removed. She noted that they have tried very hard to save the oak trees so that their additlons would fit on the property and avoid the oak trees. Staff Indicated that during the site inspection, the 14" deoclora to the south did appear to be sufferh1g from certain problems. He felt that the house and the driveway could be designed to save the 20' deodora. Arcadia City Planning Commission May 24, 1988 Page ]0 . . . Commissioner Clark commented that there are a lot of trees on the lot. Commissioner Hedlund was in favor of the change and was pleased that the oak trees were being saved.
